Uphill Battle Likely If Law School Faculty Sue Indiana Tech

A lawyer retained by a faculty member at Indiana Tech Law School is questioning the university’s explanation for closing the school.

Christopher Mackaronis, principal at Stone Mattheis Xenopoulos & Brew P.C. in Washington, D.C., said he is currently representing one faculty member and is “working with” other faculty members at the Fort Wayne law school. The possibility of filing a lawsuit against the university has been raised but Mackaronis said the teaching staff is still determining what steps to take next.

Indiana Tech cited financial constraints when it announced the closureOct. 31, effective at the end of this academic year. The university noted it had already sustained a loss of nearly $20 million from operating the law school and, looking at future enrollments, believed the deficit would continue to grow.

Mackaronis said the university knew it was going to have support the law school financially. It assured the faculty it was committed to making the program successful and never placed any conditions that it could reconsider its intentions if, for example, enrollment did not grow or bar passage did not improve.

Instead Indiana Tech portrayed itself to the professors as being fully behind the law school. Then it suddenly reversed course which, Mackaronis said, has left many faculty members shocked and angry.

“It’s not like we’re changing the color of the sofa in the lobby,” he said. “This is a life- and career-changing decision that effects (71) students and the entire faculty and administrative personnel, all of whom are losing their jobs.”

However, Brian Tamanaha, professor at Washington University School of Law in St. Louis, believes the professors will likely have a tough time proving the university knowingly misrepresented its intentions.

Tamanaha drew national praise for his 2012 book, “Failing Law Schools” which examined the growing problems in legal education stemming from the decline in applications and rise in tuition. Noting the trend of fewer students wanting a J.D. had already been established by the time Indiana Tech opened its law school, he wondered why the Fort Wayne school went ahead with its plans.

“The only thing they could have done to mitigate this was not to open,” he said.

While the university could possibly have never intended to fully support the law school, Tamanaha said the situation looks like Indiana Tech simply did not have the financial resources to continue its legal education program.

The university has a relatively low endowment and is dependent on tuition for funding its operations. Coupled with the small class sizes, he said the university was clearly subsidizing the law school.

Of more concern is the students, Tamanaha said. As they look to transfer to other law schools, some may have difficulty if they have low undergraduate GPA and LSAT scores.

The American Bar Association is moving toward requiring law schools post an average bar passage rate of 75 percent, so many schools are working to improve their graduates’ performance on the bar exam. Consequently, schools might be hesitant to enroll any Indiana Tech student who is marginally qualified and appears likely to fail the bar.

Indiana Tech President Arthur Snyder was scheduled to speak with the Indiana Lawyer Wednesday but cancelled the interview because of a scheduling conflict. In the closure announcement, he commended the faculty and said the university would assist the J.D. candidates currently enrolled.

“Our first concern is for the law school students,” he stated. “We will be working hard on behalf of each of them to ensure that the process for transferring, for continuing their legal education, and ultimately earning their law degree take place with as little disruption as possible.”

Indiana Tech Law School Dean Charles Cercone told Indiana Lawyer this week that he has reached out to law schools in Indiana and Ohio about student transfers and received a “good reception.”

Cross Country Programs Turn Attention To Midwest Regional

The University of Southern Indiana cross country programs turn their attention to the NCAA Division II Midwest Region Championships this Saturday at Angel Mounds. The men’s 10-kilometer race begins at 10:30 a.m., while the women’s 6k is slated for an 11:45 a.m. start time.

Eagles in the Rankings
Improving by a single spot in the U.S. Track & Field and Cross Country Coaches Association Top 25 and Midwest Region rankings, the USI women’s cross country team jumped Cedarville University in both polls last week. In the national poll, USI sits five points outside the top five in sixth with 161 points. Grand Valley State continues to lead the region poll with a second place ranking in the USTFCCCA Top 25.

With seven of 10 schools shifting position in the USTFCCCA Top 10, the Eagles’ men moved into seventh after gaining 18 more points in the poll. In the final Midwest Region poll, the top two spots remained unchanged with Grand Valley State and USI atop the list. The following five places all shifted after the conference championships week.

GLVC Dominance Continues
Junior Emily Roberts (Fredericktown, Ohio) earned the first GLVC Runner of the Year award for the USI women’s program since 2011 to help the Eagles win their sixth-straight GLVC championship. The time of 20 minutes, 36.03 seconds for Roberts set a new GLVC record, as did the USI margin of victory (55 points). Senior Jessica Reeves (Midland, Michigan) earned a second-place finish, while three others joined the duo on the All-GLVC team.

Seven All-GLVC runners at the conference championships sealed the men’s 12th-consecutive GLVC championship and 24th overall, the most of any sport in GLVC history. Junior Bastian Grau (Höchstadt, Germany) paced the Screaming Eagles with a runner-up performance, while senior Chase Broughton(Marengo, Indiana) also earned a top-five finish placing fourth. Freshman Nathan Hall (Springfield, Missouri) earned GLVC Freshman of the Year honors with a 13th-place finish, the eighth time and second-straight year a USI runner has earned the award.

2015 Results
Grand Valley State University won both the men’s and women’s regional crowns a year ago. The Lakers have won the last 15 women’s regional championships and the previous 14 men’s regional titles.

With a fifth-place finish, USI’s women were the final team earning a spot at the NCAA II National Championships, falling just 11 points short of third place. Junior Emily Roberts (Fredericktown, Ohio) and senior Jessica Reeves (Midland, Michigan) enter Saturday’s race as favorites in the women’s race after leading USI to its sixth straight GLVC title. Roberts was fifth at the NCAA II Midwest Region Championships a year ago and is the top returning runner in this year’s race, while Reeves was 16th. Grand Valley State’s Kendra Foley, who was sixth at last year’s regional, also is among the favorites in the women’s race after capturing the GLIAC title this year.

In the men’s race, Grand Valley State defeated the field by 79 points. The Eagles placed second with a four-point margin over GLVC foe, the University of Wisconsin-Parkside. The Rangers’ Jake Dubnicka us the top returning finisher from the 2015 event after a third place finish. Chase Striegal of Bellarmine University and Zach Panning of Grand Valley State also return after rounding out the top-five finishers in 2015. Senior Chase Broughton (Marengo, Indiana) earned All-Region honors with a ninth-place finish a year ago.

Regional Field
The Midwest Region consists of teams from the Great Lakes Valley Conference, the Great Lakes Intercollegiate Athletic Conference, and the Great Midwest Athletic Conference. Around 30 teams and more than 200 student athletes are expected to compete in each race.

Grand Valley State is the top-ranked team in both the men’s and women’s races as the Lakers enter the weekend ranked No. 2 in both U.S. Track & Field and Cross Country Coaches’ Association Top 25 polls.

The Midwest Region also is represented by six teams in the USTFCCCA Women’s Top 25. In addition to Grand Valley State and USI, the region also features No. 8 Cedarville, No. 10 Northern Michigan University, No. 11 Hillsdale College and No. 22 Bellarmine. Lewis University and the Wisconsin-Parkside are receiving votes outside the Top 25.

In the men’s Top 25, the Midwest Region is also represented by Saginaw Valley State University (No. 13), Hillsdale (No. 17), Lewis (No. 22) and Bellarmine (No. 11). Walsh University is receiving votes outside the Top 25.

The top five teams from each race Saturday advance to the NCAA II National Championships, which are November 19 in St. Leo, Florida. The top three individuals not from a qualifying team—or the top five overall individuals if none are from qualifying teams—advance to the national meet as well. All-Midwest Region honors go to the top 25 finishers in each race.

2016 NCAA II Midwest Regional
This is the third consecutive year that USI and the Evansville Sports Corporation have teamed up to host the NCAA II Midwest Region Championships at Angel Mounds. The NCAA II National Championships will be at Angel Mounds in 2017.

With a 10:30 a.m. start time, the men’s 8k race takes place first, followed by the women’s 6k at 11:45 a.m.

Piranha Shredding Fire

After reviewing the interviews and sifting thru the fire scene, I believe I know how the fire started. Workers confirm that on Thursday afternoon there was a smoldering fire in the shredder. Workers said it was from a 3 ring binder which contained metal and caused sparks as it went thru the shredder. This happens on occasion and the company even has a procedure for this along with a water hose at the machine to extinguish the fire. The workers thought they had the fire completely extinguished before leaving at the end of their shift.

 

Evidence observed at the scene is consistent with the statements given by employees.

Volleyball back on the road this weekend

Aces travel to Indiana State and Illinois State

Coming off of its best weekend of Missouri Valley Conference play, the University of Evansville volleyball team looks to continue rolling in a pair of road matches at Indiana State and Illinois State.

The Purple Aces begin the weekend on Friday at Indiana State before traveling to Normal to face Illinois State on Saturday.  Friday’s match begins at 6 p.m. CT while Saturday’s game against the Redbirds will begin at 7 p.m.  Both will be televised by The Valley on ESPN3.

In two matches last weekend, Mildrelis Rodriguez led the Purple Aces to their first conference win of the season and came close to making it 2-0 in a hard-fought match against Loyola.  Rodriguez notched a career-high 23 kills in a 5-set victory over Bradley on Friday while hitting .311.  She also led all players with an impressive 19 digs.  She followed that up with 15 more kills versus the Ramblers and 10 digs.  For the weekend, she 3.80 kills per set and hit .212.  She also notched 2.90 digs per frame.

Rocio Fortuny also had her best collegiate match against Bradley.  The sophomore posted 19 kills in 48 attempt, besting her previous high of 17.  She also matched her top mark of 13 digs in the triumph over the Braves.  Fortuny ranks second on the team behind fellow sophomore Mildrelis Rodriguez with 2.19 kills per set.  She has also done well on the defensive side with 0.44 blocks per set.

A strong weekend saw UE freshman Rachel Tam average 2.90 kills per game along with 2.10 digs as the Aces won their first MVC match of the season.  Tam opened the weekend with a career-best 19 kills in the win over Bradley while hitting .406.  She added 10 digs and a pair of block assists.  Tam completed the weekend with 10 kills versus Loyola while hitting .333.

On Friday, the Aces open up the weekend with a trip to Terre Haute to face Indiana State.  The Sycamores begin the weekend with a 9-15 record and are 3-9 in league play.  In the meeting earlier this season in Evansville, Indiana State hung on for a victory in five sets.  Kynedi Nalls continues to lead ISU with 3.38 kills per set, which is a tally that ranks fifth in the MVC.

Saturday will see the Aces travel to Illinois State.  The Redbirds are in the midst of a four-way battle for second place in the Valley with an 8-4 conference mark while sitting at 15-9 overall.  Jaelyn Keene ranks as the top hitter in the conference, checking in at .450.  She has also gotten the job done with her serving, pacing the MVC with 0.45 service aces per game.

Aces FanFest set for November 19

Event to be held prior to Morehead State game 

An annual event that has taken place every year since the opening of the Ford Center in 2011 will be held once again as the 6th annual FanFest will take place on Saturday, November 19.

Beginning at 10 a.m., FanFest will be go until the men’s basketball game against Morehead State begins at 12 p.m.  It will be held at Freedom Plaza, which is directly in front of the Ford Center main entrance.

Several great activities will be on hand for Purple Aces fans of all ages.  The fun includes bounce houses, cornhole, a photo booth, rally towels, live music and much more.

Food vendors and a beer garden will also be on hand for the attendees at FanFest.  Admission to the festivities is free.  Russ Grieger will be on hand signing copies of his new book – “The Perfect Season: A Memoir of the 1964-1965 Evansville College Purple Aces”.

 

School Bus Struck while Unloading Students

On Thursday, November 03, 2016 at approximately 3:00pm the Vanderburgh County Sheriff’s Office responded to a report of a crash involving a school bus on Old State Road south of Knollview Drive.

A red Pontiac Grand Prix had been traveling south on Old State Road when the driver exited a curve and noticed a school bus stopped in the opposing lane of travel. The driver veered into the front of the school bus to avoid striking children who were crossing the roadway.

The school bus was occupied by approximately 35 students at the time of the collision.  No one reported any injuries at the scene. The passenger car sustained significant front end damage and had to be towed.

The crash remains under investigation.
