BREAKING NEWS FROM CHANNEL 44: EPD Chief Recommends 3 Officers Be Terminated, 1 Demoted

 The fate of four Evansville Police Officers will lie in the hands of the Police Merit Commission.

Earlier this week Chief Billy Bolin placed four officers on paid administrative leave following an accusation of excessive force. The incident occurred during a Saturday morning arrest.

Bolin says the officers filed official documents claiming the man they arrested during a garage break in fought with them during the arrest. However, Bolin says body cam video tells another story. He says the body cam video shows the officers became upset after the suspect was in handcuffs when one of the officers reached into the man’s pocket and was stuck by a needle. He says three of the officers involved in the arrest became physical with the man and started yelling at him. He says a 4th officer watched.

Bolin is recommending the 3 officers who became physical be terminated, and he is recommending the other officer be demoted. The Police Merit Commission is scheduled to discuss the issue at its next meeting. The names of the officers have not been released.

Crash Involving School Bus

 Vanderburgh County Sheriff’s deputies are investigating a crash involving a school bus.

It happened Thursday around 3:00pm on Old State Rd. south of Knollview Drive.

Deputies say a car was headed south on Old State Rd. when the driver rounded a curve and saw the bus stopped, unloading students.

The driver veered into the front of the bus to avoid hitting the students crossing the road.

There were about 35 students still on board the bus at the time, but no one was hurt.

Henderson County Police Search for Suspect After Early Morning Chase

 Henderson County Sheriffs Deputies are trying to track down a driver who led them on an early morning chase.  According to dispatchers, the chase started when deputies tried to stop a truck at Arby’s along Highway 41.   That’s when the suspect took off.  After a short chase, it ended at Atkinson Park.  The male driver fled the scene on foot.  A female was taken into custody, but police are still looking for the male suspect.

The Folly and Shame of the Never Trumpers

Do we not grow weary of the sanctimonious ones? The Never Trumpers that endlessly hector and scold, and hold themselves up as paragons of moral virtue? They display their good taste by showing contempt for Trump and his supporters and accuse them of the most dastardly things. Some of them claim they will only vote down ballot, skipping the Presidential slot, or vote for Evan what’s his name (McMullin). Some will write in a candidate who will have no chance of winning. Other pious Republicans will even cast their vote for Hillary, the ultimate act of derision, conveying their moral seriousness, proper upbringing, and membership in certain elite circles.

Although they call themselves conservatives, Never Trumpers are willing to undo the candidacy of the one man who stands in the way of a hard-core radical leftist ascending to the Presidency who will build on the destructive legacy of President Barack Obama. Indeed, the Democrat candidate is arguably the most corrupt individual to ever seek the office. Hillary Clinton is a candidate with a truly pathetic public record, a career politician who knowingly compromised our nation’s security, broke our laws, and sold her office. Yet the Never Trumpers persist in undermining the one candidate who can stop her, which can only make us wonder not about Trump – but about them. However boorish or flawed Trump may seem, whatever he may or may not have said or done as a private citizen 15-20 years ago, it is a pale echo of Hillary’s misdeeds in a long and miserable public record.

As Secretary of State, Hillary sacrificed our consulate in Benghazi and knowingly lied about it, championed policies that helped create ISIS, and converted pro-Western Libya into an Islamic terrorist snake-pit. She backed the Muslim Brotherhood in Egypt (Mohammed Morsi), nearly sabotaging a critical alliance while discrediting a courageous Muslim reformer (al-Sisi). Hillary and Obama squandered our blood and treasure in Iraq and Afghanistan and have thrown both away to our enemies. They have surrendered the Middle East to Iran and its terrorist proxies, including Iraq, Syria, Lebanon, and Yemen, and undermined our Sunni allies and Israel. The two have paved the way to a nuclear-armed Iran. Hillary’s signature “reset” policy with Russia appeased Vladimir Putin, helped restart the Cold War, and led to the annexation of the Crimea and Eastern Ukraine. She has done nothing to counter Chinese aggression in the South China Sea or North Korean belligerence. She and Obama have courted hostile governments everywhere, in Iran, Turkey, and Cuba while criticizing long standing allies.

She supported Obamacare, which is in free fall. She backed Obama’s economic policies that have doubled the national debt, increased income inequality, and led to the worst economic “recovery” since World War II. She lied repeatedly in her various cover-up efforts, tarnishing the FBI, and colluding with Director James Comey, Attorney General Loretta Lynch and the unethical Department of “Justice.” Like Obama, she is a consummate race-baiter and supported Black Lives Matter, the racist, anti-Semitic hate group that promotes cop killing. She and her husband have become filthy rich through sham speaking engagements, paid extortionate sums by questionable corporate and foreign interests seeking influence including Arab regimes that treat women as second-class citizens. Feminist icon that she is, she trashed the many women that came forward that her husband had sexually abused. She defended the rapist of a 12-year-old girl and laughed about it. Perhaps most tellingly, her greatest singular achievement, the reason she got to become a US Senator, Secretary of State, and possibly our next President, is that she happened to have married Bill Clinton. Some feminist.
But apart from her pitiful political record thus far, what exactly is the Hillary agenda for the country should she win the Presidency that Never Trumpers seem willing to gloss over or even endorse?

Hillary, to begin, will eviscerate the Bill of Rights beginning with the 1st Amendment including freedom of speech and religious liberty. Her Supreme Court picks will embrace the latest whims of social justice fascists that will label all opposing opinions as hate speech, thereby silencing dissent. The Federal Communications Commissions (FCC) under Hillary will impose the “Fairness Doctrine” thereby crushing Talk Radio. Church based institutions will be forced to pay for abortions including partial birth abortions and abortifacients and preside over gay or transgender weddings. Her Supreme Court picks will abolish the 2nd Amendment by reversing prior decisions like Heller. She will begin an Australian style gun confiscation program and go after gun manufacturers through litigation making it impossible for them to stay in business. Due process (5th and 6th amendments) will become a distant memory with more Title IX based witch-hunts and kangaroo courts, for example, to “adjudicate” white males, accused of rape in our colleges.

Hillary will embrace amnesty and open borders and will welcome 650 million Latin Americans, among many others, to come to America replete with work, welfare, healthcare, and citizenship. She will raise taxes 1.4 trillion. She will add new budget busting entitlements including free college and family leave. HillaryCare preceded the collapsing Obamacare, and so she will “save” it with a Soviet style single payer system. She will end voter photo ID, thereby increasing voter fraud as more and more our elections will be decided by those not entitled to vote. Hillary will continue to gut the military. She will fund sanctuary cities and import more Syrian Muslim refugees, many of whom are sympathetic to ISIS. She will grow the administrative state, the EPA, and the entire federal bureaucracy, with their industry crushing regulations and mandates.
Hillary will continue Obama’s war on our police and criminal justice systems, smearing them as racist, creating upheaval in our cities with more violence, racial conflict and perhaps even a race war. We will see a breakdown of law and order, and the balkanization of the nation into competing racial and ethnic tribes.
Through the courts and the bureaucracy she will impose her pagan Marxism on the country, the destruction of our historic traditions and values. In their place will come the latest social justice or radical feminist fads codified by the nine unelected lawyers in black robes that sit on the Supreme Court. New “minorities” will appear everywhere, each demanding special rights and protections from “racist” America, leading to a majority grievance-victim culture in which nearly everyone is a victim.

She will build and expand on the Obama legacy of lawlessness, the growth of government, and the dismantling of our national culture and identity. She will throw open our borders to the third world and grant amnesty to those already here. Hillary will preside over the expansion of the administrative state and pack the courts with other like-minded leftists who possess the same disregard for federalism, the Constitution and the Bill of Rights that she has. She will continue the policies of Obama, replace the hated white majority, and transform the nation at every level, culturally, demographically, and politically.

I wonder why Never Trumpers have a difficult time with this decision? Would the self-righteous Republicans prefer a destructive Hillary Presidency and the demise of the nation rather than support Trump? Many of us did not like Trump. We did not support his tactics, his recent conversion to conservatism, his lack of knowledge of the issues, yet now recognize that he is all we have left to thwart Hillary and her hard left agenda.
Which candidate is more likely to damage the country? Who is more likely to undermine the Republic, the Constitution, and our free market economic system? Who will appoint radical leftists as judges, continue the wrecking and social engineering of our military, and declare war on freedom of speech, religious liberty, and our second amendment? Who will grant amnesty to millions of illegal aliens and open the door to millions more, an influx that will overwhelm the nation and transform it into one big permanent blue state with millions of new welfare recipients and Democrat voters?

The Holier than thou Never Trump crowd, so called conservatives, cannot abide supporting Trump, or even keep from insulting him and his many followers in the most vicious ways, are complicit in a possible Hillary presidency that will bring the nation to its knees. Although an imperfect candidate, Trump is the only one that can prevent a likely 16-year Obama-Clinton continuum that will alter the nation irreversibly. The moral and principled choice is to stop Clinton by embracing Trump. By failing to do so, Republican Never Trumpers betray the nation and the conservative movement they claim to be a part of, and place themselves alongside the vile left who actively seek to destroy the country.

A lawyer retained by a faculty member at Indiana Tech Law School is questioning the university’s explanation for closing the school.

Christopher Mackaronis, principal at Stone Mattheis Xenopoulos & Brew P.C. in Washington, D.C., said he is currently representing one faculty member and is “working with” other faculty members at the Fort Wayne law school. The possibility of filing a lawsuit against the university has been raised but Mackaronis said the teaching staff is still determining what steps to take next.

Indiana Tech cited financial constraints when it announced the closureOct. 31, effective at the end of this academic year. The university noted it had already sustained a loss of nearly $20 million from operating the law school and, looking at future enrollments, believed the deficit would continue to grow.

Mackaronis said the university knew it was going to have support the law school financially. It assured the faculty it was committed to making the program successful and never placed any conditions that it could reconsider its intentions if, for example, enrollment did not grow or bar passage did not improve.

Instead Indiana Tech portrayed itself to the professors as being fully behind the law school. Then it suddenly reversed course which, Mackaronis said, has left many faculty members shocked and angry.

“It’s not like we’re changing the color of the sofa in the lobby,” he said. “This is a life- and career-changing decision that effects (71) students and the entire faculty and administrative personnel, all of whom are losing their jobs.”

However, Brian Tamanaha, professor at Washington University School of Law in St. Louis, believes the professors will likely have a tough time proving the university knowingly misrepresented its intentions.

Tamanaha drew national praise for his 2012 book, “Failing Law Schools” which examined the growing problems in legal education stemming from the decline in applications and rise in tuition. Noting the trend of fewer students wanting a J.D. had already been established by the time Indiana Tech opened its law school, he wondered why the Fort Wayne school went ahead with its plans.

“The only thing they could have done to mitigate this was not to open,” he said.

While the university could possibly have never intended to fully support the law school, Tamanaha said the situation looks like Indiana Tech simply did not have the financial resources to continue its legal education program.

The university has a relatively low endowment and is dependent on tuition for funding its operations. Coupled with the small class sizes, he said the university was clearly subsidizing the law school.

Of more concern is the students, Tamanaha said. As they look to transfer to other law schools, some may have difficulty if they have low undergraduate GPA and LSAT scores.

The American Bar Association is moving toward requiring law schools post an average bar passage rate of 75 percent, so many schools are working to improve their graduates’ performance on the bar exam. Consequently, schools might be hesitant to enroll any Indiana Tech student who is marginally qualified and appears likely to fail the bar.

Indiana Tech President Arthur Snyder was scheduled to speak with the Indiana Lawyer Wednesday but cancelled the interview because of a scheduling conflict. In the closure announcement, he commended the faculty and said the university would assist the J.D. candidates currently enrolled.

“Our first concern is for the law school students,” he stated. “We will be working hard on behalf of each of them to ensure that the process for transferring, for continuing their legal education, and ultimately earning their law degree take place with as little disruption as possible.”

Indiana Tech Law School Dean Charles Cercone told Indiana Lawyer this week that he has reached out to law schools in Indiana and Ohio about student transfers and received a “good reception.”

Cross Country Programs Turn Attention To Midwest Regional

The University of Southern Indiana cross country programs turn their attention to the NCAA Division II Midwest Region Championships this Saturday at Angel Mounds. The men’s 10-kilometer race begins at 10:30 a.m., while the women’s 6k is slated for an 11:45 a.m. start time.

Eagles in the Rankings
Improving by a single spot in the U.S. Track & Field and Cross Country Coaches Association Top 25 and Midwest Region rankings, the USI women’s cross country team jumped Cedarville University in both polls last week. In the national poll, USI sits five points outside the top five in sixth with 161 points. Grand Valley State continues to lead the region poll with a second place ranking in the USTFCCCA Top 25.

With seven of 10 schools shifting position in the USTFCCCA Top 10, the Eagles’ men moved into seventh after gaining 18 more points in the poll. In the final Midwest Region poll, the top two spots remained unchanged with Grand Valley State and USI atop the list. The following five places all shifted after the conference championships week.

GLVC Dominance Continues
Junior Emily Roberts (Fredericktown, Ohio) earned the first GLVC Runner of the Year award for the USI women’s program since 2011 to help the Eagles win their sixth-straight GLVC championship. The time of 20 minutes, 36.03 seconds for Roberts set a new GLVC record, as did the USI margin of victory (55 points). Senior Jessica Reeves (Midland, Michigan) earned a second-place finish, while three others joined the duo on the All-GLVC team.

Seven All-GLVC runners at the conference championships sealed the men’s 12th-consecutive GLVC championship and 24th overall, the most of any sport in GLVC history. Junior Bastian Grau (Höchstadt, Germany) paced the Screaming Eagles with a runner-up performance, while senior Chase Broughton(Marengo, Indiana) also earned a top-five finish placing fourth. Freshman Nathan Hall (Springfield, Missouri) earned GLVC Freshman of the Year honors with a 13th-place finish, the eighth time and second-straight year a USI runner has earned the award.

2015 Results
Grand Valley State University won both the men’s and women’s regional crowns a year ago. The Lakers have won the last 15 women’s regional championships and the previous 14 men’s regional titles.

With a fifth-place finish, USI’s women were the final team earning a spot at the NCAA II National Championships, falling just 11 points short of third place. Junior Emily Roberts (Fredericktown, Ohio) and senior Jessica Reeves (Midland, Michigan) enter Saturday’s race as favorites in the women’s race after leading USI to its sixth straight GLVC title. Roberts was fifth at the NCAA II Midwest Region Championships a year ago and is the top returning runner in this year’s race, while Reeves was 16th. Grand Valley State’s Kendra Foley, who was sixth at last year’s regional, also is among the favorites in the women’s race after capturing the GLIAC title this year.

In the men’s race, Grand Valley State defeated the field by 79 points. The Eagles placed second with a four-point margin over GLVC foe, the University of Wisconsin-Parkside. The Rangers’ Jake Dubnicka us the top returning finisher from the 2015 event after a third place finish. Chase Striegal of Bellarmine University and Zach Panning of Grand Valley State also return after rounding out the top-five finishers in 2015. Senior Chase Broughton (Marengo, Indiana) earned All-Region honors with a ninth-place finish a year ago.

Regional Field
The Midwest Region consists of teams from the Great Lakes Valley Conference, the Great Lakes Intercollegiate Athletic Conference, and the Great Midwest Athletic Conference. Around 30 teams and more than 200 student athletes are expected to compete in each race.

Grand Valley State is the top-ranked team in both the men’s and women’s races as the Lakers enter the weekend ranked No. 2 in both U.S. Track & Field and Cross Country Coaches’ Association Top 25 polls.

The Midwest Region also is represented by six teams in the USTFCCCA Women’s Top 25. In addition to Grand Valley State and USI, the region also features No. 8 Cedarville, No. 10 Northern Michigan University, No. 11 Hillsdale College and No. 22 Bellarmine. Lewis University and the Wisconsin-Parkside are receiving votes outside the Top 25.

In the men’s Top 25, the Midwest Region is also represented by Saginaw Valley State University (No. 13), Hillsdale (No. 17), Lewis (No. 22) and Bellarmine (No. 11). Walsh University is receiving votes outside the Top 25.

The top five teams from each race Saturday advance to the NCAA II National Championships, which are November 19 in St. Leo, Florida. The top three individuals not from a qualifying team—or the top five overall individuals if none are from qualifying teams—advance to the national meet as well. All-Midwest Region honors go to the top 25 finishers in each race.

2016 NCAA II Midwest Regional
This is the third consecutive year that USI and the Evansville Sports Corporation have teamed up to host the NCAA II Midwest Region Championships at Angel Mounds. The NCAA II National Championships will be at Angel Mounds in 2017.

With a 10:30 a.m. start time, the men’s 8k race takes place first, followed by the women’s 6k at 11:45 a.m.
