Aces back home Wednesday to face Wabash

Game is first of five in a row at home

On Wednesday, the University of Evansville men’s basketball team returns home for the first of a 5-game home stand as the Purple Aces welcome Wabash College to the Ford Center for a 7 p.m. tilt.

Jaylon Brown and Ryan Taylor averaged double figures as the Purple Aces played in the Challenge in Music City in Nashville over the weekend.  Against some of the top mid-major competition in the country, the Aces played extremely well, coming within seconds of winning the opening two contests in the event.

Brown had the best game in almost three years for the Purple Aces against Toledo.  He scored 39 points on a 14-of-28 shooting to tally 39 points, the highest UE point total since D.J. Balentine had 43 points at UNI in 2014.  His 14 makes was also the most since Colt Ryan hit 17 shots on his way to 43 points at Creighton in 2012.  In three games at the Challenge in Music City, Brown averaged 18.7 points and 6.0 rebounds per game on his way to a berth on the All-Tournament Team.

Taylor is the No. 2 scorer for the Purple Aces, sitting at 14.5 points per game.  Taylor has connected on a team-best 11 3-pointers on the season and checks in shooting 40.7% from outside.  In the game against Middle Tennessee State, Taylor knocked down his first seven attempts on his way to a career-best 22 points.

In the game against Middle Tennessee State in Nashville, Sergej Vucetic made the first start of his career and finished with six rebounds and four points.  He had the best game of his career in the double overtime match-up against Toledo, finishing with 13 points and 8 rebounds in 32 minutes of work, all career highs.  The 7-1 center has been steady at the free throw line, hitting 13 of his 17 attempts, 76.5%.

For the first time since 1976, the University of Evansville and Wabash College will meet in a regular season game.  The Little Giants come to Evansville with a 2-2 record, earning wins over Rust College and Birmingham-Southern.  Pacing the squad is Evan Frank, who has notched 14.5 points and 8.5 rebounds per contest.  Defensively, Logan White has been a beast on the boards, hauling in an average of 10.3 caroms per game.

The Fates Of 4 EPD Officers Will Be Decided Another Day

 The fates of four Evansville police officers will be decided another day. The Evansville merit commission once again tabled the decision.

The officers were placed on paid administrative leave pending results of an Indiana State Police investigation. Officers Mark Decamps, Marcus Craig, Nick Henderson, and Sergeant Kyle Kassel were suspended for 21 days on November 9th after body cam video showed the using excessive force during the arrest of Mark Healy in late October.

ISP investigators will meet with Vanderburgh County prosecutors Friday, December 2nd to discuss the findings of the investigation.

Officers Mark Decamps, Marcus Craig, and Nick Henderson could be fired. Sergeant Kyle Kassel could be demoted.

Ivy Tech President Discusses Career Exploration With Students

 A group of students at Ivy Tech were taught by a special guest instructor Monday. Ivy Tech President Sue Ellspermann discussed career exploration in a student success class.

Students got a chance to ask Ellspermann questions and voice their concerns about the school. Many students are also parents, and they feel Ivy Tech could do better offering child support services.

Sue Ellspermann says, “We know that two-thirds of our students are part time. That means many of them are working adults and working parents at the same time. And we realize that it’s not just about coming here for class, it’s about creating the wrap-around services that will help those students be successful.”

Staff at Ivy Tech say they have started preliminary talks about starting a partnership with local daycares to help parents out.

High Court Takes Alcohol Wholesaler Case

The Indiana Supreme Court has agreed to hear a case that could decide whether beer and wine wholesalers can also be legally permitted to sell liquor in Indiana.

The justices granted transfer in the case of Indiana Alcohol and Tobacco Commission v. Spirited Sales, LLC, 49S00-1611-PL-614, last week after Indiana Attorney General Greg Zoeller announced in late October that he would petition the high court to take the case.

Zoeller first became involved in 2014 when the Indiana Alcohol and Tobacco Commission denied Spirited Sales’ application for a liquor wholesale permit. Spirited Sales is an affiliate of Monarch Beverage Co. Inc., Indiana’s largest beer and wine wholesaler, and state law prohibits wine and beer wholesalers from also wholesaling liquor as a protection against monopolies.

Spirited Sales took the issue to court, and Zoeller argued that the state agency had correctly applied the law. But the Marion Superior Court overruled the ATC in August, so the agency was forced to grant a temporary permit to Spirited Sales in late September.

After the Indiana Court of Appeals denied the state’s motion for a stay, Zoeller sought an emergency stay from the Indiana Supreme Court and requested transfer at the same time.

Zoeller told Indiana Lawyer that he is pleased that the justices granted his motion for transfer and doing so will bring much needed clarity to an important legal issue that has significant policy implications for the Indiana Alcohol & Tobacco Commission.

All justices concurred with the Indiana Trial Rule 56A transfer to the high court except Mark Massa, who is not participating in the case.

The high court also granted transfer to the case of Thomas Pinner v. State of Indiana, 49S02-1611-CR-610, with all justices concurring. In that case, the Indiana Court of Appeals reversed the denial of a man’s motion to suppress a handgun found on him after officers questioned him in a movie theater lobby.

The divided Court of Appeals found that the officer had no reasonable suspicion to stop Thomas Pinner, whom officers approached and questioned in a movie theater after receiving a call that a man matching his description had a gun in his possession.

Arguments in the Pinner case are scheduled for 9 a.m. Dec. 15.

The justices denied transfer in 26 other cases last week, including Lisa R. Harris v. State of Indiana, 83A01-1509-CR-1311, and State of Indiana v. Dejon Pitchford, 49A04-1512-CR-2173, two cases that were argued on petition to transfer last week.

In Harris’ case, the Indiana Court of Appeals held that Indiana State Police Trooper Mike Organ’s investigation into Harris’ car – an investigation that eventually found meth in her possession – went above and beyond the seat belt violation he had initially stopped her for.

In Pitchford, the Court of Appeals affirmed a trial court decision to suppress evidence of narcotics found on Dejon Pitchford’s body during a strip search following his arrest for misdemeanor battery.
