A summons and complaint in a personal injury claim were adequately served on a Menards store in Gary, the Indiana Court of Appeals found Wednesday, so the store cannot seek relief from default judgment entered against it on the basis of the service of process.

After suffering injuries due to a malfunctioning shopping cart at the Menards store in Gary, Reba Lane filed a personal injury claim against Menard Inc. in 2013. As part of her case, Lane sent a summons to Menards’ former registered agent, CT Corporation, who responded that it had not worked with Menards for more than five years and had no forwarding address to which to send the summons.

Instead, Sgt. Brian Coubal with the Lake County Sheriff’s Department served the summons at the Gary store and via certified mail, each of which were addressed to “Attn: Highest Executive Officer Found on Premises.” He received a return receipt from the mail correspondence.

In 2014, Lane moved for default judgment because Menards had not yet answered her complaint. The Lake Circuit Court granted her request and awarded her $500,000 in damages.

Lane then moved to enforce judgment by proceedings supplemental and sent a copy of the motion to the Menards store in Gary. Counsel for Menards appeared in August 2014 and asked the court to set aside default judgment, arguing that it was void under Indiana Trial Rule 60(b)(6) for lack of personal jurisdiction. Further, Menards counsel argued that the default judgment was “tainted” by attorney misconduct and was a product of excusable neglect.

The trial court denied Menards’ motion in May 2016, prompting the appeal in Menard, Inc. v. Reba Lane, 45A03-1606-CT-1283. On appeal, Menards claims that it did not receive the summons delivered by Coubal in person or the summons sent via mail and, further, that the service of process was not reasonably calculated to reach the highest executive officer on the premise.

But in a unanimous opinion, a panel of the Indiana Court of Appeals found that a stamp indicating Coubal had delivered the summons and complaint and the return receipt from the copy of the summons sent by mail indicate that he followed Trial Rule 4.1(B), which regulates the service of process.

Further, Judge Melissa May rejected Menards’ argument that Lane’s attorney committed misconduct because she should have attempted to notify two other law firms who had represented Menards in personal injury claims in the past of Lane’s complaint.

Finally, the panel held that any breakdown in communication between the time when the summons was served on the store in person and via mail to the time when it reached the appropriate executive officer was the result of neglect, but not excusable neglect, because the panel concluded that Menards did receive service of process of the summons and complaint. Thus, the trial court did not abuse its discretion when it denied Menards’ motion to relief from default judgment.

Committee Advances Sullivan’s Pre-K Expansion Bill

The House Committee on Education today advanced State Rep. Holli Sullivan’s (R-Evansville) proposal that would expand Indiana’s pre-K pilot program for low-income students.

“Offering our at-risk youth a high-quality early childhood education is extremely important to me as a parent,” Sullivan said. “This proposal would help us close the achievement gap for more low-income students. It will also provide necessary wrap around services, which will benefit the entire state.”

The current On My Way Pre-K pilot program was established in 2014 and serves nearly 2,300 students in Allen, Lake, Marion, Jackson and Vanderburgh counties. Sullivan’s legislation would add up to five more counties.

Sullivan said the increase of up to five more counties allows for a larger data set to ensure proper review of our pilot program so we can access its successes or shortfalls.

“Children who aren’t ready for kindergarten are half as likely to read proficiently by third grade. Students who aren’t reading proficiently by third grade are four times more likely to drop out of school before graduation,” Sullivan said.

In 2006, the Senate unanimously approved Judge Gorsuch to the circuit court by voice vote.

World War II changed the course of history, but for students today, the war is something they read about in history books. That is changing through a blitz by the Evansville Wartime Museum. Students now have the opportunity to meet and personally speak with a “Rosie the Riveter,” a World War II General, a soldier who served on the LST, and a P47 pilot, among others. Tomorrow, students at Central will get to meet a local P47 pilot who served oversees in Wold War II.
As part of the program through the Evansville Wartime Museum, each US History class in the EVSC has watched “E,” a short film about Evansville’s role in World War II. After viewing the video, guest speakers are invited to share pictures and artifacts. Along with each guest speaker is a special guest who participated in the WWII war effort.
Tomorrow, representatives with the Evansville Wartime Museum will be at Central to talk with students about Evansville’s war time role. Also present will be Allen Sanderson and David Thomas. Sanderson was a P47 pilot in Italy during WWII.

Eagles Tabbed For Second Place In GLVC East

The 23rd-ranked University of Southern Indiana baseball team is picked to finish second the Great Lakes Valley Conference East Division in 2017 after a vote of the league’s 16 head coaches. USI also tallied five first place votes of a possible 16 and 108 points in the poll.

The Screaming Eagles are coming off a 2016 season that saw USI finish with a 38-21 overall record and a GLVC mark of 20-8. For the fourth time in the past 10 seasons, the Eagles won an NCAA II Midwest Regional championship and moved on to the NCAA II Championship Series in Cary, North Carolina.

The University of Indianapolis (114 points, 10 first place votes) was selected to finish first in the GLVC East after capturing the GLVC Tournament title a year ago. The Eagles were followed in the poll by Bellarmine University (90) who earned the final first-place vote in the East, Saint Joseph’s College (70) and Lewis University (66), respectively, while the University of Illinois Springfield (60), McKendree University (31) and University of Wisconsin-Parkside (29) rounded out the division.

Quincy University, who are ranked 22nd nationally, took the top spot in the West Division with 116 points and 13 of the 16 first-place votes. Rockhurst University (85 points, two first-place votes) was picked to finish second in the West, while the University of Missouri of Science and Technology and William Jewel College were both picked third with 74 points. Missouri S&T also earned the final first-place vote.

Drury University (70 points) was predicted to place fifth, while the University of Missouri-St. Louis (61), Truman State University (57), and Maryville University (31) round out the eight-team division.

The Eagles start the 2017 campaign in Tampa, Florida for the second time in three years, taking on the second-ranked University of Tampa. The three-game series begins Friday, February 17.

USI’s Hodges named to National POY watch list

University of Southern Indiana Softball senior catcher Haley Hodges (Portage, Indiana) is one of 50 student-athletes from across the country to be selected to the watch list for the NFCA/Schutt Sports Division II National Player of the Year award in an announcement by the National Fastpitch Coaches’ Association Wednesday.

Hodges, who was a top-10 finalist for the award as a junior in 2016, was named first-team preseason All-America by Fastpitch News (FPN) two weeks ago after a historic 2016 season that saw her set single-season school records for home runs (22), RBIs (72), walks (45) and runs scored (58).

Along with leading the nation in slugging percentage (1.000) and on-base percentage (.578), Hodges ranked third, nationally, in home runs. She led the Great Lakes Valley Conference in batting average (.458), runs scored, RBIs and walks.

In 2016, Hodges was named the Diamond Sports Division II Catcher of the Year by the NFCA and was named first-team All-America byHerosports.com, the NFCA and the Division II Conference Commissioners Association.

Additionally, Hodges was named second-team Academic All-America by the College Sports Information Directors of America and was the GLVC Player of the Year.

Hodges is one of four players from the Great Lakes Valley Conference and one of six players from the Midwest Region to be recognized on the watch list. University of Indianapolis senior utility player Natalie Lalich, Truman State University sophomore outfielder Christa Reisinger and William Jewell College junior second baseman Brooke Benard joined Hodges as GLVC players on the list.

USI opens the 2017 season February 14 when it travels to Florence, Alabama, to take on defending NCAA II champion and preseason No. 1 University of North Alabama in a doubleheader. The Screaming Eagles host the Midwest Region Crossover February 24-26 at Deaconess Sports Park in Evansville.

Of the 50 players on the list, USI is slated to play games against nine of the players during the regular-season, including North Alabama senior pitcher Hillary Carpenter and junior outfielder Reagan Tittle.

Indiana’s Pieroni, Hixon Earn Weekly Big Ten Honors

Another week, another set of honors for Indiana University’s Blake Pieroni and Michael Hixon, as both earned weekly league accolades on Wednesday.

Pieroni was named Big Ten Swimmer of the Week for the third time this season and for the sixth time in his career, while Hixon was honored as the Big Ten Diver of the Week for the third time this year and for the seventh time in his IU career.

Both Pieroni and Hixon helped the No. 4-ranked Hoosiers take down No. 7 Louisville last Friday, 195-105, to finish the dual-meet season undefeated at 11-0. The unblemished record is the first for IU since 1981.

Pieroni, a Chesterton, Ind. native, took home two individual wins and one relay win against the Cardinals. The Academic All-Big Ten selection touched first in the 100 freestyle (43.18) and the 200 freestyle (1:35.28) with NCAA B cuts and also helped the Hoosiers earn a victory in the 400 freestyle relay with a mark of 2:56.11.

Hixon was incredibly impressive in both the 1-meter and 3-meter dives against Louisville, posting NCAA qualifying marks in his two wins. The Amherst, Mass. native scored a 447.98 in the 1-meter and then followed that with a total of 464.56 in the 3-meter dive.
