ACLU Takes First Legal Action Against The Trump Administration.

Why? Donald J. Trump is poised to become the 45th President of the United States without fully answering questions about his looming conflicts of interest. His ethical and financial conflicts threaten to undermine the public’s confidence in fair government – and even our national security.

The ACLU is demanding access to key documents concerning Trump’s conflicts of interest. The public has a right to know – and we need your help to make sure we get the full story.

On behalf of the American public, the ACLU filed a Freedom of Information Act request with the Office of Government Ethics and three other government offices. FOIA is a crucial tool for ordinary Americans to provide checks and balances on elected officials – this won’t be our last one.

Don’t forget: the American president is accountable to us – and it’s our job to hold him accountable. Obtaining information on Trump’s actual or potential conflicts of interest is critical for a functioning democracy – and insisting on this kind of oversight is how we keep presidential power in check.

This demand is just a first step to keep President Trump’s administration transparent and accountable. Let’s make it clear that we need answers now.

Ivy Tech Southwest Names Interim Foundation Leader

Erica Schmidt, formerly Director of Development for Ivy Tech Foundation Southwest, has been named the interim Executive Director for Resource Development for the Foundation. She replaces Ayana Blair, who has been named director of resource development for the United Way of Southwest Indiana.

Schmidt holds a Master of Arts degree in communication and a Bachelor of Science degree in communication studies from the University of Southern Indiana; and is currently studying Fundraising Management with the Lilly School of Philanthropy at Indiana University. In addition to her current director position, she has worked as an adjunct instructor in communication at USI and Ivy Tech.

She has been employed with Ivy Tech since July 2014. Prior to Ivy Tech she served as the Community Outreach Liaison for St. Mary’s Medical Center.

EVANSVILLE HYDROFEST TO ROAR ON THE RIVER LABOR DAY WEEKEND

A new event will be staged on the Ohio Riverfront in Downtown Evansville, Indiana USA over the Labor Day weekend in 2017. Evansville HydroFestTM will host the American Power Boat Association’s North American Championships for 14 classes of Inboard Boats during the 3-day event, Friday September 1st, Saturday September 2nd, and Sunday September 3rd, 2017.

All 14 classes of eligible APBA boats use inboard powerplants, as opposed to outboard motors, in a variety of hull designs, including flat bottom, V bottom, and hydroplanes. The classes are grouped by hull type, length, weight, and size and type of engine. Each class is distinguished by letters, such as Y, NMH, and GP.

As of this date, a total of 33 teams have committed to compete in Evansville in 3 classes, including 1 Litre Y Hydroplanes, National Modified Hydroplanes NMH, and Grand Prix Hydroplanes GP. More classes are expected to compete.

The GP’s are the loudest, fastest, and largest of the APBA Inboard Classes, using 468 cubic inch supercharged/fuel injected V8 engines running on methanol and producing upwards of 1500 horsepower. The current world straightaway record was set in Fall 2016 by GP15, driven by Jerry Hopp at 170.620 mph.

The Grand Prix’s are organized and presented by Grand Prix Worldwide (GPW), a group of teams primarily from America’s west coast. The Executive Director is Mr. Sam Cole, a longtime organizer of hydroplane racing.

Evansville HydroFest is presented by Evansville Events, Inc., a 501c3 non- profit entity of the Evansville Convention and Visitors Bureau. Mr. Bob Warren is the Executive Director. Serving on the Executive Organizing Committee are Mr. Vernon Stevens, President of Southern Business Machines and Mr. Randy Lientz, President of AXIOM. All members reside in Evansville.

Bob Warren emphasized: “We are presenting Evansville HydroFest because our residents and visitors have asked for a new form of boatracing on our beautiful Ohio River. They want more boats, closer competition, less downtime, cooler temperatures, and MORE ROAR! And we will deliver. We chose Labor Day weekend because high temperatures will be around 85 degrees. As for action, as soon as one race is completed, the next heat will begin.

Admission cost for Evansville HydroFest is $10 total for all 3 days. 12 and under are free. The wristbands will go on sale June 14th in a variety of Evansville and Tri-state locations, as well as online at www.evansvillehydrofest.com. Bleacher Seating and Pit Tours will be available for additional at the event.

EVSC to Host Groundbreaking for New McCutchanville Elementary School

The EVSC will host a groundbreaking ceremony for McCutchanville Elementary School – the new school being built on the northside – on Saturday, Feb. 4, at 10 a.m. The event will include guest speakers as well as an opportunity for families to help the corporation officially break ground on the new building. The event is open to the public and will include refreshments as well as a commemorative shovel for students. A rain date is scheduled for Saturday, Feb. 11.

McCutchanville Elementary School, which will be located at 10701 Petersburg Road, is scheduled to open for the 2018-2019 school year and will serve students in prekindergarten through sixth grade. It is located on a 25-acre site purchased in 1995 specifically as a future school site.

The new school boundaries are drawn from portions of Scott and Oak Hill elementary schools. Boundaries include: Highway 41 on the west; Boonville New Harmony Road to Petersburg Road to Green River Road to Ruston on the north; the Warrick County line on the east; and Highway 57 and a line parallel to Hillsdale Road on the south.

Construction on the new school is set to begin immediately.

An Indianapolis Metropolitan Police Department sergeant was qualified as an expert to testify about Facebook records and digital trails that led to a man’s multiple convictions for felony stalking, the Indiana Court of Appeals decided Friday.

In 2012, Christopher Johnston met D.K. and began contacting her via phone calls, texts and social media for three years. After Johnston did not comply with her requests to stop contacting her, D.K. took out a protective order against Johnston in 2014.

Johnston was arrested in 2015 after going to D.K.’s home and claimed he did not know D.K. A month later, Johnston returned to the home, so D.K. called the police. He was later arrested and charged with Levels 5 and 6 felony stalking for going to D.K.’s home and sending her texts and Facebook messages in 2013 and 2014, as well as two counts of Class A misdemeanor invasion of privacy.

During trial, the state presented IMPD Sgt. Steven Schafer as an expert in forensic analysis. Johnston objected to Schafer’s qualifications, but the Marion Superior Court overruled the objection. Schafer testified that there were multiple Facebook accounts believed to be Johnston’s aliases because they were all associated with Internet cookies attached to the same device and used the same IP address.

Schafer further testified that the likelihood of multiple people using the same device and same IP address to contact D.K. with similar messages was less than “being struck by lightning while hitting the lotto and being bitten by a polar bear at the same time.” Johnston was found guilty on all counts, but the court did not enter judgment on the invasion of privacy counts.

Johnston then appealed in Christopher Johnston v. State of Indiana, 49A04-1603-CR-543, once again arguing that Schafer was not qualified as an expert witness because he works in “a field of study which is highly technical and therefore susceptible to misunderstanding, confusion, and error” and because he did not have the requisite training in statistics to form a valid opinion about the probability of an event.

But Judge Melissa May, writing for the unanimous panel of the Indiana Court of Appeals, noted that the state did not present Schafer as an expert in statistics, but instead as an expert in forensic analysis of social media records and digital trails. Further, Schafer testified that he had been trained and done extensive work analyzing social media accounts, so admitting him as an expert witness was not an abuse of discretion, May wrote.

Similarly, Johnston also argued that the trial court committed fundamental error in allowing Schafer to give the “polar bear analogy” about statistical probability.  But May wrote that Johnston’s fundamental error argument failed because he could not meet the applicable standard to demonstrate that “the record reveals a clearly blatant violation of basic and elementary principles, where the harm or potential for harm cannot be denied, and when the violation is so prejudicial to the rights of the defendant as to make a fair trial impossible.”

USI Gets Two Wins at UIndy, Paxson Falls Short of Record

INDIANAPOLIS, Ind.—University of Southern Indiana Women’s Track & Field saw two runners take the top spot in their respective events Saturday at the UIndy Collegiate Invitational, hosted by the University of Indianapolis.
Sophomore Kate Henrickson (Boonville, Indiana) earned a victory for the second-consecutive week, this time in the 1,000-meter run. Her time of 3 minutes, 10.81 seconds was good enough to top teammate and runner-up, sophomore Allison Rollins (Evansville, Indiana) by nine-and-a-half seconds.

The Screaming Eagles also took the top two spot in the 3,000-meters. Junior Kate Duty (Owensboro, Kentucky) earned her third career victory, and first outside of the steeplechase event, with her time of 10:45.61. Finishing second, sophomore Micalah Booher (Pendleton, Indiana) finished with a time of 11:04.80. Rounding out the USI participants was freshman Ashley Lawhorn (Frankfort, Kentucky) in 14th.

In the field events, sophomore Hilary Paxson (Liberty Center, Indiana) recorded another top-10 performance in the weight throw. Paxson’s toss of 48 feet, 3.25 inches was good enough for seventh. The distance is enough to move the sophomore into second all-time at USI, just .25″ short of the school record.

USI returns to Indianapolis next weekend, January 27-28 for the Tom Hathaway Distance Classic.
