Agriculture is an integral part of Indiana’s economy. In 2014, the General Assembly approved the Indiana Grown program to encourage Hoosiers to buy locally grown products.

Indiana Grown is a branding program helping Hoosier farmers and producers promote their products by encouraging consumers to buy local. After a business becomes a member, the Indiana Grown logo is placed on their products, which helps consumers more easily identify and purchase their goods.

This program keeps jobs and financial growth in the community by supporting Hoosier businesses in our state. It also supports job creation, building sustainable communities and preserving Indiana’s agricultural heritage. It is important to remember that when an Indiana Grown product is bought, no matter where from, it helps local farmers and producers succeed as well as the Indiana economy.

A federal appeals court on Friday left in place a decision blocking Indianapolis-based Anthem Inc.’s bid to buy rival health insurer Cigna Corp, saying that a bigger company is not better for consumers.

The 2-1 decision upholds a federal judge’s ruling in February that said the proposed $48 billion acquisition would reduce competition in the concentrated insurance market.

Anthem argued the merger would save $2.4 billion in medical costs and lead to lower consumer premiums. But the Justice Department said Anthem had no real plan to reach those savings. The government sued last summer to block the deal amid concerns over its effect on prices and consumer choices.

The ruling from the U.S. Court of Appeals for the District of Columbia Circuit likely dooms the merger effort that lasted nearly two years. Even Cigna has soured on the deal, filing a separate lawsuit seeking a $1.85 billion termination fee from Anthem and billions more in damages that include the amount Cigna shareholders would have received if the merger hadn’t failed.

Consumer groups had opposed the merger, saying it would have a negative impact on consumers and lead to fewer choices. Industry experts suggested any consumer impact from the deal would take years to materialize and could lead to savings in some areas but higher costs elsewhere.

Anthem had promoted the merger as a way to help the companies negotiate better prices with pharmaceutical companies, hospitals and doctor groups. They also said it would help cut expenses and add more customers.

Writing for the majority, Judge Judith Rogers said the lower court was correct to halt the merger “based on Anthem’s failure to show the kind of extraordinary efficiencies necessary to offset the conceded anticompetitive effect of the merger” in 14 states.

Rogers also said the merger would have a “substantial anticompetitive effect” in the Richmond, Virginia, large-group employer market.

In dissent, Judge Brett Kavanaugh said a merger would allow the larger company to negotiate lower provider rates and mean cost-savings for consumers. He said he would send the case back to the lower court for further deliberations.

Earlier this year, a federal judge also blocked a separate health insurer combination: Aetna’s roughly $34 billion acquisition of Medicare Advantage provider Humana Inc.

Jones Gets Second Provisional at “Ginas”

University of Southern Indiana Women’s Track & Field sophomore Hope Jones (Cumberland, Indiana) was the lone scorer for the Screaming Eagles at the loaded Hillsdale “Gina” Relays over the weekend.

Jones earned her second NCAA Division II provisional time of the season in the 10,000-meters with a time of 36 minutes, 13.84 seconds. Finishing runner-up in the event, Jones’ time ranks 27th in NCAA II during the outdoor season. The sophomore also has an NCAA II provisional in the 5,000-meters with the 50th-fastest time during the outdoor season.

In the 3,000-meter steeplechase, junior Kate Duty (Owensboro, Kentucky) ran her best time of the season, 11:20.72, to finish 17th in the event. The finish ranks Duty 61st nationally in NCAA II, fifteen seconds shy of a provisional.

A number of Eagles competed in the 5,000-meter open event, highlighted by sophomore Allison Rollins (Evansville, Indiana) placing 32nd. Not far behind Rollins, senior Bailey Knable (New Albany, Indiana) finished 34th, while junior Bryce Cutler (Benzonia, Michigan) crossed the finish line in 36th. Sophomore Micahlah Booher (Pendleton, Indiana) and senior Carly Whitesell (Zionsville, Indiana) rounded out the USI runners in 38th and 43rd, respectively.

USI returns to action at the Great Lakes Valley Conference Championships hosted by Saint Joseph’s College in Rennselaer, Indiana. The meet begins this Thursday, April 27, and runs through Saturday, April 29. The “last chance” meet will be held May 11-12 in Naperville, Illinois, at the Dr. Keeler Invitational, while the NCAA II Outdoor Championships are May 25-27 in Bradenton, Florida.

Eagles Impress in Final Tune-up Before GLVC’s

Two University of Southern Indiana Men’s Track & Field athletes finished with NCAA Division II provisional times at the Hillsdale “Gina” Relays over the weekend in Michigan.

Winning the 1,500-meter championship event, junior Bastian Grau (Höchstadt, Germany) defeated the field with a time of 3 minutes, 46.27 seconds. The finish was good enough for an NCAA II provisional, while Grau already has an NCAA II automatic qualifying time in the event. Grau ranks fourth in the NCAA II in the 1,500-meters during the outdoor season.

Grau also holds and an NCAA II automatic time in the 5,000-meters and ranks fifth in the NCAA II. The junior earned an NCAA II provisional time in the 800-meters earlier in the year and currently ranks 27th in the event.

Junior James Cecil (Owensboro, Kentucky) also picked up an NCAA II provisional time in the 3,000-meter steeplechase with an eighth-place finish of 9:13:53. Cecil’s time is the 37th best in the NCAA II during this outdoor season. Senior Chase Broughton (Marengo, Indiana) also holds a provisional in the event and ranks ninth.

In the 5,000-meters championship event, senior Noah Lutz (Evansville, Indiana) finished less than a second from an NCAA II provisional in the 5,000-meters. Lutz finished 19th with a time of 14:39.27. In the event, Lutz is currently ranked 41st in the NCAA II.

Freshman Nathan Hall (Springfield, Missouri) was the top Screaming Eagles in the 5,000-meter open race, finishing eighth with a time of 14:48.96. Freshman Austin Nolan (Evansville, Indiana) and freshman Javan Winders (Mansfield, Tennessee) finished back-to-back in 12th and 13th, respectively. Senior Cain Parker (Petersburg, Indiana) and sophomore Jesse Stanley (Chandler, Indiana) rounded out the Eagles’ runners in 16th and 22nd, respectively.

Rain washes out USI-UMSL sofball doubleheader

University of Southern Indiana Softball lost its first game of the 2017 season to weather Friday as the Great Lakes Valley Conference doubleheader between the No. 5 Screaming Eagles and host University of Missouri-St. Louis was cancelled due to rain.

 

USI (40-10, 19-7 GLVC) finishes the regular-season Sunday at noon when it visits Maryville University for a GLVC doubleheader.

 

The rainout marks the first time since the 2014 season that the Eagles were unable to play a GLVC game due to weather. Today’s games will not be made up.

 

Summary judgment for DCS on age, sex discrimination charges affirmed

The Indiana Department of Child Services did not discriminate against a former employee seeking to come out of retirement when it declined to move him through the interview process, the Indiana Court of Appeals decided Friday.

Robert Mills was employed with DCS as a child care center licensing consultant from 1975 until 2007, when he resigned to take a position with the Evansville Head Start program. He retired in 2010 at the age of 62, then decided to begin working again a few years later.

In October 2013, Milles applied for a family case manager position with DCS and was selected for an interview. During the interview, he told DCS staff that he wanted to come out of retirement for two to three years to solidify his retirement income, and Elizabeth Herrmann, a DCS supervisor, recommended that Mills not move on in the interview process. Herrmann specifically noted that Mills was “hard to engage in conversation, was unable to answer questions with specific examples of using essential skills for the job, was rigid on his views of traditional and non-traditional families … and provided generalized answers to questions about child abuse or neglect.”

Three months later, Mills interviewed for another family case manager position and repeated that he wanted to come out of retirement to increase his pension. Herrmann expressed the same concerns about Mills as she had after his previous interview and recommended that he not move on. A 63-year-old woman was selected for the position.

Mills then filed charges against DCS with the Equal Employment Opportunity Commission, alleging sex and age discrimination. The EEOC issued a notice of right to sue but took no further action. Mills then applied for two additional family case manager positions but was not interviewed for either opening.

In November 2014, Mills filed a pro se suit against DCS, Herrmann and other DCS employees, including Director Mary Beth Bonaventura, alleging age and sex discrimination and retaliation for filing a charge with the EEOC. Additionally, Mills submitted two additional applications with DCS, but was not interviewed for either position.

DCS moved for judgment on the pleadings on many of Mills’ claims, and in response, Mills dropped Bonaventura and three of the employees and his Indiana Age Discrimination Act claim but added a claim for violations of his rights under the Equal Protection Clause. The Vanderburgh Superior Court granted DCS’ motion for judgment on the pleadings, leaving Mills with claims of age and sex discrimination and retaliation. The department then moved for summary judgment on those claims, which was granted.

On appeal, Mills argued that under 42 U.S.C. 2000-e(2)(a)(1), an “employer” can include supervisors such as Herrmann and the other DCS employees he named as defendants. But in a Friday opinion, Indiana Court of Appeals Chief Judge Nancy Vaidik rejected that notion, writing that the 7th Circuit Court of Appeals had rejected similar arguments in the past.

However, the appellate panel agreed with Mills’ argument that the trial court erred in granting judgment on the pleadings on his sex and age discrimination claims against the employees because the trial court failed to explain its ruling and because Equal Protection Clause claims can be brought against individual government employees. But such error was harmless, Vaidik said, because “we have no reason to believe that DCS would not have also moved for summary judgment on the Equal Protection Clause claims had they survived the motion for judgment on the pleadings.”

Finally, the Court of Appeals affirmed the grant of summary judgment, finding Mills failed to establish disparate-treatment or disparate-impact claims of age or sex discrimination and also failed to demonstrate retaliation against him after filing his EEOC claims.

The case is Robert C. Mills v. Indiana Department of Child Services, Shirley Starks, Kristen L. Sparks, Melanie Reising, and Elizabeth Herrmann, 82A01-1606-PL-1482.
