Passed Out Driver on US 41 had a BAC of .23%

Early this morning at approximately 1:50, Trooper Brock Buchanan located a 2012 Jeep that was parked at an angle on the shoulder at US 41 and SR 241. When Buchanan approached the vehicle he noticed it was still running and the female driver was passed out behind the steering wheel. When the female finally came to she attempted to drive off, but the vehicle was still in park. Buchanan was able to shut off the vehicle from the passenger side. The female attempted to get out through the driver’s door, but she feel back into the vehicle and sat down on the floor board. The driver was identified as Brittney Winternheimer, 27, of Evansville.  She was taken to Good Samaritan Hospital in Vincennes where it was determined she had a BAC of .23%. Winternheimer was arrested and taken to the Knox County Jail where she is currently being held on bond.

 Future Of Evansville Law Library In Doubt With Passing Of Librarian

Reed, who served as librarian since 1985, passed away March 19 in Evansville. She was 68. A accomplished keyboardist, Reed developed a deep knowledge of legal resources and patiently helped lawyers and nonlawyers alike ferret through reporter books, law journals and treatises to find the information they needed.

“She was faithful and loyal and efficient,” said Vanderburgh Circuit Senior Judge Carl Heldt. “She took care of people that used the law library.”

Reed was the only librarian at the William H. Miller Law Library and now, even though the library is open each weekday, no one is available to help the patrons. The Vanderburgh Law Library Foundation board is beginning to consider what to do next but board president, Yvette LaPlante, said closure is an option.

Founded in the early 1900s, the law library is located across the hall from circuit court in the Civic Center Complex. It has about 22,000 volumes and 6,000 volumes on microfiche, including an extensive collection of Indiana resources. It receives financial support from circuit court, the library foundation, and the Evansville Bar Association as well as private donors.

Statistics keep by Reed indicated use by lawyers had dropped and that 50 percent of the people coming to do legal research did not have any legal training. Consequently, the library provided a point of access for nonlawyers to the courts. Individuals could visit to make a photocopy or find the answer to their questions.

LaPlante recounted the story of a man who came in wanting to research the constitutionality of Indiana’s seat belt law. Most attorneys probably would have told him to just pay the ticket but Reed took the time to search through the materials with him.

“I absolutely see a need for it,” LaPlante said of the library. “I think it’s useful to both attorneys and the public.”

When he was starting as an attorney in Evansville, Robert Carithers saw the library as leveling the playing field against banks and insurance companies. The corporations had access to large firms which, at that time, all had well-stocked law libraries. As a small practitioner and, for a while, deputy prosecutor, Carithers was able to go down the street to the local law library and find information he needed to win the case.

The migration of resource materials from paper to the internet cut down on the need for attorneys to use the library for research. Still older books and some specialized publications are not always online, plus, as LaPlante found, the statute citations in Westlaw and Lexis Nexis can sometimes disagree, which necessitated turning to the original source.

Reed and the county law library still had value in the digital age. Attorneys could call Reed on the phone, tell her what they were looking for and she would locate it, copy it then fax it to them. In addition, she developed a special fondness for the writings of 7th Circuit Court of Appeals Judge Richard Posner, often reading his opinions and discussing them with attorneys.

“She was a librarian,” Heldt said. “Very bright, very meticulous, she carefully chose her words. She was quite but no shrinking violet.”

The foundation board had been anticipating it would soon have to decide the future of the library since Reed was past retirement age. But, Heldt noted, board members were counting on Reed being around to help them determine what should happen.

He anticipates the board will have a decision by mid-summer.

Born in Halifax, Nova Scotia, Canada, Reed was the organist at the Eastminster Presbyterian Church in Evansville and served as principal organist and harpsichordist with the Evansville Philharmonic Orchestra. She also taught music at the University of Evansville.

She arrived in Evansville in 1975, after earning master of music degree at the University of Michigan.

“She was just a very caring individual,” Carithers said. “Helen helped a lot of people. Everybody is just brokenhearted at losing her.”

Aces hoping for big weekend

Three home matches are on the schedule for the University of Evansville women’s tennis team this weekend at Wesselman Park.

On Saturday, an 11 a.m. tilt against Bradley begins the action before the Purple Aces face Taylor University.  Another MVC match will take place on Sunday as the Aces face Illinois State at 10 a.m.

Last weekend, UE took a 4-3 win over Southern Illinois.  Evansville opened the day with success in doubles as Theodora Soldatou and Chieko Yamada won a 6-1 decision at flight one with Diana Tkachenko and Nicoli Pereira picking up a 6-2 win in the second flight to clinch the point.

Singles play saw Daria Pentsova and Tkachenko each earn 2-set wins.  Tkachenko picked up the win in a tiebreaker in the second flight while Pentsova was victorious in the fourth.  Clinching the victory was Yamada at top singles.  She fell in the first set before rallying for the win.

The Braves come to town with an 0-1 MVC mark and stand at an even 9-9 overall.  The Redbirds are 1-0 in the league and 7-9 overall.

 

Series at Drake next for Aces softball

UE back in Iowa this weekend

Following a midweek split against Austin Peay, the University of Evansville softball team returns to Missouri Valley Conference action this weekend with a 3-game set at Drake.

Saturday will see the series start with a noon doubleheader before the series finale will be played on Sunday at 11 a.m.

A midweek doubleheader saw the Purple Aces split a pair of games against Austin Peay.  UE held on for a 10-7 victory in game one before dropping the second contest by a 12-2 final.  The first tilt was highlighted by Chandra Parr hitting the 30th home run of her career, tying the program mark of 30.  Michal Luckett had three hits while Morgan Lambert connected on her fourth home run of the season and had four RBIs.

Senior Chandra Parr belted the 30th home run of her career in the first game of Wednesday’s doubleheader against Austin Peay.  A laser to left field saw Parr tie the mark set by Krista Price in 2010.

With a batting average of .338, Hayli Scott continues to lead the Aces.  Scott had a strong effort in Cedar Falls against UNI, hitting a home run in the first game of the series.  In game two, she came in as a pinch hitter and reached via a walk before going 2-2 with an RBI and two walks in the series finale.  Her efforts pushed her season average to a team-high .356 while her 12 RBIs is second.

A steady bat in UE’s lineup has been provided by Morgan Lambert.  She is second on the team with four home runs and 16 RBI.  For the season, she is batting .270, but has been raising that average as of late, posting at least one hit in 8 of the last 9 games.  Lambert had four RBIs in the opener against Austin Peay.  She is the only UE player to notched four RBI in a game this season, doing so twice.

Drake comes into the series standing at 19-16 overall and 3-6 in the Valley.  Mandi Roemmich paces the Bulldogs with a .387 average in 29 games.  Their power comes from Sarah Maddox, who leads the team with eight home runs and 25 RBI.
