IS IT TRUE SEPTEMBER 1, 2017
IS IT TRUE it looks like the Mayor didn’t give any serious consideration to the possibility of giving a reasonable pay increase to our dedicated city employees in his proposed 2018 budget?
IS IT TRUEÂ we are extremely surprised that the Mayor didn’t propose to pay down the serious shortfall in the employee health plan in his proposed 2018 budget ?
IS IT TRUE instead the Mayor actually came up with way to give a million bucks to the EVSC so they can use it to repair Bosse Field, a facility that the EVSC has let fall into disrepair just like the city owned Mesker Amphitheater?
IS IT TRUE some people are saying that the Bosse Field proposal has got to be one of the most preposterous schemes to be proposed since our fun and games Mayor proposed a $10 Million dollar park at the old Roberts Stadium site with a $3 Million skateboard park to indulge the dozen or so skateboarders in Evansville? Â …we are told the reason why some people feel that way is because the EVSC owns Bosse Field not the city?
IS IT TRUE other Quality of Life requests the Mayor included in his 2018 proposed budget was $650,000 for Pigeon Creek Greenway Indiana HI-rail acquisition for trail expansion? …he also wants to spend $460,000 for the initial construction of the new Humboldt Penguin exhibit at Mesker Park Zoo and Botanic Garden?
IS IT TRUE the taxpayers are also paying off an annual debts payment for the new downtown medical school ($2.7M), the downtown hotel ($1.26M) without having any ownership position? …we wonder who are the owners of the hotel and medical school buildings that the taxpayers are paying off the loan notes on?
IS IT TRUEÂ that a group of local citizens recently held a very successful event to celebrate the efforts of all of the “First Responders” in Vanderburgh County?…several years ago (2013) Evansville City Council members Jonathan Weaver and Missy Mosby held an successful and well attended version of an event that honored local police and fire fighters?
IS IT TRUE we are pleased that the above group have decided to continue to celebrate the outstanding work of our “First Responders” by holding another event on 9-11 in 2018? Â …we are also extremely pleased to learn that this group have started a not-for -profit foundation so they can raise money for scholarships to be given to the children of our local “First Responders” who are going to college in 2018? Â …we have been told that this group has raised a whooping $9,000 in about a week for student scholarships?

Supreme Court Disbars Attorney For Committing A Dozen Conduct Violations
Supreme Court Disbars Attorney For Committing A Dozen Conduct Violations
Olivia Covington for www.theindianalawyer.com
A Rockville attorney accused of a dozen professional conduct violations for mismanaging his trust account and disobeying a court order has been disbarred.
The Indiana Supreme Court reached that decision Thursday in the disciplinary action, In the Matter of: John Downey Pierce, 61S00-1703-DI, 153. The complaint filed by the Indiana Supreme Court Disciplinary Commission alleges in September 2015, Rockville attorney John Downey Pierce commingled personal and client funds in his trust account and wrote three checks from that account for personal expenses, resulting in an overdraft. After the commission began an investigation into the matter, Pierce produced false documents that failed to adequately reflect deposits or transactions from the account.
The complaint also alleges Pierce failed to appear in court for his clients’ uncontested adoption hearing, and failed to complete related paperwork. The judge in the case ordered a show cause hearing, which Pierce failed to appear at, prompting the judge to file a grievance with the commission.
Finally, the complaint alleges Pierce failed to respond to the commission with respect to another grievance, which led to the initiation of show cause proceedings. Pierce also never responded to the full disciplinary complaint filed against him.
The hearing officer in Pierce’s case found his disciplinary history – which includes five completed and one pending action, according to the Indiana Roll of Attorneys – his selfish motive, his multiple offenses and his failure to acknowledge the wrongfulness of his action as aggravating factors, among others. The Indiana Supreme Court agreed and found Pierce in violation of 12 professional conduct and discipline rules.
Specifically, the high court found Pierce – who is already under indefinite suspension – to be in violation of Indiana Professional Conduct Rule 1.3; 1.15(a); 3.2; 3.4(c); 8.1(a) and (b); and 8.4(a) – (d), as well as Indiana Admission and Discipline Rules 23(29)(a)(3) and (4).
“We have disbarred other attorneys who have demonstrated similar unfitness to be entrusted with the responsibilities that accompany a license to practice law in this state,†the per curiam opinion says. “We acknowledge that Respondent may not have stolen as much money as some other disbarred attorneys, or been as pervasively dishonest or neglectful, but this offers faint praise. The nature of Respondent’s misconduct, coupled with his serial noncooperation and his failure to participate in these proceedings, persuade us that disbarment is the appropriate sanction here, as well.â€
Chief Justice Loretta Rush and Justices Steve David and Christopher Goff concurred with the sanction of disbarment, but Justices Mark Massa and Geoffrey Slaughter dissented from that sanction. While they agreed with the findings, the dissenting justices would impose a three-year suspension without automatic reinstatement.
The costs of the proceedings are also assessed against Pierce.
