IT’S TIME FOR DEMOCRATS TO GET REAL

Democrats just lost another election, this time in Montana. Unless they are willing to do some down-on-your-knees, cry-out-to-Jesus soul searching, the only way they’ll win another election is if they collude with the Russians to steal one the way Donald Trump didn’t.

It’s going to take much more than an Olivia Pope-style scandal “fixer” to fix what’s wrong with the Democratic Party. Putting a cowboy suit on an anti-gun, big government liberal like Rob Quist who regularly does gigs at a nudist resort in Idaho, was about as effective as putting lipstick on a pig.

It was also a naked attempt to blanket a semblance of normalcy over a Democrat Party that better represents the characters in the Star Wars cantina scene than those on Main Street or Your Street, U.S.A.

That’s why Greg Gianforte won Montana’s special election, despite being charged with assaulting a journalist one day prior.

After reading reports and listening to the audio of the altercation, I thought Gianforte’s response was kind of sexy. Before the snowflake generation evolved, that’s how manly men resolved their differences. And still do, in places like Montana and Alaska, where men aren’t ostracized for being men. They duke it out, brush it off, shake hands and go on their way.

Republicans should be on guard that the leftist-controlled media are not there to get facts; they are there to get at them. Reporters who “just happen” to have a recorder turned on will do their darnedest to bait politicians into physical altercations.As tempting as it might be, there’s no place in politics for body-slamming obnoxious metrosexual snowflake reporters, or any other kind for that matter.

Democrats and the left-leaning media had nothing to say when in 2004, Al Franken emerged from a crowd and body-slammed a guy who was trying to shout down then-Governor Howard Dean. Democrats promoted that clown to Senator but are outraged at Gianforte.

Let’s not forget that the violent political climate propagated by today’s progressive-left is to blame for fostering a culture of violence. Violence, not manly wrestling matches.

The Democrat Party is overrun by violent far-left extremists who regularly display their antipathy to things they dislike using violence. Setting fires, throwing Molotov cocktails, smashing windows, throwing rocks at police, destroying private property, and physically attacking Republicans like what happened at Berkley in February was the norm long before Donald Trump arrived on the scene.

Normal Americans watching this appalling behavior have come to understand that just like terrorists, these leftwing anarchists the Democrat Party harbors cannot be reasoned with, so defeating Democrats at the ballot box is America’s only hope.

Despite the barrage of Trump-Russia nothing-burgers the media cooks up and dishes out daily, regular Americans believe what the Democrat Party stands for is far worse. Democrats are out of touch to believe that their globalist, gun-grabbing, anti-Christian, anti-free speech, anti-capitalism, Russian-boogiemen-around-every-corner, race-baiting platform of victimhood would win the hearts and minds of regular people.

What’s flabbergasting to Democrats is that America’s proverbial “abused wife” on the other side of the aisle has finally conjured up the courage to put her foot down and say, “No more! Not in my house!” No more to the lies…no more to the abuse.

Shocking?

Only to those who refuse to take an honest look at themselves and the political party to which they associate.

Horses And Those Who Care For Them Are Steadily Arriving At Ellis Park

Horses and those who care for them are steadily arriving at Ellis Park, a month in advance of the thoroughbred track’s July 1-Labor Day meet. J.J. Gloria, Ellis’ stall superintendent, says 180 already are on the grounds with scores more expected well before the  deluge that hits right on top of the summer racing season.

Expected soon are at least 48 horses trained by Hall of Famer Steve Asmussen, whose division stabled at Ellis Park last year included 2017 Kentucky Derby runner-up Lookin At Lee. That colt, who won a maiden race and the $75,000 Ellis Park Juvenile at the track, also finished fourth in the Preakness Stakes and will contest the June 10 Belmont Stakes, the Triple Crown’s finale.

“We definitely have more horses than at the same time last year, and we’re getting a lot more inquiries from all over, really,” said Gloria, who has worked at Ellis off and on for 28  years. “I get new calls every day. The purse money is right now, so it’s worth it for them to come. And this is the best racetrack surface in the world. Go anywhere and show me a better one.”

Trainers who for the first time will either have their entire stable or a division based at Ellis include Brad Cox, Randy Morse, Ingrid Mason, Jose Castanon and Chris Davis.

“Our enhanced purses have resonated with horsemen, and we expect to keep building on the memorable 2016 season,” said racing secretary Dan Bork.

That also included maiden wins by the Kenny McPeek-trained Kentucky Oaks runner-up Daddys Lil Darling, now in England for Friday’s Group 1 Investec Oaks at legendary Epsom Downs, and the Dale Romans-trained Not This Time, who fell a  head shy of winning the Breeders’ Cup Juvenile.

Some stall space remains available for stabling, Bork said.

Ron Moquett was one of the first out-of-town horsemen to ship into Ellis Park, with about 35 horses. Among the 2-year-olds Moquett had training last summer at Ellis at some stage were future stakes-winner Uncontested and stakes-placed Petrov.

“The track is very kind here,” said Eddie Ruiz, a Moquett assistant who has trained on and off on his own. “Ron has confidence in the racetrack to bring those kinds of horses here. I watched Lookin At Lee run here, and (in 2015) Runhappy, who went on to be champion sprinter. You have good horses come here.”

Increased play on Historical Horse Racing terminals, the innovative parimutuel technology that provides a different gambling experience, and a $1.65 million transfer in purses and Kentucky Thoroughbred Development Fund purse supplements from Kentucky Downs will boost Ellis’ purses to record levels in the top-tier races. That includes maiden races carrying total purses of $40,000 for registered Kentucky-bred horses, which comprise the majority of those running.

John Hancock, a third-generation thoroughbred trainer from Henderson, predicted last year that Ellis Park would have its “meet of all meets.”

“And it was,” he said. “As good as last summer was, fans are in for a treat this year. There’s no doubt in my mind, with the caliber of horses and people coming, this will be even better.”

Hancock said one component is that Ellis’ local horsemen “have really stepped up” and that showed by horses who spent the winter at Henderson’s Riverside Downs training center winning seven races at Keeneland’s spring meet.

Hancock won five of those races, including with 2-year-old fillies Amberspatriot and Waki Patriot, who went on to be second (by a neck) and a troubled fourth against boys in Churchill Downs’ Kentucky Juvenile. Now he’s looking at New York’s Astoria Stakes for them, while saying he has some other babies that might be as good or better and who likely will surface at Ellis.

Horses at Ellis Park mean jobs in the area. Cox estimates that his 30 horses to be stabled at the track will involve “15 or 16” employees. Hancock says he has 10 employees, not counting his heavily-involved family members, taking care of 30 horses.

“The horse industry here puts a lot of money in area farmers’ pockets,” Hancock said. “Feed companies, hay and straw. I bet that four months out of the year, Ellis Park is the biggest employer within 50-60 miles, with everybody who works in the industry, frontside and backside.”

Built by the Green River Jockey Club as Dade Park in 1922, Ellis Park is located in Henderson just south of Evansville, Ind., on the only sliver of Kentucky north of the Ohio River. U.S. Supreme Court: Selling Product Exhausts Patent

In a decision that Zimmer Biomet and other medical device manufacturers argued will change their industry, the Supreme Court of the United States ruled Tuesday that patent holders cannot keep their patent protections after they sell their products.

The case, Impression Products, Inc. v. Lexmark International, Inc., 15-1189, started when Lexmark filed a patent infringement complaint against Impression for refilling and reselling its used ink cartridges. The Federal Circuit Court of Appeals found since Lexmark had explicit restrictions prohibiting refurbishing and reselling its cartridges, its patent rights were not exhausted when it sold the items.

However, the Supreme Court disagreed. It held Lexmark lost its exclusive rights once the sale of the product was completed.

“The Patent Act promotes innovation by allowing inventors to secure the financial rewards for their inventions,” Chief Justice John Roberts wrote for the majority. “Once a patentee sells an item, it has secured that reward, and the patent laws provide no basis for restraining the use and enjoyment of the product.”

Zimmer Biomet Holdings Inc., based in Warsaw, Indiana, and Medtronic PLC, filed an amicus curiae brief in support of Lexmark.They asserted that patent protections serve to guard against the risks posed by remanufacturers who reprocess and then sell medical devices that are designed for only one use. The third-party may not have cleaning instructions and may be unaware of design changes that make the device more compatible with other medical equipment.

The Medical Device Manufacturers Association, which also filed an amicus curiae brief in support of Lexmark, disputed Impression’s claim that manufacturers are imposing reselling restrictions in order to increase their profitability. The association pointed to patient safety, asserting the medical device manufacturers have used the conditional-sale doctrine to help ensure compliance with performance and safety standards.

Zimmer Biomet and Medtronic disputed the reprocessing industry’s contention that reusing provides a lower-cost alternative and that allowing infringement lawsuits would end the secondary markets for used products. Devices designed to be used again are already available, which gives the remanufacturers an avenue to maintain their businesses by servicing reusable medical equipment, Zimmer and Medtronic argued. Removing patent remedies will increase the frequency of single-use products being reprocessed, putting patients and the current market at risk.

Paul Stewart, partner at Knobbe Martens Olson & Bear LLP in California, expects the market will change in “fairly short order” in response to the Supreme Court’s ruling. More companies reprocessing patented products will enter the market.

Stewart served as counsel of record on the Medical Device Manufacturers Association’s amicus brief.  Chief legal counsel for Zimmer Biomet, Joseph Topmiller and the counsel of record for the brief submitted by Zimmer and Medtronic, Kathleen Daley of Finnegan Henderson Farabow Garrett & Dunner LLP in New York, did not return calls seeking comment.

The Supreme Court cited multiple precedents in reaching its decision. Those same precedents have been referred to by the Federal Circuit Court of Appeals for decades but in this case, the justices took a different reading of the past rulings.

“In all candor, I wasn’t that surprised because there are a lot of very old Supreme Court precedent that had language in them that could be interpreted in the way the Supreme Court interpreted them,” Stewart said of the decision in Impression v. Lexmark.

Patent holders will still be able to use contract law to enforce any restrictions on resales but, as Stewart noted, that could pose new difficulties. Namely, the manufacturers would essentially be bringing legal action against the purchasers who are also their customers, which they might be reluctant to do.

Eight justices voted as Justice Neil Gorsuch did not take part in the decision. Chief Justice John Roberts delivered the opinion.

Justice Ruth Bader Ginsburg concurred with the majority’s decision as it pertains to domestic sales but dissented on the finding that U.S. patent protections are exhausted during foreign sales.

To reach its decision on international exhaustion, the majority pointed to Kirtsaeng v. John Wiley & Sons, Inc., 568 U.S. 519, 525 (2013), which found foreign sales exhaust U.S. copyright protections. However, Ginsburg does not believe the case applies because patent law, unlike copyright, has not been harmonized between countries. She argued U.S. patent protections are not recognized abroad. For such protection, an inventor or manufacturer must apply to each country for the exclusive right to sell their products.

USI Softball announces Regnier signing

University of Southern Indiana Softball announced that incoming freshman catcher/first baseman Riley Regnier (Twin Lakes, Wisconsin) has signed a national letter of intent to compete for Head Coach Sue Kunkle’s Screaming Eagles in 2017-18.

Regnier is completing her senior season at Wilmot Union High School in Wilmot, Wisconsin, where she has competed in basketball and softball during her prep career. She is currently hitting .416 with six doubles, a triple, seven home runs and 27 RBIs; leading WUHS to a spot in the Wisconsin Interscholastic Athletic Association Division I sectional title game.

An All-State, All-District and All-Conference honoree as a junior in 2016, Regnier is a career-.453 hitter after posting a .489 batting average with 14 doubles, two triples, six home runs, and 34 RBIs a year ago.

WUHS’s Silver Slugger Award Most Valuable Player in 2015, Regnier is a member of the White Sox Academy Travel Ball team. In 2015, Regnier helped her travel ball team to a 32nd-place finish at nationals.

“Riley is a strong athletic kid that is going to bring added power to our offensive lineup,” Kunkle said. “She has good defensive skills and will work primarily as a catcher and first baseman.”

Regnier joins a freshman recruiting class that consists of first baseman/outfielder Haley Shouse (Borden, Indiana), second baseman/outfielder Jessica Tucker (Georgetown, Kentucky) and infielder/outfielder Alicia Webb (Elberfeld, Indiana). Shouse, Tucker and Webb signed national letters of intent during the early signing period.

USI (46-14) advanced to the NCAA II Softball Championship Series for the first time in program history after capturing its first-ever NCAA II Midwest Region title earlier this month.

UE Men’s Basketball Shooting Skills Camp begins Friday

This weekend, the University of Evansville men’s basketball program will host a Shooting Skills Camp on Friday and Saturday (June 2-3).  It will be held at the Fifth Third Basketball Practice Facility on the UE campus.

The camp is for kids entering grades 1-12 and runs from 9 a.m. until 4 p.m. on both days.

The Shooting Skills Camp will focus on fundamentals and technique of becoming a better shooter.  Campers will receive a t-shirt, basketball and will be provided with lunch.
