Diana Tkachenko finishes freshman season ranked 20th in region

The 2017 Missouri Valley Conference Freshman of the Year – the University of Evansville’s own – Diana Tkachenko – finished the 2017 season in the final ITA Regional Tennis Rankings.

Tkachenko completed her inaugural collegiate season ranked 20th in singles in the Ohio Valley Region.

“This past season had so many positives; it has really been such a positive affirmation that others have taken notice,” Purple Aces head coach Jayson Wiseman said.  “For Chieko to have made the MVC All Select team and Diana to be named Freshman of the Year were great accomplishments for the program.”

“To have Diana recognized as one of the top 20 players in our region is really something for her and our team to build on,” Wiseman added.  “Looking at the players ranked ahead of her, she has beaten several of them in the past and a number of those players were seniors this year. After talking with Diana once the rankings came out, she is very motivated to improve on that ranking and really help push our whole team forward. She and I are both excited to get back to work this fall!”

During the 2016-17 season, Tkachenko went 31-8 overall and 6-1 in MVC action.  She began the year with an impressive showing in the fall, highlighted by a 2nd place finish at second-flight singles in the MVC Individual Tournament, which was hosted by UE at Wesselman Park.

Suspended game between Wild Things and Otters to be completed July 22

The Evansville Otters and Washington Wild Things will finish the suspended game from June 18 in Washington, Pa. on Saturday, July 22, at Bosse Field.

The contest will resume at 5:35 p.m. and the regularly-scheduled game between the Wild Things and Otters will take place approximately 30 minutes after the conclusion. Evansville isn’t scheduled to play again in Washington, Pa. during the regular season.

Fans with tickets to Boy Scout Night on July 22 are encouraged to come for the conclusion of the suspended game. The game will resume in the top of the third inning with Evansville leading 2-0 off Dane Phillips’ two-run home run. Phillips’ homer isn’t official until the game is completed.

Max Duval started the game and had thrown two no-hit innings while striking out four before weather forced the suspension.

The Evansville Otters conclude the first half of the regular season at Bosse Field Friday and Saturday against the Joliet Slammers. First pitch for the series opener on Friday is 6:35 p.m.

This weekend’s promotional themes feature Father-Daughter Night, postgame fireworks, a Heritage Federal Credit Union hat giveaway, A League of Their Own celebration with players wearing special jerseys based on the movie and Girl Scout Night. On July 27th and 28th, the Evansville Police Department will host the FIRST STEP Advanced Student Threat Assessment and Intervention Response Program. FIRST STEP gives you the skills, materials, and confidence to quickly and effectively assess, intervene, and manage a student who has made a threat of violence.

This training is for Police Officers, School Resource Officer, Teachers, School Administrators, Counselors, Residential Life Coordinators as well as anyone else involved in the education and safety of students.

Indiana Joins Amicus Brief Defending Congressional Review Act

Indiana Attorney General Curtis Hill has added his name to a list of 14 state attorneys general voicing their support for the Congressional Review Act, saying the act protects the sovereignty of the states and provides them with a mechanism for relief from federal agency overreach.

Hill announced Thursday he has joined an amicus brief filed in the U.S. District Court for the District of Alaska, where the case of Center for Biological Diversity v. Ryan Zinke and Department of the Interior, 3:17-cv-00091, is pending. The brief urges the federal court to dismiss a complaint brought by the Center for Biological Diversity, which is challenging the act’s constitutionality, and instead find the act “is a tool that allows states to work with Congress to stop unlawful regulation.”

In the amicus brief, the attorneys general argue the CRA – which allows both houses of Congress to pass joint resolutions overturning federal agency regulations, subject to the approval of the president – is a lawful execution of the legislative branch’s constitutional authority to set its own rules of procedure.  Further, the attorneys general say the CRA helps protect the states against harmful federal overreach through implementation of agency rules.

“Many federal rules impose significant harms on the States, and often do so illegally,” the amicus brief says. “The CRA provides an efficient procedure that Congress can use to stop this federal overreach, quickly blocking regulations without requiring States to engage in costly and time-consuming litigation.”

The amicus brief pointed to a list of six federal rules recently overturned through the CRA, including the Department of the Interior’s Stream Protection Rule, which “imposed onerous requirements on coal mines near streams,” and the Social Security Administration’s rule banning gun possession by citizens who need help managing their finances.

“In all, the CRA is a lawful procedural tool, which, as recent experience has demonstrated, allows Congress to expeditiously eliminate illegal and/or harmful rules, while working with the States,” they wrote.

In a recent interview with Indiana Lawyer, Hill said attorneys general have the “power and authority…to work on state sovereignty and to recognize the role of state government and the role of federal government and where the two intersect.” Similarly, before he left office last winter, former Indiana Attorney General Greg Zoeller told the Indiana Lawyer many of the federal lawsuits he either brought or joined that challenged federal regulation were not policy challenges, but rather were questions of the scope of the enumerated powers of the executive branch.

In addition to Hill, 14 other attorneys general joined the brief, those in Alabama, Arizona, Arkansas, Georgia, Kansas, Louisiana, Missouri, Nebraska, Nevada, Oklahoma, South Carolina, Texas, Utah and Wisconsin.

State, Local Governments Win “Takings” CaseIt has been a number of years since states and local governments won a property rights case. But in Murr v. Wisconsin, the U.S. Supreme Court concluded 5-3 that no taking occurred where state law and local ordinance “merged” nonconforming, adjacent lots under common ownership, meaning the property owners could not sell one of the lots by itself. The Takings Clause of the Fifth Amendments prohibits the government from “taking” private property for public use without “just compensation.” According to Justice Anthony Kennedy, writing for the majority, the question in this case was whether the lots should be viewed as a single parcel when concluding whether a taking took place. The court applied a three-factor test that led it to conclude that the lots should be viewed as one parcel.

Trump’s DOL Addresses Overtime Rules

The Trump administration said in a Texas court filing late last week that it would rewrite an Obama-era rulemaking that dramatically expanded the number of workers covered by federal overtime rules. Under former President Barack Obama, the Department of Labor (DOL) last year doubled to $47,000 the minimum annual salary threshold a worker must make before he or she can be deemed a “managerial” worker and therefore exempt from federal law requiring that they are paid time and a half after working 40 hours in a week. A Texas court struck it down on procedural grounds late last year. The Obama administration swiftly appealed but was unable to resolve the issue before the new administration took over. Trump’s DOL argued that it has the authority to establish an overtime salary test, but declines to do so in this particular case.


Federal authorities investigate fair housing complaints against Noblesville and Hamilton County

Federal authorities are investigating housing discrimination complaints against the city of Noblesville and Hamilton County over the lack of low-income housing in the wealthy suburb. Amy Nelson, executive director of the Fair Housing Center of Central Indiana, told the Indianapolis Star that regardless of whether they are intentional, Noblesville’s development policies have kept segregation patterns intact instead of breaking them down. The U.S. Department of Housing and Urban Development’s Office of Fair Housing and Equal Opportunity is investigating the complaints. The city and county receive federal funding aimed at helping communities reduce poverty. The complaints argued they violated the fair housing requirements that come with the money.
