State Files Lawsuit to Level the Sales-Tax Playing Field Between Hoosier-Based and Out-of-State Businesses
Today at Indiana Governor Eric J. Holcomb’s request,  Attorney General Curtis Hill filed a lawsuit on behalf of Indiana’s Department of Revenue asking a court to find House Enrolled Act 1129 (Ind. Code § 6-2.5-2-1) constitutional. The new law, which became effective July 1, 2017, seeks to level the playing field between Hoosier-based businesses and those outside our state that do business here through online sales. HEA 1129 requires these out-of-state businesses to collect and remit the same sales/use taxes as Hoosier-based businesses.
The Indiana General Assembly enacted HEA 1129, and Gov. Holcomb signed it into law, with full awareness that the United States Supreme Court ruled in 1992 that out-of-state retailers need not collect and remit sales/use taxes.
“In light of the rapid evolution and capabilities of software and technology, the incredible growth of online sales in recent years and other factors, it’s time for the Supreme Court to revisit and overturn this ruling,†Gov. Holcomb said. “Hoosier-based businesses need the ability to compete on a level playing field as soon as possible.â€
The legislature included, and the state’s lawsuit relies upon, a provision in HEA 1129 that allows Indiana to put into motion a legal process to challenge the 1992 Supreme Court ruling. HEA 1129 also calls for the court(s) to act “expeditiously.â€

YESTERYEAR: Hill’s Snappy Service BY Pat Sides
This small diner opened in 1941 at Main Street and Riverside Drive, not long before this photo was shot. It housed Hill’s Snappy Service restaurant, part of a popular Midwest chain that had begun to expand into Indiana cities in the 1930s. The building’s distinctive style and diminutive size contrasted starkly with the older, more traditional commercial structures surrounding it. Hill’s replaced a building that was damaged by the Great Flood of 1937, and the diner’s tiles and curves resembled the Art Deco style of the Greyhound Bus terminal at Third and Sycamore, which had opened two years earlier. Hill’s was already operating three other restaurants in Evansville when the location on Main Street opened.
Helpful Hoosiers Should Also Be Vigilant In The Wake Of Hurricane Harvey
Attorney General Curtis Hill today reminds helpful Hoosiers to be vigilant and even skeptical before contributing to relief efforts for Texas residents affected by Hurricane Harvey. Whether in Indiana or thousands of miles away in another state, Hoosiers are always some of the first in line offering a helping hand to their fellow Americans. In fact, many Hoosiers are already headed south to assist with rescue efforts in Houston and other communities in ruins along the coastal bend in Texas. During the next few weeks, many more Indiana citizens likely will continue to make donations and travel to Texas to help people in need. However, the Office of the Indiana Attorney General’s Consumer Protection Division (CPD) warns all Hoosiers that the aftermath of a natural disaster is a hotbed for scammers. Any Hoosier with plans to help Texas residents should also take steps to avoid falling victim to scams targeting those who want to help victims. The CPD encourages contributions to relief efforts but advises Hoosiers to donate money and supplies through well-established organizations and pay attention to possible red flags that could indicate scams. Anyone contacted by a person directly requesting a monetary donation and claiming to represent an organization should proceed with caution and even skepticism. A better option is generally to donate through more trusted methods such as well-established organizations’ websites. Further, Hoosiers should not give out any personal information such as bank account or debit and credit card numbers. The Office of the Indiana Attorney General thanks the first responders and civilians in Texas and all across the country assisting with relief and rescue efforts. Our thoughts are with all Texans who have been affected by Hurricane Harvey. |

USI Volleyball Notes
Farrell in history books. Senior libero Shannon Farrell (Munster, Indiana) begins the year ranked No. 3 all-time at USI with 1,359 career digs. She became the first player in program history with back-to-back 500-dig seasons a year ago and set the program record with 5.41 digs per set in 2016. Farrell needs just 131 digs to move into second all-time at USI and 489 to match Kaya Heldman’s school-record 1,848.
Tough competition. USI plays three teams in its opening weekend that are earning recognition in the AVCA Top 25 Preseason Coaches’ Poll. In addition to No. 2 Southwest Minnesota State, both North Alabama and West Florida are receiving votes outside the Top 25.
Openers. USI is looking to win its season-opener for the fifth straight year after beginning the 2016 season with four straight wins. The Eagles have not lost a season-opener since 2012.
Sunshine State. This weekend’s games mark the second straight year and the fifth time since 2010 that USI has opened the season in Florida. It is the third time since 2010 that USI has opened the year in Pensacola and the fifth time during Head Coach Leah Mercer‘s career at USI.
Returning leaders. While Farrell returns to lead the Eagles’ back row, USI will be led at the net by senior middle hitter Te’Ayla Whitfield (Fort Wayne, Indiana) and sophomore outside hitter Mikaila Humphrey (Floyd Knobs, Indiana). Whitfield averaged a team-high 0.82 blocks per set as a junior, while Humphrey led USI with 2.61 kills per frame during her rookie season. Junior setter Erika Peoples (Bloomington, Illinois) was fifth in the GLVC last year with a team-high 9.06 assists per set.
10-match skid. USI is looking to end a lengthy skid when it takes the court this weekend after losing 10 straight matches to end the 2016 campaign.
