Adopt A Pet

Curtis is about 1 ½ years old. If there’s one word to describe him, it would be “trooper.” Curtis was very sick for months at VHS. After medication and lots of rest, he’s now healthy & ready for a home! He and nine of his friends are up for adoption at the new River Kitty Cat Café opening Friday, July 14th. His adoption fee is $30 and he’s ready to go home neutered, microchipped, and vaccinated. Adoption process will be completed at VHS and can take 1-3 business days. Specialty Pet Grooming Is A Cut Above The Rest

When you google Evansville pet grooming, a number of establishments will pull up in that search request.  While all of these businesses will advertise they are the best in town, Specialty Pet Grooming offers not only grooming services, but they also offer daycare and boarding for pets as well.

Located on the corner of Hwy 41 and Lincoln, Specialty Pet Grooming will give your pets special attention when you take your dogs/cats in for a grooming or just want to drop your pets off for the day while you’re at work.  Their pet daycare hours are from 6:30 am to 6 pm Monday thru Friday which is during regular business hours.  Thus, you will not have to worry about being late to work in the morning or late picking up your pets after work.  There are 2 people on staff during these hours who work in the doggy daycare.  There are also 2 employees who have the responsibility of bathing the dogs.

Specialty Pet Grooming’s owner, Jamie Hubiak, is living out her dream.  “I’ve been wanting to do this my whole life,” Hubiak says.    Hubiak has been a certified pet groomer since 2012.  She attended the Animal Arts Academy in Carmel where she obtained her certification.  Her love of animals along with her entrepreneurial spirit is what helped the business develop.  Hubiak started grooming at home until she eventually had to add space and staff for her rising business.

Laurel Hinten takes her dogs into Specialty Pet Grooming regularly for a haircut.  “Jamie is a high quality groomer who cares for all the animals she works with.  You know when you leave your pets with her, she will treat them like one of her own.”  Hinten says.

IU’s Hixon Qualifies for 1-Meter Dive Final at FINA World Championships

Indiana University diver Michael Hixon had a great showing in the 1-meter dive quarterfinals on Friday at the 2017 FINA World Championships in Budapest Hungary.

Hixon, diving for Team USA, placed fifth overall in the quarterfinals with a total of 384.80 to earn a spot in Sunday’s 12-diver championship final, scheduled for 9:30 a.m. ET.

After a first-round dive of 43.50, Hixon scored no less than 63.00 points on his final five dives, including a list-best mark of 73.10 on his sixth and final attempt.

Diving for Team Australia, IU’s James Connor placed 26th overall in the 1-meter dive with a total of 323.40.

Hoosier divers will be back in action on Saturday at the 2017 FINA World Championships, as Hixon will dive in the 3-meter synchro (4:00 a.m. ET), while incoming freshman Andrew Capobianco will compete in the 10-meter mixed synchro (7:00 a.m. ET).

7th Circuit vacates plea, reverses 15-year sentence for illegal possession of a firearm

An Indiana man’s 15-year sentence for possession of a firearm in violation of the Armed Career Criminal Act has been reversed after the 7th Circuit Court of Appeals determined one of the man’s prior convictions did not constitute a violent felony and, thus, did not qualify him for a sentence above the 10-year statutory maximum.

In United States of America v. Marvin L. Bennett, 16-3769, Marvin Bennett pleaded guilty to possession of a firearm by a felon in violation of 18 U.S. Code Section 922(g)(1), an offense that normally carries a maximum of 10 years in prison. However, under the Armed Career Criminal Act, a person who violated U.S.C. 922(g)(1) after accumulating at least three previous “violent felonies” must be sentenced to a minimum of 15 years in prison.

Bennett’s plea agreement provided that he would be sentenced to 15 years, but prior to his sentencing hearing, he argued that his previous conviction for violating Indiana Code 35-44-3-3 – which punishes the offense of resisting law enforcement– was not a crime of violence, thus disqualifying the 15-year sentence sentence. Chief Judge Theresa L. Springmann of the U.S. District Court for the Northern District of Indiana disagreed and sentenced Bennett according to the terms of his plea agreement, prompting the instant appeal.

Writing for a panel of the 7th Circuit Court of Appeals in a Wednesday opinion, Judge Richard Posner noted that violation of I.C. 35-44-3-3 constitutes a misdemeanor offense, so had Bennett only violated that portion of state law, he would not be subject to the 15-year sentence. However, Bennett was prosecuted pursuant to subsection (b)(1) of the statute by “inflict(ing) bodily injury on or otherwise caus(ing) bodily injury to another person,” prompting Springmann to conclude that Bennett’s conduct qualified under the ACCA.

However, Posner went on to write that “inflict(ing) bodily injury” does not necessarily connote violence.

“Suppose a person is handcuffed by a police officer, tugs in the hope of squeezing his hands through the cuffs, and accidentally causes the officer to trip and fall as a result of the tugs,” Posner wrote. “The person’s effort thereby to avoid arrest would be resisting law enforcement, but would not be considered violence or even threatening under 18 U.S.C. section 924(e)(2)(B)(i). The government has failed in this case to prove a violent felony.”

Based on that conclusion, the 7th Circuit reversed the district court’s judgment, vacated the plea agreement and remanded the case to the district court for further consideration.
