Cross Country teams remain in top 10, head to Louisville Saturday

The University of Southern Indiana men’s and women’s cross country programs return to action Saturday morning when they travel to E.P. Tom Sawyer Park for the Greater Louisville Classic in Louisville, Kentucky.

The event is scheduled to begin at 8:30 a.m. (CDT), with the men running an 8k and the women a 5k.

In the latest U.S. Track & Field and Cross Country Coaches Association poll, the men dropped one spot to sixth after being idle last week. USI was tied for fifth with the University of Mount Olive last week. The Screaming Eagles are second in the Midwest Region behind Grand Valley State University, who is ranked second nationally.

In the women’s poll, USI remained eighth after having last weekend off. Top-ranked Grand Valley State and fourth-ranked Hillsdale College are both ahead of USI in the regional rankings, where the Eagles are third.

With the Eagles preparing for the Regional Crossover meet in Romeoville, Illinois, the following week, USI will likely hold out many of its top runners Saturday.

Challenge to alcohol permit presents issue of first impression

A liquor store seeking to challenge the type of alcohol permit awarded to a Hamilton County specialty food store does not have standing to pursue judicial review under the Administrative Orders and Procedures Act, the Indiana Court of Appeals ruled in a first impression case.

21st Amendment Inc. objected at a hearing held by the Hamilton County Local Alcoholic Beverage Board in which Grapevine Cottage, a local specialty food shop that also sold alcohol, sought to renew and transfer its license. Grapevine holds a Type 115 grocery store alcoholic beverage permit; 21st Amendment has a Type 217 package store alcoholic beverage permit. It claimed most of Grapevine’s sales were in alcohol so it should have to hold a different permit and that granting Grapevine’s request would dilute 21st Amendment’s permit.

21st Amendment claimed it had a statutory right to bring an action to abate the sale of alcohol that constitutes a nuisance. The Indiana Alcohol & Tobacco Commission denied its petition to intervene, leading to the liquor store to file a verified petition for judicial review under AOPA. 21st Amendment claimed it had standing because it is a “permittee with a statutory right to abate a nuisance.” The commission filed a motion to dismiss, claiming 21st Amendment is barred from seeking judicial review under law, or lacks standing to do so. The trial court found the liquor store couldn’t seek to abate the public nuisance on a petition for judicial review and gave it 30 days to file a separate amended complaint on that issue.

“At issue in this case is Indiana Code section 4-21.5-5-3(a)(3), which accords standing for judicial review if the party has ‘standing under a law applicable to the final agency action.’ While our courts have previously decided standing questions under the other subsections of the statute, it appears that our courts have not yet had occasion to address standing under Indiana Code section 4-21.5-5-3(a)(3),” Judge Patricia Riley wrote.

“We agree with 21st Amendment to the extent that a party with ‘standing under a law applicable to the final agency action’ is not obligated to pursue relief under the separate statute; rather, judicial review under the AOPA is appropriate in those situations. I.C. § 4-21.5-5-3(a)(3). Here, however, we cannot say that the Commission’s issuance of an alcoholic beverage permit constitutes a final agency action to which the public nuisance laws apply,” she continued.

“Rather, as the public nuisance statutes establish, it is the conduct of the permittee (i.e., Grapevine Cottage) or conduct otherwise carried on in premises where alcoholic beverages are kept/sold that may give rise to a public nuisance claim. See I.C. §§ 7.1-2-6-1; -2. As the alleged nuisance is not the result of the agency’s action, but rather the subsequent conduct of the permittee, 21st Amendment does not have standing under Indiana Code section 4-21.5-5-3(a)(3) of the AOPA. As the trial court found, 21st Amendment’s statutory right to abate and enjoin a public nuisance for improper alcohol sales must be achieved through a separate nuisance action.”

The case is 21st Amendment, Inc. v. Indiana Alcohol & Tobacco Commission, 49A05-1612-PL-2863.

Americade Exposition by Pat Sides

Students arrive at the Evansville Coliseum on November 2, 1955, to visit the Americade Exposition, a four-day event sponsored by the National Association of Manufacturers in cooperation with the Evansville Manufacturers and Employers Association and the Evansville Chamber of Commerce. Evansville was one of only five cities in the nation selected for a premiere showing of the displays, which highlighted America’s potential for “tremendous advances in all areas of human achievement.” Attractions included simulated rides in “futuristic aircraft” and closed-circuit televisions. Nearly 20,000 people viewed the exposition, which outpaced attendance in St. Louis, Louisville, and other larger cities.

Dr. Richard Moss formally committed to joining the “Freedom Caucus,” the conservative bloc within the Republican Caucus in Congress at the announcement of his candidacy on September 9, 2017.  

Dr. Moss, who ran against Congressman Larry Bucshon in 2016 is deeply concerned about the direction of the Republican Party.  “I intend to win this Congressional seat and join the Freedom Caucus.  We need to build a critical mass of constitutional conservatives within the Republican caucus and transform the Republican Party into an honest to God, hard-hitting principled Conservative party, not the big government, big spending, liberal progressive party it is today.”

“It is becoming harder and harder to distinguish the Republicans from Democrats in Washington.  Career politicians from both parties go to Washington, cut deals, grow the size of government, and bankrupt our children.  We need new conservative leadership in Washington DC, new conservative leadership from Indiana’s 8th Congressional district, a new conservative leader who will go to Washington, take on the career politicians in both parties, and fight for we, the American people.”

Dr. Moss then focused his attention on Bucshon. “It didn’t take Larry long to become another typical DC politician.  He has even moved his family to Washington, just like Richard Lugar and Evan Bayh.  He would rather mingle with Washington insiders and lobbyists than do what the voters of Indiana sent him to do.  Hoosiers voted Lugar and Baye out of office and they ought to do the same for Larry.”

“Larry has never met a spending bill he didn’t like. He votes for massive trillion dollar Omnibus bills, 1500 page monsters that no one reads that fund all the things he says he’s against like sanctuary cities, the EPA, amnesty, Planned Parenthood, the Iran Nuke Deal, and importing more Syrian Muslim ‘refugees.’  Like every establishment Republican he campaigns like a conservative but votes like a liberal.  He voted for the phony House Obamacare replacement bill, Obamacare 2.0. or SWAMPCARE.  It doubles down on Obamacare, maintains its basic structure, only making it worse, ensuring an even more rapid collapse of the health care market, but this time with Republican fingerprints all over it, leading to single payer. That is the SWAMPCARE bill Larry Bucshon voted for.  As a doctor he should have known better. Thank God the Freedom Caucus held strong and prevented it from passing.”

Christy gillenwater – NAMEd CEO of the greater Chattanooga chamber of commerce

Christy Gillenwater, President and CEO of the Southwest Indiana Chamber, announced today that she is resigning from that position and has accepted an offer to be the next President and CEO of the Greater Chattanooga Chamber of Commerce.

In June 2017, Christy was named Chamber Executive of the Year at the annual conference of the Indiana Chamber Executives Association (ICEA).  In 2015 Christy led the Southwest Indiana Chamber to be named Indiana Chamber of the Year by ICEA. She also led the Chamber to be named the 2016 National Chamber of the Year by the Association of Chamber of Commerce Executives (ACCE).

“In the more than four years that Christy has been at the helm, the Southwest Indiana Chamber has firmly established itself as one of the leading chambers in the Country.  On behalf of our board of directors and our community, I would like to thank Christy for her collaborative spirit and commitment to helping community organizations drive economic development in our region,” noted Jim Sandgren, President & COO, Old National Bancorp and Southwest Indiana Chamber Board Chairman.

Christy’s planned start date for her new role is December 1, 2017.  Tim Hayden, Chief Communications and Engagement Officer for the Chamber, has been named  interim President and CEO and will be working closely with Christy on transition in the coming weeks, until a national search can be completed and a permanent replacement is named.
