Supreme Court To Consider 3 Cases On Petition To Transfer Next Week

IL for www.theindianalawyer.com

The Indiana Supreme Court will decide whether to add three cases to its docket when it hears arguments on petition to transfer next week.

First, the case of Destin Jones v. State of Indiana, 84A05-1609-CR-02065, will come before the high court on petition to transfer at 9 a.m. Thursday. After Destin Jones was convicted of attempting and conspiring to commit armed robbery, he appealed, arguing the state failed to disprove his abandonment defense beyond a reasonable doubt.

The Indiana Court of Appeals reversed Jones’ attempted robbery conviction, but affirmed his conspiracy conviction in an April decision on the basis that the abandonment defense did not apply. Jones is now appealing to the high court to accept jurisdiction over his case.

The court will then hear the case of In re Termination of the Parent-Child Relationship of A.K.G. (Child) and S.M.H. (Mother) v. Indiana Department of Child Services, 02A03-1608-JT-01869, in which S.M.H.’s parental rights were involuntary terminated and a permanency plan calling for the adoption of her child, A.K.G., was approved. The Court of Appeals affirmed the Allen Superior Court’s findings that although S.M.H. completed services, she remained unable to ensure A.K.G.’s safety and maintain employment and suitable housing.

Oral arguments on petition to transfer in that case will begin at 9:45 a.m.

Finally, the high court will consider whether to take the case of Billy Brantley v. State of Indiana, 49A04-1606-CR-01401. In that case, a divided Court of Appeals reversed Billy Brantley’s conviction for voluntary manslaughter in relation to the shooting death of his brother-in-law after determining the state failed to prove “sudden heat,” as is required to sustain a voluntary manslaughter conviction. Oral arguments will begin in that case at 10:30 a.m.

Tyler Gray Ties For 4th Place At EKU

0

For the second time in three rounds this weekend, University of Evansville golfer Tyler Gray finished with a sub-70 round as the Purple Aces wrapped up the EKU Intercollegiate at the University Club at Arlington.

Gray opened the weekend with a 68 and finished with a 69 on Sunday.  His final total of 208 was good for a tie for 4th place.

Cameron Weyer kept up his solid weekend, notching his best score of the three rounds.  He notched a 72 in the final 18 to finish with a 221, tying for 58th.  Third for the Aces was Matthew Ladd.  His final day score checked in at a 75 as he posted a 225 for the three rounds.

Spencer Wagner had his best showing of the tournament.  After carding a 79 in Saturday’s opening round, Wagner lowered that to a 74 in round two before completing the final 18 with a 73.  He came home with a total score of 226.  Noah Reese was next up.  Reese totaled 76 strokes on Sunday, finishing the event with a 229.

As a team, UE remained in 15th place.  Sunday’s round was the best of the weekend for the squad as they registered a 289.  It was tied for the 6th-best team showing of the day.  Eastern Kentucky dominated play on Sunday, posting the best team score off the weekend – a 275 – to finish the event a -3 with an 837.  The Colonels were 12 ahead of second-place Longwood with Dayton taking third.

Jordan Boulton of Longwood was the medalist.  He toured the course in a tournament-low 65 shots in the final round to card a 204.  That was one ahead of EKU’s Noah Combs, who took second place.

UE’s next action will take place on Sept. 24 and 25 at the Northern Kentucky Fall Classic.

Eagles Rally Late, But Fall 2-1

0

The University of Southern Indiana men’s soccer team tried to rally late, but lost to Bellarmine University, 2-1, Sunday afternoon in Louisville, Kentucky. The Screaming Eagles fall to 2-3-0 overall and 0-3-0 in the GLVC, while Bellarmine sees its record go to 5-1-0 overall and 3-1-0 in the league.

The Eagles fell behind in the first third of the first half when the Knights took a 1-0 lead 15:53 into the match. Bellarmine would hold the 1-0 advantage through the intermission.

In the second half, Bellarmine increased its lead to 2-0 with a tally at 73:56. USI tried to rally and cut the deficit in half, 2-1, when sophomore forward Eric Ramirez (Vincennes, Indiana) scored at 79:51. The unassisted goal was Ramirez’s first of the season.

The Eagles would have two more shots at the Knights’ goal, but was unable to convert on the tying tally.

Eagles’ senior goalkeeper Adam Zehme (Orland Park, Illinois) stood tall between the posts today despite getting the loss in goal. Zehme faced 25 shots, 11 on-goal, allowed two goals, and made nine saves.

USI starts a two-match homestand Friday when it host the University of Indianapolis for a 7:30 p.m. kickoff. UIndy saw its record go to 5-1-0 overall and 4-0-0 in the conference after defeating McKendree University, 3-0, this afternoon in Indianapolis.

USI leads the all-time series with Indianapolis, 21-13-0, after the teams split a pair of games last fall. The Eagles won the regular season match-up, 1-0, but lost to the Greyhounds in the GLVC Tournament, 2-0.
