Suit Claiming Police ‘Unleashed’ K-9 On Sleeping Man Proceeds

The City of Indianapolis lost its bid to dismiss a lawsuit brought by a man who claims an officer “unleashed” a police dog on him as he slept, leading to serious injuries.

Charles W. Cooper sued the City of Indianapolis and Indianapolis Metro Police Officer Gregory Davis in July, alleging excessive force, unreasonable search and seizure, negligence, assault, battery and other causes of action against the city. Cooper claims — and IMPD admits in court filings — that in July 2015, Davis and other officers investigating a reported robbery unleashed a K-9 that “attacked and bit” Cooper.

Cooper claims he was sleeping on his grandmother’s porch when the dog was unleashed, and that he had done nothing necessitating the use of force. IMPD denies this in response to the complaint and asserts theories of immunity as affirmative defenses.

Chief Judge Jane Magnus-Stinson in the District Court for the Southern District of Indiana on Wednesday denied the city’s motion to dismiss Cooper’s suit, even though he did not reply to the city’s motion.

“The Court finds that Mr. Cooper has adequately alleged a Monell claim against the City. Mr. Cooper sets forth the individual treatment he received, alleges that Officer Davis and other employees ‘acted pursuant to official policy,’ and alleges that the City ‘had an official policy, procedure, or protocol authorizing its officers to use excessive force in situations such as described in this Complaint,’” Magnus-Stinson wrote. “At the motion to dismiss stage, this is enough to sufficiently state a §1983 claim against the City. … Accordingly, the Court denies the City’s Motion to Dismiss.”

The case is Charles W. Cooper v. City of Indianapolis and Officer Gregory Davis, 1:17-cv-2467.

Thunderbolts To Recognize Memorial State Champs

Hockey team giving tickets to Memorial boys and girls soccer, football teams

Evansville, Ind: The Evansville Thunderbolts are proud to announce that they will be recognizing the accomplishments of Memorial High School’s boys and girls soccer teams, as well as the football team, during the Thunderbolts’ hockey game on Friday, Dec. 1 at Ford Center.

As a way to reward the hard work of Memorial’s state champions, the Thunderbolts will be meeting with members of both soccer and football teams accompanied by the Memorial Varsity Cheerleaders from 5:30 to 6 p.m. Thursday, Nov. 30 at Ford Center. The Thunderbolts will personally invite the boys and girls soccer teams, cheerleaders and football team to Friday’s game to congratulate them for their state titles.

Both of Memorial’s soccer teams were successful at reaching the sports highest rung in the state this past October. The boys soccer team celebrated their second state championship in two years, beating Fort Wayne Concordia Lutheran 2-0, while the girls celebrated their state win, topping South Bend St. Joseph, 3-1.

On the football field, the Tigers recently defeated Brebeuf Jesuit, 29-17, at Lucas Oil Stadium to be named the state champions in Class 3A. Memorial went 14-1 on the season.

The Thunderbolts now begin a four-game home stand starting Friday against the visiting Knoxville Ice Bears. Doors open at 6 p.m., with the game starting at 7:15 p.m.

UE Student Maggie Phelps Honored at Realizing the Dream Banquet

University of Evansville student Maggie Phelps of Alexandria, Indiana, was one of 30 students from Indiana’s private, non-profit colleges and universities honored recently at the 28th annual Realizing the Dream Banquet. The event recognizes first-generation students attending Independent Colleges of Indiana campuses, along with their inspirational teachers and families. Realizing the Dream is made possible by a grant from Lilly Endowment Inc. to the ICI.

The students honored at the event have realized the dream of being the first in their families to go to college, have been selected by their colleges for outstanding achievement in the freshman year, and are successfully advancing toward completing their bachelor’s degrees. Each student will receive a $2,500 check to help with college costs, and each student’s selected “most influential” teacher/mentor will receive a $1,000 professional development grant. Phelps’s most influential teacher is Deborah Selke, an instructor at Alexandria-Monroe High School in Alexandria.

“We are honored that Maggie has chosen to attend the University of Evansville,” said Angie Dawson, UE director of student retention. “Maggie, now a sophomore, completed her freshman year at UE in our rigorous athletic training program with a GPA of 3.467. She is active in several campus clubs, works part-time on campus, and is a resident assistant. We are grateful to ICI for this scholarship, which rewards and recognizes hard-working students like Maggie.”

One out of every three students on ICI campuses is first-generation. Generous financial aid provided by the institutions, combined with state and federal grants, makes a private college education possible for all students in Indiana.

Evansville Man Indicted For Murder Following Heroin Overdose Investigation

Evansville, IN – Late Thursday afternoon, a grand jury indicted 37-year-old David Andrew Dimmett for Murder in the death of 35-year-old Kourtney Fields.

In the early morning hours of June 25th, emergency personnel were called to a death investigation on South Fairlawn Avenue.  Kourtney Fields was found unresponsive in a basement bedroom.  Due to drug paraphernalia near his body, detectives with the Evansville Vanderburgh County Joint Drug Task Force were called in to process the scene.  Toxicology results from the Indiana State Police indicated Fields died from a heroin overdose.

Through cell phone records and police interviews, detectives discovered evidence indicating that Fields purchased the heroin from David Dimmett.

David Dimmett is currently in the Vanderburgh County Jail for several drug-related charges.

Dimmett will now be advised of the new murder charge, and an initial hearing will be scheduled in Vanderburgh County Superior Court.

“Drug dealers are distributing potentially deadly substances into our community.  Our country is experiencing one of the worst drug epidemics we’ve ever seen.  And Vanderburgh County is no exception,” explained Vanderburgh County Prosecutor Nick Hermann.  “Kids are losing their parents.  And parents are losing their children.  And we cannot stand by and let this continue to happen.”

Evansville man sentenced to 36 years after traffic stop nets heroin, cocaine, & meth

Late Thursday afternoon, Vanderburgh County Circuit Court Magistrate Kelli Fink sentenced 40-year-old Kevin Shawn Carter to 36 years behind bars, after a December 2016 traffic stop netted 226 grams of meth, 2.36 grams of cocaine, and 30 grams of heroin.

In October, a jury found Kevin Shawn Carter guilty of:

  • Dealing in methamphetamine (Level 2 Felony)
  • Dealing in a narcotic drug (Level 2 Felony)

Carter, and a co-defendant in this case, were pulled over by Vanderburgh County Sheriff’s Deputies in December of 2016 for swerving out of their lane.  Several minutes later, deputies located a fast food bag inside the vehicle with narcotics that tested positive for methamphetamine, heroin, and cocaine.

“Our community is losing too many mothers, fathers, brothers, and sisters due to the disease of addiction,” explained Prosecutor Nick Hermann.  “Drug dealers are supplying deadly substances to our community, and more people are dying from drug overdoses in our community than ever before.  The investigation that led to Mr. Carter’s incarceration helped get a substantial amount of drugs off the streets.”

The Evansville Police Department is investigating the collision and can provide updates as to its progress.

Autopsies are scheduled for 13:00 hours today.

Softball to hold January clinics

On Sunday, January 7, 2018, the University of Evansville softball team will hold various winter clinics on the UE campus.

Students in grades 7-12 are invited to three clinics on the 7th that including Pitching/Catching, Hitting or Defense.  A full schedule is on the brochure that is linked on GoPurpleAces.com.

The hitting and defensive session will cover proper hitting, bunting, throwing and fielding techniques. The catching clinic will work on fundamentals of catching, throwing and blocking. The pitching session will teach the fundamentals and drills used at the collegiate level. All pitchers are required to bring their own catcher.

These clinics begin at 9 a.m. and go through 2:30 p.m.

Later in the day, from 4-6 p.m., a youth clinic will be held for grades 2-8.  This will focus on hitting, bunting, throwing and fielding fundamentals.

All campers will need to bring tennis shoes, glove, helmet, bat, catchers gear, and a water bottle.  Cost for each clinic is $75 and space is limited.
