“Toy Town” at Sears By Pat Sides

“Toy Town” was always a hectic place during the Christmas shopping season at the Sears store in downtown Evansville. In this late 1950s image, two employees position stuffed bears in a 1958 DeSoto Firemite, a miniature version of a larger DeSoto automobile manufactured by Chrysler to promote sales. A wide assortment of other toys is on display in the background, some on sale for as low as 88 cents. Sears catalog, which boosted sales with convenient “one-stop shopping.” The Sears building, which still stands at Fourth and Sycamore streets, was occupied by the giant retailer from 1925 to 1975.

MEET MIKE BRAUN CANDIDATES FOR THE UNITED SENATE

Mike Braun graduated from Jasper High School in 1972. He lettered in three sports (football, basketball and track), served as Senior Class President and received the Outstanding Senior Boy Award.

After high school, he went to Wabash College earning an economics degree, graduated summa cum laude and was a member of Phi Beta Kappa. He also served as President of the Student Body.

In 1976, Mike entered the Harvard Business School and earned an M.B.A. in 1978. In May of that year he moved back to Jasper accepting a position with Aristokraft. In 1979, he co-founded Crystal Farms, Inc. which has expanded over the years to become one of the largest turkey operations in the tri-state.

In May of 1981, he began his entrepreneurial career accepting a position with Meyer Body Company, eventually becoming sole owner and converting it into a distribution concern. Meyer Distributing now has nearly 800 employees with 65 locations in thirty- eight states. He is also owner of Meyer Logistics, a sister company that services all Meyer customers plus third party warehouse and transportation needs. Meyer Distributing has received numerous industry awards from various manufacturers as well as the coveted SEMA 2010 & 2015 “Distributor of the Year” award. He was awarded the Dubois County “Entrepreneur of the Year” in 2014.

Mike spends most of his spare time engaged in forestry related activities. He took the Purdue short course years ago and actively manages several tracts of timberland. This includes tree planting, timber stand improvement along with hunting and fishing on these properties. He and a co-owner were awarded the Charles Deam and Pioneer Forestry awards for woodland management.

Mike is a board member of Conexus Indiana Logistics Council (Southwest) and the Mid- State Corridor Development Corporation. He is a member of the Nature Conservancy, Indiana Woodland Owners Association and Quail & Upland Game Alliance. He has coached many youth sports in the past and served on the Jasper School Board from 2004 to 2014. He was recognized as an outstanding alumnus in 2008.

In November of 2014, he was elected as an Indiana State Representative serving District 63. He serves on Ways & Means, Roads & Transportation and Government Reduction Committees. He was a co-author of the House Transportation Bill in 2016 and 2017 and House Sponsor of SB128 concerning regional infrastructure projects in 2017.

Mike and Maureen Braun have been married for forty years and have four grown children, Jason, Jeff, Ashley and Kristen. Jason, Jeff and Kristen work with him at Meyer Distributing. Mike and Maureen are members of St. Joseph’s Catholic Church.

Attorney Who Claimed Improper Influence Over Judges Suspended For 90 Days

An attorney who implied to a client that he had the ability to improperly influence judges and suggested his client flee the court’s jurisdiction to avoid criminal prosecution has been suspended for 90 days.

While representing a defendant in a child molesting and child solicitation case, Indianapolis attorney Carl Epstein began recording phone conversations with his client during which he bragged about having personal relationships with judges and implying he could improperly influence those judges. Further, the recordings revealed Epstein made pejorative comments about another client’s race, and also discussed whether his client to should flee the jurisdiction to avoid or delay his criminal prosecution.

After the Indiana Supreme Court Disciplinary Commission filed a complaint against Epstein, he stipulated to committing the alleged misconduct. Epstein was then found to be in violation of Indiana Rules of Professional Conduct 1.2(d), 8.4(e) and 8.4(g). Those rules relate to counseling a client in criminal conduct, implying the ability to exert improper influence and engaging in conduct that manifests in bias or prejudice.

Thus, the Indiana Supreme court imposed a 90-day suspension without automatic reinstatement against Epstein in a Wednesday order. The suspension will take effect on Jan. 25.

Epstein can petition for reinstatement at the end of the 90-day period if he pays the costs of the proceeding, fulfills the duties of a suspended attorney and satisfies the requirements for reinstatement. He will also be required to show by clear and convincing evidence that he is remorseful, rehabilitated and fit to practice law.

Simmons Having Great Senior Season 

Senior Blake Simmons has continued his banner season in his final year with the Purple Aces.  In victories over Austin Peay and Midway, Simmons averaged 18 points per game while shooting 60% from the field (12-of-20).

He started the week hitting six out of nine shots against the Governors, finishing with 18 points.  The Newburgh, Ind. native was on the floor for 42 minutes in the win.  He followed that up with another 18-point effort on Sunday against the Eagles.  For the week, he was 5-8 from long range.

Simmons is a Sport Management major with a 3.83 GPA.

 

Dainius Chatkevicius posts career night as Aces fall to #4 Duke

Aces back in action for MVC opener on Saturday

DURHAM, N.C. – Facing one of the top frontcourts in the nation, University of Evansville junior Dainius Chatkevicius registered a career-high 12 points as the Purple Aces men’s basketball team fell to 4th-ranked Duke University by a final of 104-40 inside Cameron Indoor Stadium.

Chatkevicius hit six shots and lead the team with five rebounds.  Next up for UE (10-3) was Noah Frederking, who finished with nine.

“They took us out of everything we wanted to do, we couldn’t do what we wanted tonight,” Aces head coach Marty Simmons said.  “We will use this as a learning opportunity to teach our players how to be more committed. It is a quick turnaround to face Illinois State on Saturday and we need to be ready.”

Four Blue Devils (12-1, 0-1 ACC) finished in double figures, led by Wendell Carter Jr., who notched a game-high 27 points on 9-of-15 shooting.  Marvin Bagley III had 18 points while Grayson Allen and Gary Trent Jr. had 16 and 13 points, respectively.

UE notched the opening bucket of the game and held a 4-3 lead on a basket by K.J. Riley.  After Duke took a 5-4 lead, Blake Simmons put the Aces back in front with the squad’s first triple of the night making it a 7-5 game.

Duke took control from there, scoring 12 in a row to grab a 17-7 advantage.  The lead for the Blue Devils hovered around 10 points until the midway point of the first half.  Up 27-15 with just over 10 minutes on the clock, Duke wrapped up the half on a 31-3 run.  They converted on an unbelievable 67.7% of their attempts (21/31) in the half while knocking down 8 out of 11 free throws.

Chatkevicius led the team with 8 tallies in the opening period while Wendell Carter Jr. had 17.

In the opening three minutes of the second half, the Blue Devils added to the lead by reeling off the first 11 points.  Evan Kuhlman ended the UE drought with his first bucket of the night from outside.  Duke continued to hit from all parts of the floor, going up by a 78-21 margin with 15:21 on the clock.

Evansville never packed it in, fighting hard until the end.  Simmons and Marty Hill hit back-to-back triples to cut into the deficit, but the Blue Devils proved to be too much, taking the game by a final of 104-40.

For the game, Duke shot 61.9% while holding UE to 30%.

Missouri Valley Conference play begins for UE on Saturday as the Aces welcome Illinois State to the Ford Center for a 1 p.m. contest.  It is the annual West Side Game with vouchers for $5 tickets available at several locations across the west side of Evansville.

 

Attorney who failed to file appeal then lied about conduct suspended

An attorney who failed to timely file an appellant’s brief for a client seeking an expungement then lied about his work on the case has been suspended from the practice of law in Indiana for at least 90 days.

South Bend attorney Marcus Ellison was a supervisor at a pro bono expungement clinic sponsored by Ivy Tech Community College, but had no experience in expungement appeals. Even so, Ellison agreed to represent a client in an appeal of the denial of her petition to expunge a misdemeanor theft conviction and filed notice of the appeal in September 2015.

Notice of the completion of the transcript was then filed in November 2015, but Ellison failed to subsequently file an appellant’s brief that was due the following December. The client began emailing Ellison to ask about the status of her appeal, and he falsely implied the brief had been filed in two of his replies.

Then in March 2016, the online appellate docket indicated the appeal would be dismissed for failure to file an appellant’s brief. When the client emailed Ellison demanding an explanation, he chose not to respond, but rather moved in the Indiana Court of Appeals for leave to file a belated brief, falsely claiming he had appended the brief to the transcript and notice of appeal, but apparently did not attach it.

Ellison emailed a copy of the tendered brief to his client, who was able to discern that it had not been accepted for filing. The appeal was then dismissed with prejudice, though Ellison failed to inform his client of the dismissal or of any available options.

The client eventually filed a grievance with the Indiana Supreme Court Disciplinary Commission, which Ellison responded to by giving knowingly false explanations of his conduct on two occasions. Based on the results of the grievance investigation, Ellison was found to have violated seven Indiana Professional Conduct Rules, including:

  • Rule 1.1
  • Rule 1.3
  • Rule 1.4(a)(3)
  • Rule 1.4(b)
  • Rule 3.3(a)(1)
  • Rule 8.1(a)
  • Rule 8.4(c)

Though Ellison has no prior discipline, the Indiana Supreme Court wrote Wednesday his “pattern of dishonesty is very troubling and elevates this into a much more serious offense.”

“Respondent lied to Client, to the Court of Appeals, and to the Commission, all in an attempt to cover up his neglect,” the court wrote in a Wednesday per curiam opinion. “Moreover, Respondent has not accepted responsibility for any wrongdoing or demonstrated any insight into his misconduct.”

Thus, the court imposed a 90-day suspension without automatic reinstatement, effective Jan. 31. Ellison can petition for reinstatement at the end of the 90 days if he has paid the costs of the proceedings, fulfilled the duties of a suspended attorney under Admission and Discipline Rule 23(26) and satisfied the requirements for reinstatement under Admission and Discipline Rule 23(18).
