A LOOK BACK AT 2017 AND A LOOK FORWARD TO 2018 IN THE WORLD OF INTELLECTUAL PROPERTY

As we say goodbye to 2017 and ring in 2018, we thought it would be a good idea to take a look back on some of the biggest game-changing decisions from last year in intellectual property and look forward to how they might affect you and the world in 2018. While there were many to choose from, we selected three – a patent case, a trademark case, and a copyright case.

PATENTS

Since the passage of America Invents Act (AIA) in 2012, there has existed a faster and cheaper alternative to the federal court system for attacking the validity of an issued U.S. Patent. An inter partes review is a trial proceeding conducted at the USPTO’s Patent Trial and Appeal Board to review the patentability of one or more claims in an issued patent under certain limited circumstances. A third party instituting an inter partes review must show that there is a reasonable likelihood that the petitioner would prevail with respect to at least one claim challenged. If the proceeding is instituted and not dismissed, a final determination by the Board will be issued within one year (much faster than the typical case in federal court).

The constitutionality of the inter partes review is under attack in the Oil States Energy Services, LLC v. Greene’s Energy Group, LLC, which was argued before the U.S. Supreme Court in November 2017. The sole issue now being considered by the Supreme Court is whether inter partes review violates the Constitution by extinguishing private property rights through a non-Article III forum without a jury. A few years back (120 to be exact), in McCormick Harvesting Machine v. Aultman, the U.S. Supreme Court addressed this issue under similar circumstances, holding that “[t]he only authority competent to set a patent aside, or to annul it, or to correct it for any reason whatever, is vested in the courts of the United States, and not in the department which issued the patent.” Stay tuned to see if this “ancient” interpretation of the Constitution holds up in 2018.

TRADEMARKS

In Our September 2017 Blog and Newsletter, we reported to you on the death of disparagement in the world of trademarks. In Matal v. Tam, Supreme Court ruled that the United States Patent & Trademark Office (PTO) could not refuse registration of the name “The Slants” to an Asian-American dance rock band from Portland, Oregon on the grounds that the phrase constitutes a slur and is offensive to Asian-Americans. In doing so, the Supreme Court ruled that the trademark law barring disparaging terms infringes on free speech rights, and, as such is unconstitutional.

The issue was raised again last month in In re Brunetti, a decision by the U.S. Court of Appeals for the Federal Circuit. The Federal Circuit held that the “immoral” or “scandalous” marks provision of the Lanham Act is also facially invalid under the First Amendment. Brunetti
is the owner and founder of FUCT – a clothing brand that has been referred to as one of the pioneering brands of modern streetwear, often incorporating various elements and icons of pop culture alongside anti-government and anti-religious campaigns into their designs. It is worth noting that, in its opinion, the Federal Circuit concluded that strict scrutiny (high burden of proof), rather than intermediate scrutiny (intermediate burden of scrutiny as the name implies) is the applicable standard in assessing the issue because the law “regulates the expressive components of speech, not the commercial components of speech”. Even if the government concludes that the “immoral” or “scandalous” provision cannot be saved in light of Tam, there may be good reason to request review by the entire panel of the Federal Circuit or the U.S. Supreme Court on the proper level of scrutiny to be applied, particularly since federal trademarks are. by there very nature, “commercial”. Stay tuned!

COPYRIGHTS
Section 411 of the Copyright Act has long provided that “no civil action for infringement of the copyright in any United States work shall be instituted until preregistration or registration of the copyright claim has been made”. At present, there exists a split between the various Circuit Courts of the United States as to just exactly when such a registration or preregistration “has been made”. In the Fifth Circuit (Texas, Louisiana, Mississippi) and Ninth Circuit (California, Arizona, Nevada, Oregon, Washington, Idaho, Montana) this is considered to have occurred when the copyright holder delivers the required application, deposit, and fee to the Copyright Office. In contrast, the Tenth Circuit (Colorado, Utah, Wyoming, Kansas, Oklahoma, New Mexico) and Eleventh Circuit (Alabama, Georgia, Florida) require that the Copyright Office “act” on the application before registration or preregistration is considered to have been made. To complicate things further, our own Seventh Circuit (Indiana, Illinois, Wisconsin) has issued conflicting opinions on the issue.

With any luck, the U.S. Supreme Court will resolve this difference sometime in 2018. The loser of the 2017 decision of the Eleventh Circuit Court of Appeal in Fourth Estate Public Benefit Corp. v. Wall-Street.com, LLC is requesting the U.S. Supreme Court review the case and resolve the split between the circuits once and for all. At the present time, the U.S. Supreme Court has not yet determined whether it will hear the case and has asked the U.S. Solicitor General to weigh in with his views on the issue. Hopefully, this is a sign that the Supreme Court is considering hearing the case, particularly for those of us situated in the Seventh Circuit where there is no clear answer to this question.

First Impression: No Hearing Required On Specialized Driving Privileges

Indiana law does not require trial courts to conduct a hearing on petitions for specialized driving privileges where claims lack merit, an Indiana Court of Appeals panel unanimously ruled Wednesday in deciding a matter of the first impression.

Brent Orange had petitioned the Hamilton Superior Court for a specialized license that would permit him to drive back and forth to work and to court-ordered Alcoholics Anonymous and probation meetings. The trial court denied Orange’s petition, issuing an order that adopted his proposed order but stripped from it all language regarding the scheduling of a hearing.

Orange conceded in his brief “that I.C. § 9-30-16-1 et seq. does not say a trial court must hold a hearing on a petition for specialized driving privileges, but neither does the statute contain an express provision permitting a trial court to summarily deny such a petition.”

Judge Melissa May wrote for the Court of Appeals panel that affirmed the denial of Orange’s petition. She noted the legislature amended the statutes in question in 2015, repealing language that said in such cases the prosecuting attorney “shall appear in person or by the deputy and be heard by the court.”

“(W)e conclude the legislature intended to change the language of the statute to remove the requirement that the trial court held a hearing regarding a petition to grant specialized driving privileges after the suspension of a petitioner’s driver’s license,” the panel held in Brent Orange v. Indiana Bureau of Motor Vehicles, 29A02-1707-MI-1549.

However, the panel advised, “While a trial court is not required to hold a hearing under the statute, it may still err if it fails to grant a petitioner’s request for a hearing when the petition raises claims of possible merit.”  This wasn’t the case for Orange, adjudicated a habitual traffic violator multiple times and whose driving record of the past 10 years contained 27 different suspensions and whose eligibility date is “indefinite.”

Even though the court found Orange had waived his arguments, “there can be no question that the trial court properly exercised its discretion when it denied Orange’s petition for specialized driving privileges. … Additionally, the trial court did not err when it did not hold a hearing because Orange’s petition did not assert any claims of merit.”

 

Softball tabbed sixth in MVC preseason poll

The 2018 MVC Softball season will be highly contested as two points separate the preseason favorite from the school picked third. Illinois State has been picked as this year’s preseason favorite in Missouri Valley Conference softball as voted by the league’s coaches. The Redbirds earned two first-place votes and 88 points. Southern Illinois was picked in second-place with three first-place votes and 87 points while UNI claimed third (three first-place votes and 86 points).

The University of Evansville was picked to finish in sixth place (56 points) while junior Morgan Florey was named to the Preseason All-Conference Team.  The Purple Aces graduated 9 seniors from a season ago and will be under the experience of the lone senior, Brittany Hay and junior Morgan Florey.

“This is going to be an exciting season of MVC softball action,” UE head coach Mat Mundell said.  “As you can tell from the coaches voting, the league is going to be wide open.  I understand being picked to finish sixth because we have a lot of question marks coming into the season our goal of course is to finish higher.”

Hay was named 2017 MVC Newcomer of the Year while Florey earned 2017 MVC All-Conference Second-Team laurels and 2018 MVC Preseason All-MVC honors. Against league foes, Florey held a 1.81 ERA and struck out 95 batters, the best in the Conference.

Nine of the Missouri Valley Conference softball teams begin action the second weekend of February, with tournament play and non-conference games. Indiana State will start the season the following weekend. League competition will begin Friday, March 16 for two teams with the remainder of the Conference starting Saturday, March 17.

Evansville is ready to start its season in Lafayette, La. at the Louisiana Classic.  The Aces face Samford, Louisiana, UIC, Iowa and Eastern Illinois in the tournament.

Stephen Feistel Joins Schultheis Insurance

V-Day USI To Mark 20th Anniversary Of The Vagina Monologues With Benefit Reading

The University of Southern Indiana Philosophy Club and V-Day USI will present a benefit reading of Eve Ensler’s The Vagina Monologues at 7 p.m. Thursday, February 22 and Friday, February 23 in Forum III in the Wright Administration Building on the USI campus. Doors open at 6:40 p.m. and tickets may be purchased at the door for $8.

The reading is being staged to recognize the 20th anniversary of the debut of The Vagina Monologues and as part of V-Day, a global activist movement to end violence against women and girls through the staging of benefit readings of The Vagina Monologues and other performances. USI has hosted a benefit reading of Ensler’s play since 2007.

“In an era of #metoo, we truly hope the Evansville community will turn out to make V-Day a day of real victory over violence against women and girls,” said Dr. Mary Lyn Stoll, associate professor of philosophy and V-Day USI coordinator. “We can show our love to all of the women in our lives by helping to support this event.”

Ninety percent of proceeds from the reading will be donated to Willow Tree of Posey County, working to help women and girls coping with sexual assault and domestic violence. The remaining 10 percent will go to the V-Day Rise 2018 Campaign.
