Historic New Harmony’s 34th annual Heritage Artisans Days will take place from 8 a.m. to 3 p.m. April 18 through 20, in New Harmony, Indiana. The Tri-state tradition celebrates 19th-century arts, crafts and industry through demonstrations and activities. Groups of third and fourth graders from Indiana, Illinois and Kentucky will experience what life was like in the 1800’s through the eyes of a variety of period artisans. New Harmony welcomes an average of 3,000 visitors for Heritage Artisan Days each year. While the event aligns with grade-school curriculum, it is also open to the public each day. Paul Ryan rides into the sunset

• With Ryan’s announcement, 25 GOP Congressmen and 3 GOP senators have announced their plans to retire. That’s not one or two, that’s a rush to the exits.

• In Indiana, we’ve seen a surge in first-time candidates, women candidates and millennial candidates step up to run and a sizable increase in the number of Statehouse districts Hoosier Democrats are contesting. The battleground is expanding nationally and right here.

• We can’t take anything for granted, we’ll have to rely on *grassroots organizing and we’ll win one conversation at a time, but Ryan’s exit is an eyebrow-raising data point.

Justices to hear appeal over trains blocking road crossings

The Indiana Supreme Court will decide whether state or federal law controls how long trains may block road crossings.

The court agreed last week to hear the railroad’s appeal of an Indiana Court of Appeals decisionreversing an Allen Superior judge’s ruling to grant Norfolk Southern Railroad Company summary judgment. The Court of Appeals ruled that federal law does not preempt state laws that forbid trains from blocking road crossings for more than 10 minutes.

Virginia-based Norfolk Southern argues that Indiana Code 8-6-7.5-1, which regulates the amount of time trains may block roadways, was preempted by the Interstate Commerce Commission Termination Act and the Federal Railroad Safety Act. The railroad does not dispute nearly two dozen citations Indiana issued for blocking crossings, but it says federal law preempts enforcement of the state statute.

But writing for the COA panel, Judge Melissa May held on a matter of first impression that federal codes do not address how long trains may block roads, and other federal circuits have ruled that states have the power to regulate crossings. “Without state action,” May wrote, “railroads would be allowed to block major thoroughfares for an infinite amount of time because the federal regulation is silent.”

The case is State of Indiana v. Norfolk Southern Railway Company, 02A03-1607-IF-1524.

Justices also agreed last week to hear a dispute over whether an auditor’s error should invalidate a Henry County tax sale.

In that case, the Indiana Court of Appeals allowed Lamasco Redevelopment LLC to move forward with its purchase of two Henry County properties at tax sale despite the county auditor’s failure to comply with Indiana Code 32-21-8-7. The auditor claimed the office inadvertently violated that statute by endorsing deeds to transfer the original property owners’ interests in the parcels to other persons prior to issuing tax deeds for the parcels to Lamasco.

The COA let the sale stand, with Senior Judge John Sharpnack writing that the purchaser should not be penalized for the government entity’s error. “Viewed equitably, Lamasco, who did all required by law, stands on higher ground than the county officials who failed to do all required by law and the grantees who benefitted from that failure.”

The case is Lamasco Redevelopment LLC v. Henry County Auditor, et al., 33A01-1702-MI-398.

USI to host KWC, #4 Tampa this week

The University of Southern Indiana baseball team returns to the friendly surroundings of the USI Baseball Field this week to host Kentucky Wesleyan College (18-18) Tuesday at 6 p.m. before a three-game showdown with fourth-ranked University of Tampa (31-5) April 20-21. Start times for the USI-Tampa series are set for 6 p.m. April 20 and 21, prior to concluding the three games with a noon first pitch April 22.

SCREAMING EAGLES BASEBALL NOTES:

USI goes 2-3 last week. USI (18-16) saw its winning streak go to nine games with a victory over Oakland City University, 6-3, to start last week’s action before going 1-3 in GLVC action over the weekend at Bellarmine University. The Eagles, in the four-game set with Bellarmine, lost the opener 6-5; game two, 8-5; and game three, 7-6; and rallied to salvage game four,13-8.

USI the last five games. Senior utility player Nick Gobert (Jasper, Indiana) led the Eagles last week with a .579 batting average (11-for-19), six runs scored; three doubles, two triples, and 10 RBIs.

Hitting Streak. Senior rightfielder Buddy Johnson had his hitting streak snapped after a career-high 12 games in the nightcap of the first doubleheader at Bellarmine. Senior utility player Nick Gobert has the team’s best hitting streak this season, reaching 13 games. Kyle Kempf owns USI’s longest hitting streak, 26 games (last 12 games of 2015 and first 14 games of 2016).

USI at the plate this season. Senior first baseman/leftfielder Drake McNamara leads USI hitters in 2018 with a .386 batting average and a team-high 37 RBIs, 15 doubles, and six home runs. Senior utility player Nick Gobert, who has seen action at first base, third base, right field, and on the mound, follows with a .358 batting average and ranks second on the squad with 35 RBIs, while rightfielder Buddy Johnson is third with a .357 batting average and 32 RBIs.

USI on the mound this season. Senior right-hander Devin Williams (Evansville, Indiana), senior right-hander Kyle Griffin (Morganfield, Kentucky), senior utility player Nick Gobert, and sophomore right-hander Tyler Hagedorn lead the Eagles with three wins each. Griffin also has a team-best 55 strikeouts.

Out of the bullpen. Junior right-hander Dalton Lewis (Parker, Colorado) has USI’s best ERA in 13 appearances in relief (2.19). Lewis, sophomore right-hander Jacob Bowles, and sophomore right-hander Tyler Hagedorn are tied with one save each.

Moving up the charts. Senior first baseman/leftfielder Drake McNamara and senior third baseman/shortstop Sam Griggs (Evansville, Indiana) are moving up the USI all-time record book.

Florida man wanted for attempted murder arrested in Evansville

Evansville Police arrested 28 year old DAHMAD HEATH on an attempted murder warrant on Sunday evening.
Officers were called to a motel on the 8100 block of E Walnut for a reported sexual assault. Several men in the room were detained as part of the investigation.
HEATH gave a false name, but officers were able to determine his real identity. Officers found out he was wanted for attempted murder in Fort Lauderdale Florida. The warrant stemmed from an April 6th shooting that left one man injured.
HEATH is in the Vanderburgh County Jail awaiting extradition.

TROPICANA ENTERTAINMENT INC. ANNOUNCES DEFINITIVE SALES AGREEMENT

(NASDAQ: IEP), announced today that it has entered into a definitive agreement to sell Tropicana’s real estate to Gaming and Leisure Properties, Inc. (NASDAQ: GLPI) and to merge its gaming and hotel operations into Eldorado Resorts, Inc. (NASDAQ: ERI), for aggregate consideration of approximately $1.85 billion.

The transaction does not include Tropicana’s Aruba assets, which will be disposed of as a condition to closing. The aggregate consideration of approximately $1.85 billion will be increased by the amount of the net proceeds received in connection with the Aruba disposition and will be further adjusted to pay corporate level taxes.

The transaction is expected to close in the second half of 2018, subject to receipt of required gaming approvals, termination of the waiting period under the Hart-Scott-Rodino Antitrust Improvements Act of 1976, as amended, and other customary closing conditions. The transaction is not subject to any financing condition.
