Johnson sends Eagles into national championship series
Celebrating her 21st birthday in style, junior second baseman Claire Johnson (Pittsboro, Indiana) hit a solo home run in the bottom of the seventh inning to tie the game and drove in the winning run in the eighth as University of Southern Indiana Softball rallied from a 4-2 deficit to defeat No. 25 Saint Leo University, 5-4, in the semifinals of the NCAA Division II Softball Championship Sunday morning.
The Screaming Eagles (39-23) advance to play in the best-of-three national championship series for the first time in program history and are now just two wins away from claiming the first team national championship in the history of women’s athletics at USI.
In a comeback that began Saturday morning, the Eagles roared back from a 4-0 deficit. After spotting the Lions (39-18) four runs in the top of the first frame, USI scored in the bottom of the first inning on an RBI-double by junior outfielder Allison Schubert (Nicholasville, Kentucky).
After back-to-back hits by Schubert and senior third baseman Mena Fulton (Bloomington, Indiana) put runners on base with no outs in the fourth, sophomore shortstop Taylor Ricketts (Georgetown, Kentucky) pushed across the second tally on an RBI-groundout.
Neither team scored a run in the fifth as rain took hold of the Roanoke Valley, forcing the contest to be halted and resumed Sunday.
After sophomore pitcher Jennifer Leonhardt (Louisville, Kentucky) mowed down the Lions’ lineup in the sixth inning Sunday morning, Fulton led off the last half of the sixth frame by being hit by a pitch.
A passed ball allowed Fulton to move to second base before USI Head Coach Sue Kunkle inserted freshman Alicia Webb(Elberfeld, Indiana) to run for Fulton. The move payed dividends as senior first baseman Marleah Fossett (Brownsburg, Indiana) hit a ball up the middle that scored Webb and got the Eagles to within a single tally.
Leonhardt, who retired 16 consecutive batters at one point between Saturday and Sunday, set the Lions down in order again in the seventh, setting the stage for Johnson’s heroics in the bottom of the inning.
Johnson, who was down in the count, 1-2, drilled the fourth pitch of the at-bat over the leftfield fence to tie the score. The home run was the first long ball hit by USI during the 2018 NCAA II Tournament and was the first in program history at the NCAA II Softball Championship.
After a one-out single broke up Leonhardt’s streak of batters retired in the top of the eighth inning, Johnson began a 4-6-3 double play to get the Eagles out of the frame unscathed.
In the bottom of the eighth, Ricketts drew a one-out walk to get the Eagles going. A base-hit by junior catcher Lindsey Barr(Whitesville, Kentucky) put runners on first and second, while a walk to senior outfielder Olivia Clark-Kittleson (Carbondale, Illinois) loaded the bases for Johnson, who sharply hit a ground ball to the shortstop that was mishandled, allowing Ricketts to score the winning run from third base.
Leonhardt (23-12) earned the win after giving up four runs off four hits in eight innings of work. She struck out eight batters and allowed just one hit in the final seven innings of the game.
USI will play Saint Anselm College (44-11-1) in game one of the national championship series Sunday at 6 p.m. (CDT). The Hawks defeated No. 8 Southern Arkansas University, 3-0, in the “if necessary” game Sunday afternoon to advance.
ServSafe® Certification Course Planned at Ivy Tech Community College
Ivy Tech Community College Tell City Career & Technology Center is now offering a one-day food handler course which will provide individuals the certification they need to legally process, serve, and sell food for public consumption.
The ServSafe® certification course will be offered on Wednesday, June 20, 8 a.m. to 5 p.m. The cost of the course and exam is $175.
The Indiana Code 410 IAC 7-22 requires mandatory certification for all food service operations. In 2006, the Conference for Food Protection, in conjunction with the American National Standards Institute, developed a national standard for measurement of food safety knowledge that has universal acceptance by state and local food protection agencies and the food industry in general. At least one individual per food establishment must possess this certification and oversee food safety operations within the establishment.
ServSafe is one of only five exams that meet the Indiana certification requirements for food safety. The Ivy Tech course includes ServSafe® certificate (valid for five years), recognition from the International Food Safety Council, and permanent registration with the National Restaurant Association Education Foundation.
Register in person at Ivy Tech Community College Tell City Career & Technology Center at 1034 31st St, Tell City, Indiana, or by phone at 812-429-9810. Space is limited.
Textbooks are also available at the Tell City Career & Technology Center. Advance study is recommended. The certification exam will be given immediately following the class. Two pieces of identification are required to take the exam, including one photo ID with signature.
Appeals court orders further proceedings in lake-use flap
Dave Stafford for www.theindianalawyer.com
A dispute over shoreline rights between a property owner and the association that controls access to part of Lake Freeman in Carroll County will go back to the trial court after the Indiana Court of Appeals granted the property partial relief.
Patricia M. Jones was locked out of an area of the shoreline she had improved on Lake Freeman by the Von Hollow Association. Her property of a little more than half an acre does not front on the lake, but she is granted access to the shore through a yearly license issued by the Shafer and Freeman Lakes Environmental Conservation Corp. Von Hollow also is issued a separate license for the same shorefront.
After a lake access dispute arose with neighbors who were members of the Von Hollow Association, the association changed the locks granting shore access in 2015 and didn’t give Jones a key to the property she’d used since 1998.
Jones sued in 2016, seeking a declaratory judgment that she had a prescriptive easement; an injunction preventing Von Hollow from obstructing or interfering with her use of the easements over the Von Hollow property; and a judgment against Von Hollow for trespass. Von Hollow counterclaimed for trespass, and Carroll Circuit Judge Benjamin Diener ruled for Von Hollow on its trespass counterclaim against Jones and denied her other claims.
The Indiana Court of Appeals reversed that decision in part Friday in Patricia M. Jones v. Von Hollow Association, Inc., 08A02-1709-PL-2175. Writing for the panel, Judge Robert Altice reversed the trial court’s finding of criminal trespass against Jones, as well as its order directing the shorefront be licensed jointly to Jones and Von Hollow by the Shafer and Freeman Lakes Environmental Conservation Corp.
“Recognizing the discord that existed between the parties with respect to the (shorefront license) agreements and each party’s rights within the shorefront area, the trial court attempted to mitigate the situation by directing SFLECC to issue the parties joint licenses to use the area. However, SFLECC is not a party to this action,†Altice wrote. “Regardless of its good intentions, the trial court erred by directing SFLECC to issue joint licenses. We reverse the trial court’s judgment in this regard.â€
The trial court properly determined that Von Hollow did not commit trespass; “however, its conclusion that Jones committed criminal trespass under Ind. Code § 35-43-2-2 is not supported by the record and is clearly erroneous,†because she had authorization to use the shoreline through her license.
“Because the trial court erred when it determined that Jones committed criminal trespass, it also erred when it concluded that Von Hollow was entitled to costs of the action and reasonable attorney fees under Ind. Code § 34-24-3-1 (pecuniary loss as a result of property offenses),†Altice wrote. “We, therefore, reverse the trial court’s judgment on this issue.â€
The panel affirmed, however, that Jones did not establish a prescriptive easement over the property. The court noted such easements are disfavored in Indiana. The matter was remanded for proceedings.

JUST IN: National Championship Series Pushed To Monday
University of Southern Indiana Softball will have to wait until Monday to open the best-of-three NCAA Division II National Championship Series with Saint Anselm College.
The two teams will play game one of the series at 9 a.m. (CDT), with game two slated to start 30 minutes following the conclusion of the opener. Game three, if necessary, is slated for Tuesday at a time to be determined.
Rain and soggy field conditions were a determining factor of the games being pushed back.
USI falls to Florida Southern to open series
The University of Southern Indiana baseball team dropped a soggy 5-3 decision to third-ranked Florida Southern College to open the NCAA Division II Baseball Championship Saturday evening at the USA Baseball Training Center in Cary, North Carolina. USI, the eighth-seed, falls 36-22 overall, while Florida Southern, the top-seed, rises to 43-9-1.
With the loss, the Screaming Eagles advances in the NCAA Division II Baseball Championship to play fourth-seeded/23rd-ranked Southern New Hampshire University, who lost to fifth-seeded/11th-ranked Augustana University, 5-2, Sunday at 3 p.m. (CDT) due to the weather forecast for Monday.
USI jumped out to the early 1-0 lead with a tally in the top of the third inning on a RBI-single by junior second baseman Jacob Fleming (Evansville, Indiana). The single scored freshman shortstop Ethan Hunter (Terre Haute, Indiana) from third.
Hunter had moved into scoring position after singling to open the frame, advanced to second on a stolen base, and reached third on a sacrifice by freshman centerfielder Bryce Krizan (Mt. Vernon, Indiana).
After the Mocs posted a four-spot in the bottom of the fourth, the teams were forced from the field for a one-hour-14-minute rain delay. Florida Southern emerged from the delay and extended its lead to 5-1 with another tally in the bottom of the fifth.
USI closed the gap in the top of the seventh when senior first baseman Nick Gobert (Jasper, Indiana) homered to left field to make the score, 5-2. The Eagles would close the gap once again in the ninth and get the tying run to the plate after senior third baseman Sam Griggs (Evansville, Indiana) scored on an RBI-fielder’s choice by Hunter to cut the margin to 5-3, but that would be as close as the Eagles would come before the final out.
Eagles’ senior right-hander Devin Williams (Evansville, Indiana) battled on the mound for eight innings before taking the loss. Williams (5-5) allowed five runs on eight hits and three walks, while striking out four.
Grau earns 2nd-team All-America honors with 9th-place finish
University of Southern Indiana senior Bastian Grau (Höchstadt, Germany) concluded his collegiate career Saturday evening with a ninth-place finish in the men’s 5,000 meters at the NCAA Division II Outdoor Track & Field Championships.
In doing so, Grau earns second-team All-America honors, bringing his career total to four All-America awards.
The 2017 national champion in the indoor mile, Grau survived a humid and muggy evening Saturday to finish the 5,000-meter race in 14 minutes, 28.08 seconds. Grand Valley State University senior Zach Panning won the race in 14:00.69.
Grau began the race running toward the back of the field, which consisted of 20 competitors. He navigated his way up seven spots from his position early in the race to secure the All-America nod.
The All-America award is the second outdoor honor for Grau, who earned first-team All-America status in the 1,500 meters as a junior in 2017. He captured All-America laurels in the mile and the distance medley relay during the 2017 indoor season.
Rain wins Day 3 at NCAA II Softball Championship
University of Southern Indiana Softball had its semifinal game against Saint Leo University in the NCAA Division II Softball Championship halted after five innings due to rain. The game will resume Sunday at 7:30 a.m. (CDT) heading into the top of the sixth with the Screaming Eagles trailing, 4-2.
The Lions, who edged No. 1 University of North Georgia in the elimination bracket Saturday morning, began the game by scoring four runs off three hits and a pair of walks in the top of the first inning.
Sophomore outfielder Allison Schubert (Nicholasville, Kentucky) got the Eagles on the board in the bottom of the first inning with an RBI-double that nearly went over the leftfield fence. It was Schubert’s 50th RBI of the year, making her the fifth player in program history to reach 50 RBIs in a single season.
USI used back-to-back hits by Schubert and senior third baseman Mena Fulton (Bloomington, Indiana) to get things going in the bottom of the fourth inning. Sophomore shortstop Taylor Ricketts (Georgetown, Kentucky) pushed a run across two batters later with an RBI-groundout. The Eagles had runners at first and second with one out in the fifth, but could not push across a run.
Meanwhile, sophomore pitcher Jennifer Leonhardt (Louisville, Kentucky) has shaken off a rough start to retire the last nine batters she has faced. She has five strikeouts through five innings of work.
If USI fails to rally from the 4-2 deficit in the final two innings Sunday, the Eagles will play Saint Leo once more 30 minutes following the conclusion of the current contest. A win Sunday will put the Eagles into the best-of-three championship series, which has been pushed to Monday with game one set to start at 11 a.m. and game two at 1:30 p.m. Game three of the championship series, if necessary, is slated to start Tuesday at 11 a.m.
On the other side of the bracket, No. 8 Southern Arkansas University defeated No. 6 Angelo State University, 3-0, in the elimination bracket Saturday morning before topping No. 25 Saint Anselm College, 11-5, to force an if necessary game Sunday at 11 a.m.
