We hope that today’s “IS IT TRUE” will provoke honest and open dialogue concerning issues that we, as responsible citizens of this community, need to address in a rational and responsible way?

IS IT TRUE the revelation that Evansville City Controller Russ Lloyd Jr., CPA hasn’t paid the $369,000 in Victory Theater bills for 2017 has really got the attention of many people?  …he has taken $369,000 from the 2018 city budget to pay for the operating expenses of the Victory Theater for 2017 without City Council knowledge or approval?  …we wonder where  City Controller Lloyd is going to find the money to pay for the Victory Theater bills for 2018?  …we wonder why someone hasn’t contacted the Indiana State Board of Accounts to report this questionable transaction?

IS IT TRUE last week it was announced that the Thunderbolts Head coach and General Manager are moving on to greener pastures?  …we wish them the best in the future? …their unexpected departure leaves some daunting questions concerning the Thunderbolts hockey team past, present, and future financial activities?

IS IT TRUE to understand what economic risk if any that VenuWorks of Evansville LLC may have with respect to the Evansville Thunderbolts Hockey team, one must first examine addendum #6 to the legal contract agreement between VenuWorks and the City of Evansville that was discreetly funneled through the Evansville Redevelopment Commission? … this legal agreement deals with the operation and control of the Evansville Thunderbolts?  …in addendum #6 of this legal contract, it stated: “VenuWorks shall be entitled to utilize facility (Ford Center) staff and resources reasonably necessary in connection with its operation of the SPHL Franchise?”  … during any such periods in which VenuWorks operates the SPHL Franchise, ALL OPERATING EXPENSES OF THE SPHL FRANCHISE SHALL BE DEEMED AN EXPENSE OF THE FACILITY (Ford Center) AND ALL OPERATING REVENUES OF THE SPHL FRANCHISE SHALL BE DEEMED A REVENUE OF THE FACILITY (Ford Center)?”

IS IT TRUE the taxpayers and City Council members need to know who is responsible for the paying the for the administrative, support staff and players salaries of the Evansville Thunderbolts? …the taxpayers and City Council members need to know who is paying for the yearly SPHL franchise fees? …the taxpayers and City Council members need to know who is responsible for away games travel expenses (transportation, meals, and lodging) for the Thunderbolts?  …the taxpayers and members of City Council need to know who is paying for the medical costs for injured players for the Thunderbolts?  …the taxpayers and City Council members need to know who is responsible for paying for the marketing of the Thunderbolts?  …the taxpayers and City Council members need to know who is responsible to pay the costs of providing housing for the Thunderbolts players?  …the taxpayers and City Council members need to know who is responsible to pay for all the costs in getting the FORD CENTER ready for the Thunderbolts to play hockey?

IS IT TRUE it’s obvious the taxpayers and members of the Evansville City Council need to have an accurate and detailed breakdown down of the profit and loss statements for the 2017-18 Thunderbolt hockey season?  …its also obvious that the taxpayers and City Council members need to know where is the Ford Center getting the money to cover any possible losses incurred by the Evansville Thunderbolts?

IS IT TRUE that the boys of summer are out in force and baseball is drawing faithful crowds to Bosse Field to see the Evansville Otters attempt to make the playoffs?…once upon a time when Russ Lloyd Jr. was Mayor of Evansville we were very close to having an AAA affiliate of the Los Angeles Dodgers playing in a $20 Million downtown baseball stadium?…all of the big shots in town were behind the project and the location was chosen to be where “The District” now sits?… The District has seen a parade of ribbon cuttings followed by closings and just recently was dealt a blow when RiRa’s closed?

IS IT TRUE the reason that Evansville missed out on the AAA Dodgers Affiliate is because Jonathan Weinzapfel made it a campaign issue deriding Mayor Lloyd for “taking us all out to the ball game” with a wasteful downtown baseball stadium where a court jester ran the bases?…the silly commercial worked and the baseball stadium was cancelled?…four years later when Weinzapfel became Mayor he forgot about how a $20 million baseball stadium was the butt of jokes and borrowed $127 million for the Ford Center that has never even paid its own operating expenses much less it’s $8 million per year mortgage?…it looks like we got taken out to the old ballgame after all?

IS IT TRUE that last Friday the Vanderburgh County Commissioners in conjunction with the Old Courthouse Foundation, Sheriff’s Office and the Vanderburgh Bicenntenial Committee hosted another successful “Lunch On The Lawn” event?  …that this event was the best one yet?  …this event offered many family-friendly activities such as a zip line, red-white-and Blue popsicles, food stands and more? …we are pleased to learn that the Vanderburgh County Commissioners and the Old Courthouse Foundation decided to build a   Bicentennial Park downtown?  …we are told that the downtown Bicentennial Park will be self-funded and paid for out of the funds from the Old Courthouse Foundation?

SEND YOUR OPINION ABOUT PROPOSED WATER AND SEWER RATE INCREASE RATE INCREASE TO UCC

If you didn’t know about the hearing on the city’s plan to raise our water bills even higher, you still have a chance to let the state know what you think about it. Everybody needs to get involved in this because it is a burden for all of us, a burden we just can’t handle and a burden that involves more than money for water and sewers.

You have until July 13 to send your opinion by email to this email address: UCCinfo@oucc.In.gov.

Write what you are talking about Cause 45073. You will have to give your name, mailing address, email address and daytime phone number. Say that you are a customer. Don’t be afraid to give this information because this is important. Say in your own words what these higher bills mean for you already and what even higher bills will do to you.

If you have friends or neighbors that might not have a computer or email, offer to help them send a message too.

I went to the meeting at Bosse High School because I wanted to speak for the people who are already having a hard time paying their water and sewer bills. I really didn’t expect many people to attend because there wasn’t much publicity about it, even on social media. 

I have seen that these fees and other costs are having a very negative impact on the way citizens are living in Evansville. I am especially worried about the elderly and everybody with low income. I am afraid for the single mothers and everyone just trying to feed their families and keep them in decent housing.

I went to speak for the people who I didn’t think would be able to come.

But I wasn’t the only one there for this reason. People in this community care about each other. Some came to talk in the same terms. They told of their own struggles and the problems being caused for their neighborhoods. Some talked about the negative impact the water line work is already having on their property.

People made comments for several other reasons, gave other facts. I learned there are many more sides to the issue, even though I believe the most important side is that we cannot pay these bills.

I heard comments about how the water & sewer department operates and how the city operates and the financial aspects of both of them. I heard people give details of money being used also to make new parks and bike trails and just being used for things that have nothing to do with water and sewers.

I listened to county residents talk about the impact on them because they get city water. Some people talked about science and engineering and what the water department actually does to get water to us and clean the water we put back in the sewers.

Older people spoke. Young people spoke. There was diversity in the group. Some gave specific details. Others spoke through emotion. One lady started to cry.

It was a good meeting, and I made new friends and contacts. We have to work together for all of us because it impacts all of us.

Schedule Coming Soon with C-SPAN Joining in for National Broadcasts
INDIANAPOLIS – The Indiana Debate Commission will host two statewide televised debates this fall in one of the nation’s most highly anticipated mid-term elections for Indiana’s U.S. Senate seat.
The participating candidates are Republican Mike Braun, incumbent Democrat Joe Donnelly, and Libertarian Lucy Brenton. The commission is working with the campaigns to finalize dates and venues for the debates, which will be announced at a later date.
In addition to statewide broadcast and live streaming, the debates will be available nationwide via C-SPAN.
“The results from the Indiana U.S. Senate race could determine which party controls the Senate in 2019,” said C-SPAN Political Editor Steve Scully. “C-SPAN is pleased to partner with the Indiana Debate Commission to bring this important race to a national audience.”
Hoosier voters can continue submitting proposed questions to be considered for the debates on the commission’s website at www.indianadebatecommission.com. Voters can submit questions that are most pressing to their lives and businesses for matters that are under the control of a U.S. senator.
The commission is working to further accommodate Hoosier voters this fall with venues that will be open to the public.
“This particular race has generated significant interest within Indiana and beyond our borders,” said Commission President Gerry Lanosga. “We will continue our independent role in producing widely-disseminated, public-focused debates that provide voters with the best opportunity to hear the candidates in an unfiltered setting.”
The Indiana Debate Commission is open to a third debate this fall should the candidates come to an agreement later in the election season. Over the commission’s 10-year history, it has included as many as three debates – and as few as one – in the races for Indiana’s U.S. Senate seats.

Vectren has always been known for being significantly coal-fired, but not for long.

The live smart company now has two solar farms and once they are finished they will have enough energy to power 300 homes annually.

It will also take Vectren to a 60 percent carbon deduction.

Former ITT Educational Execs To Pay $300,000 To Settle SEC Lawsuit

Former ITT Educational Services Inc. CEO Kevin Modany has agreed to pay $200,000 and accept a five-year ban from serving as an executive of a public company to settle a Securities and Exchange Commission lawsuit accusing management of hiding the rapidly eroding financial condition of the now-defunct firm from investors.

Former ITT Chief Financial Officer Daniel Fitzpatrick agreed to pay $100,000 and accept the same ban under a separate settlement. Under the deals, neither man admitted wrongdoing.

The settlements came just before a trial that was scheduled to begin Monday morning and was expected to last two weeks.

The amounts the men agreed to pay are modest in the context of the ferociousness of legal battle that has been playing out between the two sides since the SEC filed its suit three years ago. Both sides rang up legal costs that no doubt far exceeded the amounts of the settlements.

For example, in a recent squabble over whether six expert witnesses should be permitted to testify, attorneys for the SEC and executives submitted 2,000 pages of filings and exhibits.

In a statement, Stephanie Avakian, co-director of the SEC’s Division of Enforcement, said: “Holding individuals accountable—particularly senior executives—is a critical focus of our enforcement program. These settlements, entered into on the eve of trial after years of litigation, reflect our commitment to this accountability.”

Attorneys for Modany, 51, and Fitzpatrick, 58, told Reuters that their clients were pleased to put the case behind them.

The SEC’s 56-page suit charged the pair with concealing from investors the “extraordinary failure” of two off-balance-sheet student loan programs ITT helped set up in 2009 after the financial crisis shut down the market for traditional private education loans.

The complaint alleged that, as loan defaults mushroomed at the for-profit education company, the pair “routinely misled” the company’s auditor, PricewaterhouseCoopers, on numerous fronts—including by not sharing internal projections that showed even bigger problems brewing—an omission that “helped to further the defendants’ fraudulent scheme.”

But attorneys for Modany and Fitzpatrick scoffed at the allegations, calling them “overreaching” and often “based on pure speculation.” “The SEC’s pleading approach followed the commonly known tactic of throwing as much mud as possible against the wall in the hope that some sticks,” a filing said.

In particular, the pair says they relied on an army of advisers for guidance on how to handle a range of sensitive issues, such as whether it was permissible for the company to make minimum payments on students’ loans to prevent them from sliding into default.

The SEC alleged in its suit that minimum payments ITT made had the effect of masking the company’s deteriorating financial condition since it put off the need for the company to disclose that loans had gone bad and weren’t going to be repaid.

In a court filing, Modany and Fitzpatrick counter that both in-house and outside legal counsel reviewed ITT’s loan disclosures and earnings-call statements, without citing problems. Further, the men contend they were forthcoming with PricewaterhouseCoopers.

“Each quarter, PwC made ‘hundreds’ of requests for information from ITT, and in turn, ITT provided the requested information to PwC,” the filing says.

ITT dismissed its 8,000 employees and shut down its 130 ITT Technical Institutes in 38 states in September 2016—driven under by federal sanctions, including a prohibition against providing financial aid to new students. The government said it tightened the screws because it had “significant concerns about ITT’s administrative capacity, organizational integrity, financial viability and ability to serve students.”

In short, ITT was under unprecedented scrutiny over whether its expensive diplomas (a two-year associate’s degree ran about $45,000) were leaving students awash in debt while failing to properly prepare them for gainful employment.

Modany and Fitzpatrick appeared to have put the case to rest last year when they struck a settlement with SEC staff. But when the deal went before the SEC’s three commissioners, they turned it down, apparently concluding it was too lenient.

Because the deal wasn’t approved, terms weren’t disclosed. Since that rejection, the makeup of the commission has changed. It now has five members.

Modany still faces significant legal challenges. Last month, ITT’s bankruptcy trustee filed a $250 million lawsuit against Modany and eight of its former directors, charging that breaches of fiduciary duty and lapses in oversight led to the company’s demise.

The suit focuses on events from April 2016 to September of that year, when the company shut down. Fitzpatrick, who is not a defendant in that case, left ITT in July 2015.

Otters’ July Promotions Highlighted By German Heritage Night And Princess Night

The Evansville Otters will host eight scheduled home games in the month of July with promotions highlighted by German Heritage Night and Princess Night.
The Otters will begin the second half of their home schedule with a series against the Lake Erie Crushers July 17-19. Tuesday, July 17 will be a doubleheader to make up a postponed game from July 5 at Lake Erie.
The fun-filled promotional schedule for the month of July starts with a $2 Tuesday on July 17 at 5:05 p.m. against the Crushers. Fans can take in the doubleheader at Bosse Field with $2 General Admission tickets and $2 popcorn.
Wednesday, July 18 will be Deaconess and Orthopaedic Associates Night at the Otters.
The series finale on Thursday, July 19 will be German Heritage Night, featuring the Rhein Valley Brass Band, Germania Mannerchor Choir, Alpha Horns and specialty menu items including Kraut Balls. It is also a Thirsty Thursday presented by Working Distributors. Fans can come enjoy an ice, cold frosty one while they watch the Evansville Otters as drafts are at special prices at Bosse Field.
The homestand will continue with a three-game weekend series against the Windy City Thunderbolts July 20-22.
The series opener Friday, July 20 is Kyndle Night with the Otters welcoming the Kentucky Network for Development, Leadership and Engagement.
Saturday, July 21 will be Princess Night courtesy of Lil Bit Sassy and Junior Achievement of Southwestern Indiana. Some of your favorite princess characters will be in attendance. Kids are invited to wear princess costumes to join in on the fun. Kids can also participate in a costume contest and an on-field parade. There will also be a postgame firework show for fans to stay in their seats and enjoy after the game.
The Otters will conclude their series against the Thunderbolts Sunday, July 22 with Fellowship Day and a Family Fun Day. For Fellowship Day, local area church and youth groups are invited for an afternoon of Otters baseball at Bosse Field. Fellowship Day ticket special includes one G.A. ticket and food voucher per person. Participating groups must register for ticket special. Family Fun Day with the Otters allows families to take advantage of special package deal including four General Admission tickets, four popcorn, soda and snow cone vouchers, and two inflatable passes for $40.
Following a six-game road trip, the Otters return home Tuesday, July 31 to open a series against the Joliet Slammers.
The series opener against the Slammers is McDonald’s Night and another $2 Tuesday with $2 General Admission tickets and $2 popcorn.
The series will finish August 1-2 with Heart Services Night by Deaconess Hospital and special draft and beer prices for Thirsty Thursday.
