Anthem Sued By Doctors In Dispute Over Emergency Room Coverage

The health insurer Anthem Inc. was sued by doctors in Georgia for declining to pay for some emergency room care, escalating a long-running battle over how far insurance plans can go to push patients to seek lower-cost treatment.

The American College of Emergency Physicians and the Medical Association of Georgia filed suit Tuesday in the U.S. District Court in Atlanta against Anthem’s Blue Cross and Blue Shield of Georgia unit over the denied payments. The doctors asked the court to require Anthem to halt its policy and cover the claims.

“Providers and patients alike are operating in fear of denial of payment by defendants when patients seek emergency department care,” the groups said in the filing.

It’s the latest legal challenge over a change in policy that Indianapolis-based Anthem says was designed to cut down on patients going to an emergency room in situations that don’t require it. Emergency room care usually costs significantly more than treatment at a doctor’s office or an urgent-care clinic. Georgia’s Piedmont Hospital and five related facilities also have sued Anthem over the policy, the Atlanta Journal-Constitution reported in February.

Last summer, Anthem told its members in Indiana that starting October 1, it would deny claims for hundreds of non-emergency diagnosis codes, such as bruises, rashes, minor burns, swimmer’s ear and athlete’s foot. It said those kind of medical problems should be treated in a doctor’s office or an urgent care-center for a fraction of the cost.

But some Indiana physicians said they worried that patients might start to second-guess whether their middle-of-the-night chest pains were a heart attack or indigestion. They said patients should get such serious issues evaluated in an emergency room.

Before putting the policy in place, Anthem sent letters to customers explaining the policy and urging them to use other sites for care. The insurer also held meetings with physicians, according to the suit.

Anthem didn’t immediately respond to a request for comment on the suit.

Medical records

Anthem’s strategy went beyond what’s legally allowed, the doctors say in their lawsuit. The insurer reviewed the cases of patients who went to an emergency room and decided whether to pay for their care based on billing information or medical records related to the incident. The suit says Anthem violated legal requirements that insurers cover care in a situation where a “prudent layperson” would believe he or she was experiencing an emergency.

According to the suit, Anthem began reviewing emergency-room visits in Georgia, Kentucky and Missouri and expanded the policy to Ohio, New Hampshire and Indiana. Anthem operates under the Blue Cross and Blue Shield brand in 14 states. The company has almost 40 million health-insurance members.

Lawmakers including U.S. Sen. Claire McCaskill of Missouri have criticized Anthem’s policy. McCaskill and a fellow Democrat, Sen. Ben Cardin of Maryland, sent a letter in March to the Health and Human Services Department and Labor Department, asking them to investigate the payment denials.

“By denying patient claims based on the patient’s final diagnosis and ignoring the patient’s symptoms present at the time of the emergency, we believe that Anthem likely violated federal law,” the senators wrote.

INDIANAPOLIS – Here is a moment in today’s America.

I’m swimming laps at a community pool. It’s late afternoon on a hot day. The pavement on the pool deck burns the soles of people’s bare feet.

The pool is packed. The open swim area is shoulder-to-shoulder.

Each of the lap-swim lanes has at least two people in it.

In the lane next to me, two people – a man and a woman, both white, both 20 years younger than I am – do lazy laps. They wear sunglasses. Their heads never touch the water.

A guy a little older than I share the lane I’m in. He seems to know the couple in the next lane. He walks back and forth in the lane’s shallow end, talking with them as he does.

Often, he wanders into my path. Once, to get around him, I dive under the lane guide to swim past him underwater.

Neither he nor they seem to notice.

After a bit, the younger man hops out of the pool, leaving the woman by herself. She and the older man continue their conversation.

A heavyset African-American woman slips into the younger woman’s lane in the deep end. The black woman is older and has a tattoo. She works her way up the lane in a slow, determined dog paddle.

“Oh, great,” the young white woman mutters. “Why does she have to get in my lane?”

Minutes later, another swimmer – an Asian-American man who’s about 60 – hops into that lane and says he’d like to join them.

The white woman says he can’t.

They argue. The Asian-American man summons a lifeguard. The white woman swims away, sunglasses still in place.

I swim up. The Asian-American man and the African-American woman stand waist deep in the shallow water, fuming.

I tell them I only have one lap left to do and that one of them can take my spot. They thank me, but the Asian-American man is furious.

“People have to be nice and work with each other,” he says. “She can’t kick people out of the pool.”

I swim my last lap and climb out. The pool deck scalds the balls of my feet and my heels as I hop toward my towel and flip-flops.

The lifeguard summons two pool managers, both in their late teens. The Asian-American man wants the managers to affirm that he has a right to swim in the lane. The white woman says the lifeguards have done a horrible job policing the pool.

She points at the African-American woman, who has dog-paddled her way to the other end of the pool.

“Look,” the white woman says. “She can’t even swim. She doesn’t belong here.”

The white woman says she’s going to file a complaint about how the pool has been managed by the two teens.

The older man who shared the lane I was in has fled the scene. The lane now sits empty.

After more argument, the Asian-American man moves over to the empty lane. He begins a steady breaststroke.

The white woman gets out of the pool. The African-American woman continues her determined dog paddle.

I motion the pool managers over.

I suggest they ask their supervisors to post a rule saying swimmers must circle swim – go down on one side and come back on the other – when there are more than two people in a lane. That might keep lifeguards from having to practice poolside diplomacy.

The white woman sees us talking and charges over.

She doesn’t say excuse me or pardons me. She starts lecturing the two teenagers.

The issue, she says, is courtesy. The other swimmers should have asked her permission to swim in the lane.

She points at the Asian-American man swimming his breaststroke.

“He’s just rude,” she says. “He’s an a******.”

She again says she’s going to file a complaint.

“I didn’t come here to be stressed out,” she says.

She marches away.

The teens look at me. One asks me how everyone got so angry.

I shrug my shoulders. I don’t have a clue.

The late afternoon air is heavy with heat in a crowded little corner of my native land.

Just another moment in today’s America.

FIRST TIME IN EVANSVILLE- MIKE EPPS & The All Stars of Comedy

The All Stars of Comedy featuring Mike Epps will be live in concert at the Old National Events Plaza on Saturday, September 15 at 8:00 pm. Tickets are $69, $59, $49 and $39 and go on sale Friday, July 20.  This show contains mature subject matter.

Since 2000, Epps steadily climbed his way up the stand-up comedy ranks when he was recognized by a national audience in 1995 for appearing on HBO’s Def Comedy Jam (which, years later, he would go on to host). During a performance at LA’s Comedy Store, Epps caught the attention of Ice Cube. This led to the first of three feature films they would do together: the cult hits “Next Friday,” “Friday after Next,” and “All About the Benjamin’s.”

Mike Epps is generating an extraordinary amount of buzz among his peers for being not only one of the funniest comic actors in town but also for his burgeoning dramatic talent. On the Starz series “Survivor’s Remorse” produced LeBron James and Mike O’Malley Mike won a 2016 NAACP Image award for “Best Supporting Actor in a Comedy Series” for his portrayal as Uncle Julius.

Mike appeared in the indie comedy “The Trap,” directed by Chris Robinson, executively produced by Jesse Collins and co-starring Tip “T.I.” Harris. “The Trap” is based on a story that Epps created with Nile Evans, with Evans writing the script. The Trap tells of a man (T.I.) who returns home to Atlanta after an extended absence to help save his brother (Epps) and mother’s run-down restaurant. An unexpected change to the chicken recipe breathes new life into the restaurant but also brings unexpected problems.

He recently wrapped   Eli Roth’s remake of “Death Wish” for MGM/Paramount starring opposite Bruce Willis. Epps will play Dr. Chris Salgado, a playboy doctor and close friend of Willis’ character Paul Kersey. Kersey’s life has been destroyed by a violent crime against his wife and daughter. Frustrated that the bad guys for the crime were never brought to justice, Kersey starts hunting them down.

In 2017, Mike began production on The Weinstein Film “Pryor” starring opposite Oprah Winfrey, Eddie Murphy and Kate Hudson as the legendary comedian Richard Pryor. Written by Bill Condon, the film will bring to life the comedians groundbreaking accomplishments to the stand-up stage, TV, and films.

He was seen in the HBO-Emmy Winning biopic “Bessie” based on Bessie Smith, played by Queen Latifah. The film chronicles how Smith overcame her tempestuous personal life to become one of the most acclaimed performing and recording artists of the 1920s and ’30s, earning the nickname Empress of the Blues. Mike plays Richard Morgan, a bootlegger and romantic interest to Bessie Smith. The film also won a Critics Choice Award for “best miniseries/ movie” as well as a Primetime Emmy for “Television Movie or Limited Series.”

He is also currently developing the script “Any Means Necessary” for Sony pictures with Neal Moritz attached to produce. He will star opposite Marlon Wayans about two brothers- one a cop and one a criminal.

In 2011, he was awarded an NAACP Image Award for “Best Supporting Actor” for his role in the Sony Pictures film, “Jumping the Broom.” He continued to receive critical praise for his dramatic turn in 2012 with “Sparkle,” opposite Whitney Houston and Jordan Sparks. He further pursued his dramatic side with two important roles: starring opposite Forest Whitaker and Anthony Mackie in the Lionsgate thriller, “Repentance,” being released through Lionsgate/Codeblack Entertainment., followed by the independent Nina Simone biopic, “Nina,” starring Zoe Saldana. In “Nina,” he plays the legendary Richard Pryor, who opened for the singer in the early 60’s. In 2015 he produced and starred in the independent film “meet the Blacks.”

“Mike Epps: Underrated and Never Faded,” in 2011 introduced the world to new comedic talent with, “Mike Epps Presents…,” both which aired on Showtime. He also released his first comedy rap album called “Funny Bidness: Da Album.” The album featured Snoop Dogg, Kid Rock, and Slim Thug to name a few. That year also marked the release of his comedy DVD “Funny Bidness.” With his undying love for hip-hop, Mike hosted the BET Hip-Hop Awards from 2009-2012.

TROPICANA EVANSVILLE ANNOUNCES FUEL ON FIRE HEATS UP 421 LOUNGE

 The versatile band of brothers, Fuel On Fire, explodes onto stage at Tropicana Evansville’s 421 casino lounge this weekend, July 20-21, from 7 PM – 10:30 PM each evening.

They were known as a must-see band in Key West, Florida, when they shot a cover video of Coldplay’s “Houston #1” and raised funds for Hurricane Harvey relief for the ravaged Texas city.

But when Hurricane Irma threatened the idyllic Florida town they called home, Fuel On Fire evacuated their family and moved to Nashville where they had been making monthly commutes to write and produce songs with some of the industry’s biggest names.

Now they’re on tour promoting their six-song EP Think, released late last year.

The band performs their own creations like “What We Are” and “Never Said Goodbye,” while boosting their repertoire with music from groups such as Coldplay, Switchfoot and U2.  And you’ll see them free at 421 Lounge.  No admission fee, just a two-drink minimum.

 

Flawed allegations against Attorney General Curtis Hill addressed

This morning, Attorney Kevin Betz and Attorney Sandra Blevins addressed the accusations made against Indiana Attorney General Curtis Hill.

Ms. Blevins addressed the many flaws in the “investigation” memo produced by the members of the general assembly, including the following points:

  1. An independent entity or person did not conduct the “investigation,” instead the political leaders and their agents conducted the interviews.
  2. The same person did not interview each woman, so we know there was no consistency in the questions asked.
  3. We know that two months passed after the alleged incidents before anyone complained.
  4. Other potential corroborating or contradicting witnesses were not interviewed.
  5. Attorney General Hill was not interviewed or notified of the allegations until the “investigation” was concluded three months after the alleged incident(s).

Mr. Betz and Ms. Blevins went on to highlight the many inconsistencies between the “confidential” memo prepared for the political leaders and the statements that have subsequently been released by accusers, including the following points:

  1. The memo states that Attorney General Hill placed his hand under Rep. Reardon’s clothes on two occasions. She specifically denies this in her personal statement.
  2. The memo states that Attorney General Hill “groped [Ms. DaSilva] on the buttocks,” but Ms. DaSilva denies this in her personal statement.
  3. Legislative Employee C claims in the memo that she witnessed the alleged event with Rep. Reardon and then saw Attorney General Hill “engage in the same conduct with Rep. Reardon a second time,” when Rep. Reardon stated in her personal statement and in a subsequent interview that touching never occurred below the clothing and the conduct did not occur twice.

Mr. Betz further issued a request to the political leaders to reveal who leaked the memo to the media and who provided the information for the memo, and therefore likely fabricated the known false accusations that were put into the “investigatory” memo. These individuals are likely liable for defamation against Attorney General Hill. Mr. Betz also called for the memo to be corrected. Until that occurs, the memo should be removed from all areas it has been publicly disseminated.
