Mike Braun for Indiana released the following statement on Justice Anthony Kennedy’s announced retirement from the Supreme Court of the United States:
“I want to thank Justice Kennedy for his distinguished service to our nation and wish him well in his retirement,” said Mike Braun. “Given that it’s an election year, I expect Senator Donnelly to vote for President Trump’s nominee to distract from his liberal record of opposing tax reform, passing ObamaCare, and supporting Obama’s nuclear deal with Iran. Hoosiers won’t be fooled by Senator Donnelly’s election year pandering.”

Federal Judge Blocks Latest Indiana Abortion Law

A federal judge on Thursday blocked an Indiana abortion law that was set to take effect July 1 that would have required the reporting of complications arising from abortions to the state.

The decision was a victory for Planned Parenthood of Indiana and Kentucky, which with the American Civil Liberties Union of Indiana sued in federal district court in Evansville to block the new law.

“The court finds PINK has satisfied its burden to obtain a preliminary injunction of Indiana Senate Enrolled Act No. 340,” Indiana Southern District Judge Richard Young wrote in Planned Parenthood of Indiana and Kentucky, Inc. v. Commissioner, Indiana State Department of Health, et al., 1:18-cv-01219.

Young’s order preliminarily enjoins the Department of Health, the Indiana Medical Licensing Board, and the prosecutors of Marion, Lake, Monroe and Tippecanoe counties from enforcing the law.

The decision found the balance of harms and the public interest weighed in favor of an injunction blocking the law, and that PINK had shown it would suffer irreparable harm if an injunction were not issued. Young also found Planned Parenthood had shown a likelihood of success on its argument that the statute is void for vagueness. Because it reached that conclusion, the court did not express an opinion on PPINK’s due process and equal protection claims.

Stan Levco Calls Current Prosecutor Nick Hermann Incompetent

The not guilty verdicts in the Aleah Beckerle trial are a direct result of NickHermann’s incompetence. I don’t make this statement lightly.

I agree with the Evansville Police Department’s assessment that there’s no need for further investigation. The police did their job. The problem was the prosecutor did not do his job.

I’ve listened to the trial. The way Mr. Hermann tried this case and the way he selected-or more accurately-didn’t select the jury, proves he is incompetent.

When I first started examining this case, what immediately struck me was how quickly it was tried. A jury was selected, and opening statements were completed before lunch on the first day. I’ve tried over 30 murder cases and I’ve never had a case where a jury was selected and opening statements were given before noon on the first day.

When you examine the record of this trial, it seems like Mr. Hermann was more interested in getting it done quickly than getting it done right.

The State listed 32 possible witnesses for trial to prove their case. Only 5 were called by Mr. Hermann. I don’t recall ever trying a murder case with as few as 5 witnesses.

The State’s presentation of evidence only lasted about 4 hours. That is an exceptionally brief amount of time to present in such a serious case.

The clearest example of his ineffectiveness was in the second round of jury selection. Mr. Hermann did not ask a single question to any of the 6 jurors on the second round.

Jury selection is not only the first part of the trial, it may be the most important part of the trial. Competent trial attorneys know, “When you are picking a jury, the jury is picking an attorney.”

I was astounded to discover he did not ask a single question of any of the 6 jurors in the second round and then accepted all of them without question to be on the jury. In my career, I’ve chosen well over 1,000 jurors and I believe I’ve asked all of them at least one question.

I’ve taught jury selection to prosecutors nationally, to Indiana Prosecutors and as a Law Professor to law students in Bloomington. The concept of asking questions during jury selection is so fundamental that no competent attorney would fail to do so.

Before he became a prosecutor, the Indiana Court of Appeals in a written opinion found Nick Hermann to be ineffective. Seven and a half years later nothing had changed. He’s still ineffective.

Vanderburgh County deserves a Prosecutor who knows how to try a case.

Otters split afternoon doubleheader against Gateway

The Evansville Otters split a doubleheader with the Gateway Grizzlies on Wednesday, dropping the first game 2-1 before walking-off a 5-4 victory in the second game.
In the first game, pitching dominated for both sides, but it was the Grizzlies who prevailed in the 2-1 win.
Gateway got their only runs of the game in the fourth inning on a two-run single from Jeff Cardenas.
Evansville responded with a Jeff Gardner home run, his fifth of the year, to cut the lead to one, but that was as close as they would get.
Kevin Simmons came on and closed the game out in the seventh for the Grizzlies to claim the 2-1 win.
Randy Wynne was dealt the tough loss after tossing six innings and giving up just those two runs on three hits and striking out five.
Mike Elwood gets the win for the Grizzlies as he gave up just one run on five hits and picked up four strikeouts.
In the second game, the Otters rallied with two runs in the seventh to get their first walk-off win of the season.
Evansville grabbed a 1-0 lead in the third on a David Cronin RBI double.
The Otters then doubled their lead thanks to a Mike Rizzitello sacrifice fly in the fourth.
However, Gateway tied the game in the fifth with a runner at second and third, and a Toby Thomas fielding error allowed both runs to score and tie the game.
Evansville retook the lead in the bottom of the fifth on a solo home run from Manny Cruz, his first of the year.
Against Otters closer Mitchell Aker, Gateway scratched out two runs in the top of the seventh to claim a 4-3 lead. A passed ball allowed Shane Mardirosian to score from third and tie the game. Then, Jhonniel Alvarez hit a sacrifice fly to put the Grizzlies up 4-3.
But, Evansville struck back with two runs in the bottom of the seventh to win the game. Cronin was hit by a pitch to begin the inning, and on the ensuing bunt from Ryan Long was able to beat out a force play at second to put runner at first and second. Toby Thomas then laid down a bunt to advance both runners, but pitcher Josh Glick threw the ball away trying for the force out at third base which allowed Cronin to score and put Long at third with Thomas going to second. Gardner was then walked intentionally to load the bases which brought up Travis Harrison. Harrison came through in the clutch with an RBI single, giving the Otters the 5-4 win and their first walk-off victory of the season.
Spencer Medick’s first start as an Otter ends in a no-decision, but the southpaw threw five innings, giving up two unearned runs, while striking out six.
Alec Kisena also went five innings for the Grizzlies, allowing three runs on four hits in the no-decision.
Aker claims his first win of the year after blowing the save in the top of the seventh.
Glick is hung with the loss after allowing the two runs to score in the seventh without recording an out.
Thursday’s series finale is a Thirsty Thursday at Bosse Field with select drafts and beers at special prices. First pitch is scheduled for 6:35 p.m.
