IS IT TRUE that a late great professor from the University of Evansville once said, “come to the revolution all of this $%#! will cease? the obsession with fun and games spending is what has led the sheep to this unsustainable abyss?
IS IT TRUE we would like to thank Vanderburgh Chief Deputy County Prosecuting Attorney Gary Schutte for doing one heck of a job for the citizens of Vanderburgh County? Â …Vanderburgh County Prosecuting Attorney Nick Hermann should be very thankful that Mr. Schutte is around to watch his blind side?
IS IT TRUE we are told that several people are upset with the way that the Vanderburgh County Prosecutor Nick Hermann has awarded ABK, Inc. drug testing contracts? …we are told that Mr. Hermann doesn’t put the contract for drug testing out for competitive bidding? ..we are told one would be extremely surprised how much Mr. Hermann pays ABK, Inc. for drug testing each year? …we wonder if the owner of the company doing drug testing for the County Prosecutors office ever donated to Mr. Hermann past or present campaigns? …we’re told if Stan Levco beat Nick Hermann in the Vanderburgh County Prosecutor race he will put the contract for drug testing out for competitive bidding?
IS IT TRUE we are told that many people feel that its time that our elected officials pass an ordinance stating that if any individual or business who are wanting to do business with City or County government won’t be allowed to donate money to anyone running for elected office or who is an elected official?  …if this ordinance is adopted, it would help eliminate a conflict of interests or influence peddling?  …it wouldn’t hurt if they would also pass an ordinance stating that all bids over a certain dollar amount must be put for competitive bids?
IS IT TRUE when Vanderburgh County Prosecutor Nick Hermann received the political endorsement from the local Fraternal Order of Police Association 8 years ago over Stan Levco Mr. Hermann said: “it was awesome to be endorsed by the local FOP”?  …last month Stan Levco received the endorsement of the local Fraternal Order of Police for Vanderburgh County Prosecutor?  …we are told that the Vanderburgh County Prosecutor Nick Hermann now feels that FOP enforcement means nothing?
IS IT TRUE that the race between Joe Donnelly and Mike Braun is to close to call? …that our statistical guru predicts that the winning margin of this race could be decided by 200,000 votes or less? …he also predicts if the Libertarian candidate receives over 3 1/2 % of the popular vote then Joe Donnelly could be re-elected to the United States Senate by the slimmest of margins?
IS IT TRUEÂ we are wondering who is paying for the TV ads opposing the re-election of State Representative Wendy McNamara? …we feel that whoever placed these ads have wasted their money? Â …it’s obvious that they don’t want you to vote for Ms. McNamara? Â … they never say in the ad who they want you to vote for? …this TV is just downright dumb?
IS IT TRUE we are told that Steve Folz (D) is giving Wendy (Mac) McNamara (R) a run for her money? …we hear when Mr. Folz ask the question; “how can Representative McNamara be paid as a full-time administrator with EVSC but is allowed to go to Indy many times every month to conduct her Legislative duties” may be getting the attention of some of the voters?
IS IT TRUE we are told that several members of the Evansville Police Department are doing part-time doing security work at EVSC schools?  …we are told that want their hourly pay to be increased from $25 per hour to $30 an hour? …we are told that the Superintendent of Vanderburgh County Schools said “he will only increase their pay to $27 an hour”? …we can’t imagine why any responsible administer of a Metropolitan schools system would  jeopardize the safety of our children over a mere $5 dollar per hour raise for part-time public safety officers during times like this? …we hope that the newly elected EVSC School Board members will push to override Superintendent Smith’s ill-advised pay raise decision?

IS IT TRUE that the House of Representative of the United States has many doctors who have given up their life’s work to run for elected office and Southwest Indiana is not without an example of such an official?…Dr. Larry Bucshon was a respected doctor before turning in his medical practice to run for Congress?…the issue that opiate addiction is just the kind of problem that congressional doctors should be taking on?  …we would like to thank Congressman Bucshon for stepping up to finding ways to fight this national problem?

IS IT TRUE we are told by several movers and shakers in Vanderburgh County politics that Vanderburgh County Commissioner Ben Shoulders is considered to be a rising political star?  …we agree with their assessment of Mr. Shoulders political staus?  …all we can add to their comment is “shine on Mr. Shoulders”?
IS IT TRUEÂ that Matt Hostetter is running unopposed in the District 64 State Representative seat in tomorrow’s election? Â …although he has no opposition we urge you to give him a complimentary vote because we need a “true conservative” representing us at the Statehouse?

“There have been lots of people who have wanted to talk and who seem to be excited about getting out and voting,†says Edie Hardcastle, Indiana State Senate candidate District 49.
Hardcastle says it’s important to talk with people about why they should vote and why their vote is important.
“It’s really one of our last days of getting Out The Vote weekend and so what we’re doing really today is what we’ve been doing the last six months which is going out and knocking on doors and talking to voters about the issues,†says Hardcastle.
Hardcastle says talking with people face-to-face is an effective approach to get their message across.
“That’s why we make it such a big push the weekend before the election not only to make people aware the election is happening, but like if they have questions like where to vote or whose on the slate, if they need a ride to the polls, we can give them all that information,†says Hardcastle.
Meanwhile, at the Vanderburgh County Republican Headquarters, County Commissioner District 2 candidate Mike Duckworth says the weekend before election day is a culmination of 11 months work.
“In some of these races it could be very close, so picking up two or three or five votes here and there could be the difference,†says Mike Duckworth, County Commissioner District 2 candidate.
Campaign volunteers were also busy sending text messages, making calls, and putting up signs.
“They are indispensable,†says Hobart Scales, a campaign volunteer. “Campaign volunteers are the most important piece of any campaign and so having them here doing that work, that’s it. That’s everything.â€
Democrats and Republicans alike worked hard urging people who haven’t voted to make sure they do.
“We want folks to take a look at our qualifications and our experience and make their decision,†says Duckworth.
Monday is the last day to vote early. Vanderburgh County races will include Prosecutor, County Commissioner, State Senate District 49, and State Representative District 74 and 76.

They also met at the Four Freedom’s Monument to create signs for the “Love Not Hate Expressions Art Exhibit.†Through the voices of the future leaders of our community.
Nathan McCullough-Haddix stated “We decided rather quickly that we needed to take action, we needed to amplify these kids voices, and lead by love. Love in the face of adversity, love in the face of hate.â€
“The Love Not Hate Expressions Art Exhibit†will be on display from November 4 to December 31 at various organizations around the city.
Justices: Mineral-Rich Property Transfers improper In Trust Case

A bitter dispute between stepsiblings — including a woman who was written out of her inheritance of mineral-rich property — has resulted in the Indiana Supreme Court ruling that a decades-old transfer of the land to her stepbrother was improper.
“Sibling squabbles are commonplace and can be mild. But when disagreements arise over the property after parents’ deaths, rifts may become serious, with lengthy litigation separating family members. That is the case for stepsiblings Brenda Sue Gittings and William Deal,†Chief Justice Loretta Rush wrote at the opening of a 21-page Spencer County trust decision with potentially multi-million-dollar ramifications for the parties involved.
A unanimous Indiana Supreme Court ruled in Brenda Sue Gittings and Marc Richmond Gittings v. William H. Deal, 18S-TR-231, that transfers of mineral-rich land to William Deal in the 1990s were improper, and he is therefore not entitled to court approval of those transfers. The court also found his stepsister, Brenda Sue Gittings, and her son Marc Gettings’ claims were not tolled by fraudulent concealment, and that their claims are subject to statutes of limitations to the extent they seek affirmative relief, but not to the extent they diminish or defeat Deal’s request for declaratory relief.
The suit arises from trusts established by Brenda Gittings’ father, Nile Richmond, and Deal’s mother, Georgia Richmond, after they married in 1985. Each parent established trusts in their own names that mirrored each other. After Nile died in 1995, Georgia had Brenda sign deeds and assignments that purported to convey her one-half interest in the real property from her father’s trust in Georgia’s. But Georgia had not disclosed that she had removed Brenda, who since had become a mother to Marc, as an heir to her established trust.
After Georgia died, Brenda and William each received almost $91,000 apiece from the distribution of the remainder of Niles’ trust, and Marc received $22,710, but Brenda sued after she received no benefit from the property that by 2010 “began producing significant income — hundreds of thousands of dollars annually — from oil and gas leases,†Rush wrote.
While the justices affirmed the Spencer Circuit Court findings that fraudulent concealment had not tolled the statute of limitations, it found the Gittings’ claims are subject to statutory time limits to the extent that they seek affirmative relief, but not to the extent they function as defenses.
Further, Rush wrote for the unanimous court, “We agree with the trial court that (Nile’s) Trust Agreement and (Georgia’s) Trust Agreement did not create a single, implied trust and that Georgia’s amendment of (her) Trust Agreement — removing Brenda and Marc as beneficiaries — did not violate the terms of either trust agreement. But based on our de novo review of the trust terms and Indiana statutes, we disagree with the trial court that the transfers of property … were proper. So (Deal) is not entitled to court approval.â€
The Indiana Court of Appeals had previously affirmed the trial court, despite Judge Michael Barnes writing that the panel had “significant concerns†about the conduct of the trustees.
So did the justices, for whom Rush concluded, “Here, the transfer was not defensible on grounds of consent: Georgia had an adverse interest in the transaction, and Brenda lacked material information about her rights when she signed the deeds.
“In sum, the transfers of property … required court authorization and took place without all material facts disclosed to Brenda, a trustee, and beneficiary under (Nile’s) Trust Agreement. William is therefore not entitled to a court order approving those transfers.â€
The case is remanded to the courthouse in Rockport for proceedings.
