AG Curtis Hill reaches $120 million settlement with makers of hip implants over alleged misleading claims
Attorney General Curtis Hill announced today that he and 45 other attorneys general reached a $120 million consent judgment with Johnson & Johnson and DePuy to resolve allegations that DePuy unlawfully promoted its metal-on-metal hip implant devices, the ASR XL and the Pinnacle Ultamet.
The attorneys general allege that DePuy engaged in unfair and deceptive practices in its promotion of the ASR XL and Pinnacle Ultamet hip implant devices by overstating the longevity (also known as survivorship) of metal-on-metal hip implants. Some patients who required hip implant revision surgery to replace a failed ASR XL or Pinnacle Ultamet implant experienced persistent groin pain, allergic reactions and tissue necrosis – as well as a build-up of metal ions in the blood. The ASR XL was recalled from the market in 2010. DePuy discontinued its sale of the Pinnacle Ultamet in 2013.
“Products and services related to health care are among the most important consumer items purchased by Hoosiers,†Attorney General Hill said. “We will always put a high priority on holding accountable those involved in all aspects of the health-care industry. These entities must be honest and transparent in their marketing practices. Both doctors and patients need to be able to trust the information they receive from these providers of goods and services. The settlement announced today helps advance this cause.â€
As part of the consent judgment, DePuy has agreed to reform how it markets and promotes its hip implants. Under the consent judgment, DePuy shall:
- Base claims of survivorship, stability or dislocations on scientific information and the most recent dataset available from a registry for any DePuy hip implant device.
- Maintain a post market surveillance program and complaint handling program.
- Update and maintain internal product complaint handling operating procedures including training of complaint reviewers.
- Update and maintain processes and procedures to track and analyze product complaints that do not meet the definition of Medical Device Reportable Events.
- Maintain a quality assurance program that includes an audit procedure for tracking complaints regarding DePuy Products that do not rise to the level of a Medical Device Reportable Event but that may indicate a device-related serious injury or malfunction.
- Perform quarterly reviews of complaints and if a subgroup of patients is identified that has a higher incidence of adverse events than the full patient population.
Under the settlement, Indiana shall receive $3.5 million.
Indiana was one of eight states on the executive committee for this investigation, which was led by South Carolina and Texas.
Compton is Promoted to Sergeant at Evansville District
Indiana State Police Superintendent Douglas Carter has promoted Trooper Kylen Compton to the rank of Sergeant to serve as a District Squad Leader at the Evansville District.
Compton is a native of Griffin and a 1999 graduate of North Posey High School. He later attended Purdue University and graduated in 2003 after receiving a Bachelor’s Degree in Sociology.
Compton graduated from the Indiana State Police Recruit Academy in 2004 and was originally assigned to the Jasper District where he primarily patrolled Perry and Spencer Counties. He transferred to Evansville in July 2006 and primarily patrolled Gibson and Posey Counties. Compton is also a member of the Tactical Intervention Platoon, a Control Tactics Instructor, a Crash Reconstructionist and a Field Training Officer. Compton, a 14-year-vetern, will supervise troopers in Pike and Gibson Counties.
Sergeant Compton and his wife, Amy, reside in Posey County with their nine and seven-year-old sons.

Aces set for 2-game road trip to Iowa
Aces face Drake on Wednesday
Purple Aces head softball coach Mat Mundell has announced the 2019 schedule for the University of Evansville.
In just over two weeks, the season gets under way at the Total Control Sports Invitational in Rosemont, Ill. Set for Friday, February 8 through the 10th, the Aces will take on Purdue Fort Wayne, DePaul, Detroit, Butler and Green Bay. DePaul is the top squad in the tournament, coming off of a Big East Championship last season along with 34 wins and a berth in the Fayetteville Regional in the NCAA Tournament.
UE is finalizing its opponent for the second weekend of action, details will be announced as soon as they are available. On February 22, the Aces travel to Chattanooga, Tennessee for the Frost Classic. Participating squads include Creighton, Eastern Kentucky, Western Michigan, Ohio University and Chattanooga. Ohio U. won the Mid-American Conference Championship in 2018, going 40-17 and 20-3 in the MAC on their way to the Knoxville Regional, where they won two games. The Colonels of EKU picked up 45 wins last year and advanced to the postseason, taking part in the National Invitational Softball Championship (NISC). Creighton won 28 games and played DePaul in the Big East Championship game.
Next up for the Aces is the Samford Tournament in Birmingham, Alabama. Set for March 1-3, UE will face Western Kentucky, Houston Baptist, Samford and Jackson State.
Home play commences on Wednesday, March 6 when the Aces welcome Purdue Fort Wayne to Cooper Stadium for a 5 p.m. game. UE heads back on the road from March 9-11 at the East Tennessee State Tournament in Johnson City, Tenn. Tennessee Tech, Rutgers, Siena and East Tennessee State will be playing in the event. On March 13, UE will play a road contest at Tennessee Tech on their way back to Evansville.
That is the final non-conference tune-up before Missouri Valley Conference play begins. The Aces open up the league slate on March 16 at home against Illinois State. After opening MVC action, the Aces take on UT Martin inside Cooper Stadium on March 20 for a doubleheader. An 8-game homestand continues on the weekend of March 23 with three games against Loyola before a single game against Butler on the 26th.
After the long streak at home, the Aces take to the road for their next six games, beginning with three games at UNI on March 30-31. The month of April begins in Carbondale with three games at Southern Illinois on April 6-7. On Wednesday, April 10, the Aces return home for a doubleheader against travel partner Indiana State before welcoming Bradley on the 13th and 14th.
Seven of the final ten games will take place on the road, starting with a trip to Springfield, Mo. to face Missouri State on April 19-20. The Bears won 32 games last year and were 17-8 in the Valley. Following a single game against the Sycamores on April 24, UE wraps up the home schedule with a 3-game series against Valparaiso on April 27-28.
The final weekend of the season will see the Aces travel to Des Moines to take on defending league champion Drake. The Bulldogs were 45-11 overall and 24-1 in the conference in 2018 on their way to a berth in the NCAA Tournament where they played in the Eugene, Oregon Regional. The MVC Championship is set for May 9-11 in Peoria, Illinois.
Eagles return to PAC to face Missouri S&T, No. 2 Drury
University of Southern Indiana Women’s Basketball returns to the Physical Activities Center this week to host Missouri University of Science & Technology Thursday at 5:30 p.m. and No. 2 Drury University Saturday at 1 p.m.
Saturday’s game against Drury is USI’s seventh-annual Hoops for Troops game to honor members, past and present, of the United States Armed Forces. Veterans, military personnel and their guests will receive free tickets to the USI-Drury men’s and women’s basketball doubleheader with their military identification or proof of service at the front of the PAC. Hoops for the Troops is sponsored by American Legion Post 324 and the USI Student Veterans Association

The Screaming Eagles (13-4, 6-1 GLVC) are coming off their second GLVC road sweep in the last three weeks and have won three straight games after wins at Rockhurst University and William Jewell College last week.
Senior guard Alex Davidson (Salem, Indiana) is averaging 13.8 points, 5.4 rebounds and 3.6 assists per game to lead the Eagles this year, while senior center Kacy Eschweiler (St. Charles, Missouri) is chipping in 10.9 points and a team-high 7.4 rebounds per appearance.
USI also is getting 10.9 points and 5.7 rebounds from sophomore forward Imani Guy (Columbus, Indiana), while sophomore guard Emma DeHart (Indianapolis, Indiana) is contributing 10.3 points per contest. Junior guard Ashley Johnson (Louisville, Kentucky) is close to double-figures, with 9.5 points and 3.5 assists per outing.
Saturday’s game against Drury could have major GLVC Tournament implications as the Panthers and Eagles are ranked first and second, respectively, in the league standings as well as the GLVC Points Rating System.
