Unplanned Opens in Evansville

Unplanned is the most important movie you will ever see on the most controversial issue of our time–Abortion.  No matter which side of the fence you are on, no one will leave this film unmoved.

Right to Life of Southwest Indiana will host a premiere of the movie Unplanned on Thursday, March 28, 7 p.m. at Showplace East Cinemas in Evansville, Indiana.  In addition to this showing, Unplanned will be shown at 7:30 p.m., and 10:10 p.m.  on Thursday evening at Showplace East.  Contact the theatre for tickets, and other showings as Unplanned opens nationwide on Friday, March 29.

Unplanned is the inspiring true story of one woman’s journey of transformation.  All Abby Johnson ever wanted to do was help women.  As one of the youngest Planned Parenthood clinic directors in the nation, she was involved in more than 22,000 abortions and counseled countless women about their reproductive choices.  Her passion surrounding a woman’s right to choose even led her to become a spokesperson for Planned Parenthood, where she fought to enact legislation for the cause she so deeply believed in.

Unplanned received a controversial “R” rating from the MPAA even though the movie contains no gun violence or profanity.  Critics of the “R” rating have said that it is ironic that a young girl can get an abortion without her parents’ consent in many states, but can’t see a movie about it.

Judgment against casino as discovery sanction affirmed

mary judgment against a casino as a sanction for dragging its feet on discovery in an elderly man’s negligence complaint filed after a fall, the Indiana Court of Appeals affirmed and sent the case back to determine the man’s damages.

Joseph Ferrantelli Sr. was 86 in March 2016 when he and a “lady friend” heard about a “crab leg deal” and wanted to “gamble a little bit,” so they went to the Ameristar Casino in East Chicago. Ferrantelli said he asked an attendant where he could get a wheelchair, and after he was given one, an attendant told him to take the escalator. His chair fell backward, causing him to be injured, and he filed a negligence lawsuit.

But after multiple lingering discovery disputes as Ameristar failed to produce witnesses for depositions or documents pertaining to Ferrantelli’s case, Lake Superior Judge Bruce D. Parent entered default judgment against the casino parties as a sanction. Parent also denied a motion to set aside the default judgment, leading to this appeal.

The Indiana Court of Appeals, however, found no abuse of discretion by the trial court, upholding its rulings in a case that judge Terry Crone wrote “illustrates the dangers of noncompliance with our liberal and self-effectuating discovery process.

“To be clear, the entry of a default judgment is the ultimate sanction. Still, we must be mindful that ‘[t]rial judges stand much closer than an appellate court to the currents of litigation pending before them, and they have a correspondingly better sense of which sanctions will adequately protect the litigants in any given case[.]’ Wright v. Miller, 989 N.E.2d 324, 327 (Ind. 2013).

“It is not the place of this Court to substitute our judgment for that of the trial court, as we must presume the trial court acted in accord with what was fair and equitable in the specific case. … The trial court here made a detailed oral record explaining its frustration with Ameristar’s behavior, as well as its prior warnings to counsel to stop what the court viewed as the intentional sandbagging of the case considering the plaintiff’s advanced age. We conclude that the trial court did not abuse its discretion in determining that the sanction of default judgment was warranted. Moreover, the trial court was well within its discretion to reject Ameristar’s equitable demands for the court to set aside the default judgment pursuant to Trial Rule 60(B)(8).7 Therefore, we affirm the trial court’s orders and remand for further proceedings on the issue of damages.”

The case is Ameristar Casino East Chicago, LLC, Ameristar East Chicago Holdings, LLC, and Pinnacle Entertainment, Inc. v. Joseph Ferrantelli, Sr.,  18A-CT-1174.

State Budget Director Dudich to Depart

INDIANAPOLIS – Gov. Eric J. Holcomb today announced that State Budget Director Jason Dudich will leave his post in May to serve as the vice president, chief financial officer, and treasurer of the University of Indianapolis.

 

“Jason is an enthusiastic problem-solver who has served the state with great skill and integrity,” Gov. Holcomb said. “I wish him continued success in his new role at the University of Indianapolis and thank him for helping us take Indiana to the next level.”

 

Dudich has served as the state budget director since 2017 after being appointed by Gov. Holcomb. During his tenure, Dudich developed, presented and managed one balanced budget and is diligently worked on a second. He has helped manage the fiscal operations of the state ensuring integrity as well as maintaining strong reserves and the state’s AAA credit rating.

 

“I want thank Gov. Holcomb for giving me the opportunity to serve in his administration. I am proud that the State Budget Agency is in a position that the next director will have a strong team in place,” Dudich said. “I am confident that the relationship we’ve built between the budget agency and the state agencies will continue into the future and ensure collaboration to meet the needs of Hoosiers.”

 

Dudich will continue in his current role through the conclusion of the legislative session and depart the administration in mid-May. Gov. Holcomb will appoint a replacement in the near future.

7 DAYS vs 45 MINUTES

Both the Quran and the Bible claim the World was created in 6 days by a God who even took a final day to rest up. I am okay with this explanation. It is simple, understandable and interesting. It certainly beats all the hours needed by me in an attempt to dimly comprehend the physics, chemistry and biology behind evolution. However, this is not a column about the age-old discussion about science versus religion. No, this is a plea to the sadists who write the directions that accompany Do-It-Yourself home improvement projects such as installing a ceiling fan.

If God needed only 6 days to create the World, it is pretty obvious to me He did not have to decipher some instruction manual written originally in Chinese then translated into what resembles English. God had the advantage of proceeding unencumbered by misleading photographs of parts and diabolical descriptions of which part goes where. My assumption is Satan was still in God’s good graces when the World was created or he had already been cast out of heaven before God decided to amuse Himself with Adam and Eve. Apparently Satan did not attempt to confuse God with some phony How-To book on Creation as did the fiends who wrote the instructions for installing the ceiling fan Peg demanded I put up last weekend.

Let me first point out the light Peg told me to replace had been put in by me only 10 years earlier. I had no trouble unscrewing the old one and connecting the black wire to the black, the white wire to the white and the green ground wire. After all, I have had about 20 years of formal education and labored at numerous jobs that required I follow instructions, being a husband for instance. If things are simple, I am your man.

But when I opened the 39 page instruction manual for the “Impreso en China” (made in China?) ceiling fan and light I had the same sinking feeling I experienced when I sat for the Bar Exam. It did not help that the portion written in Spanish made as much sense to me as the part in English.

The most nefarious part of this guide into the depths of the “simple” procedure was the statement on page 5: “ESTIMATED ASSEMBLY TIME – 45 MINUTES”. Yes, this was all in capital letters and in bold type. I could sense the glee of the group of nasty nerds when they wrote this great Creation Myth. God would have just thrown up His hands had these sadistic purveyors of obfuscation been around to “help” Him develop the World.

Gentryville, IN. – Jean (Sisk) Bender, 74, of Gentryville, Indiana passed away on Thursday, March 7, 2019, at her home.

Jean was born in Nortonville, Kentucky on June 17, 1944, to the late Robert and Hallie (Jones) Sisk.
Jean was a hard worker and retired from Spencer Industries after 19 years of service. She was a devoted wife, mother, and grandmother. She touched many lives and will be dearly missed. Jean attended Mt. Olive United Methodist Church in Gentryville.
Jean is survived by her husband of 56 years, Clyde J. Bender of Gentryville, IN; children, Denise Gasaway and her husband, Jeff of Tennyson, IN; Clyde Allen Bender and his wife, Sheila of Evansville, IN; grandchildren, Andrea and Ryan Bender of Evansville, IN; Caitlynn and Bradley Gasaway of Tennyson, IN; siblings, Ruth Ann Jones and her husband, Art of Arkansas; David Quinn (Melinda); Carol Quinn; several nieces, nephews, and cousins.
Services will be 10 A.M. on Monday, March 11, 2019, at Koehler Funeral Home with Pastor Charlotte Lee officiating. Burial will be at Bender Cemetery in Gentryville, Indiana.
Visitation will be 2 P.M. until 6 P.M. on Sunday, March 10, 2019, at the funeral home and again from 9 A.M. until the time of service on Monday.
Memorial contributions may be made to the Spencer County Hospice.

Mary Eliza Long, age 87, passed away Thursday, February 28, 2019, at Deaconess Hospital in Evansville, Indiana. Mary was born in Henderson, Kentucky on May 5, 1931, a daughter of the late Hestoria and Gordie Brown. Mary worked at Green River Valley for over thirty years before retiring. She enjoyed being an active participant in a church where she played many roles and loved working outdoors.

Mary was a faithful servant at Seventh Street Baptist Church in Henderson. She was preceded in death by her husband, Frank Long; her sister, Dorothy McFarland; her brother, John Richard Brown; her granddaughter, Mary Chalonda Woodruff; and her grandsons: Jason Woodruff and Chalon Woodruff.

Mary leaves to cherish her life, one son, James Richard Woodruff who resides in their childhood home; beloved grandchildren: Jamie Evonne Woodruff of Olathe KS, Tabrisha Ruby of Tampa FL, James D. Hay of Henderson KY; 8 great-grandchildren; and a host of nieces, cousins, friends.

Services are Friday, March 15, 2019, at 12:00 noon at 7th Street Missionary Baptist Church in Henderson with same day visitation from 10:00 am until service time at the church. Evansville Man Arrested for Dealing Synthetic Marijuana

Vanderburgh County: Indiana State Police obtained an arrest warrant yesterday for Jerome Lee, 36, of Evansville, for Dealing in Synthetic Marijuana, a Class 6 Felony. Lee’s arrest stems from a criminal investigation conducted by Indiana State Police and Indiana State Parole Agents that netted 14 lbs. of synthetic marijuana and a stolen firearm on February 21.

Lee is being held in the Vanderburgh County Jail on the following criminal charges:

  1. Dealing in Synthetic Marijuana, Class 6 Felony
  2. Possession of a Firearm by a Serious Violent Felony, Class 4 Felony
