Unauthenticated cell records lead to reversal of robbery-related conviction

onvicted of aiding a robbery after the Indiana Court of Appeals reversed her conviction, finding the state failed to properly authenticate cellphone records it said tied the woman to the crime.

In Jaqueline B. Walters v. State of Indiana, 18A-CR-1021, Jaqueline Walters was charged with Level 3 felony aiding, inducing or causing an armed robbery after the phone number she shared with her boyfriend, known as 6065 Phone, was tied to a 2015 robbery of the Morgantown IGA where Walters worked. Records from Verizon listed messages between 6065 Phone and John Nocito, a friend of Walters’ boyfriend, discussing a plan to rob the IGA. Walters was present during the robbery.

After Walters’ initial trial resulted in a hung jury, the state scheduled a retrial and requested an evidentiary hearing to have the text messages “deemed statements of coconspirators so the statements would not be hearsay.” The state wanted the Morgan Superior Court to take judicial notice of the cellphone records, which had been presented during the trial against Nocito and Walters’ boyfriend.

The trial court agreed to take judicial notice over Walters’ objection, and the state supported its conspiracy theory by presenting messages saying Nocito intended to work with “Jackie” to carry out the robbery and that Walters could provide information about the best time of day to rob the store. The state also presented an affidavit of certification from Verizon that was dated Feb. 27, 2017.

Walters objected to the admission of the phone records, arguing they were not self-authenticating and noting the certification did not list what phone number it applied to or what warrant it was responding to. But the trial court determined there was a certification from a business records custodian and, thus, admitted the cell records.

A jury then found Walters guilty, but the Indiana Court of Appeals overturned her conviction Friday. Judge Melissa May, writing for a unanimous appellate panel, noted the certification was issued roughly 18 months after the records were obtained and did not list the applicable phone number or dates of the records.

Without that information, the appellate panel said the certificate of authenticity “lacks indicia of reliability.”

“We cannot say the State provided proper authentication of these records to breach the threshold question of admissibility,” May wrote, citing to Speybroeck v. State, 875 N.E.2d 813 (Ind. Ct. App. 2007), reh’g denied. “Without authentication, we do not reach the question of whether the statements made therein were admissible as coconspirator statements. The trial court abused its discretion when it admitted the evidence of the phone records for 6065 Phone without proper authentication.”

Further, without the phone records, the appellate panel determined there was not enough evidence to sustain the state’s case against Walters. Thus, her conviction was reversed, but with leeway for the trial court to retry her.

“While ‘double jeopardy forbids a retrial … if the reviewing court concludes that the evidence is legally insufficient to support the conviction[,]’ if the State were able to authenticate the phone records for 6065 Phone, the jury could have found Walters had conspired with Nocito,” May wrote. “Therefore, the Double Jeopardy Clause does not preclude a retrial.”

Obituary For Antonio Dwayne Frazer

Antonio Dwayne Frazer, nicknamed “Tony,” passed away March 14, 2019, at the age of 58 at ContinueCare Hospital of Baptist Health Madisonville.

Tony was born October 23, 1960, in Madisonville, Kentucky to Samuel Edward Frazer, Jr. and Loretta Carney Frazer. He attended school in Gary, Indiana. After returning to Madisonville, he attended Christ Church Holiness. Tony was a people person and loved his music. He was a friendly person and was well-liked by many.

Tony was preceded in death by his father and mother, Sam and Loretta; his son, Shawn Antonio Baxter; and his grandparents: Samuel Frazer and Sadie Scisney.

Left to mourn his loss are his wife, Mary Frazer; his grandson, Jeremiah Baxter; his sisters: Debra Frazer and Karen Maypray; and four brothers: Derrick (Antoinette) Frazer, Samuel Frazer III, Anthony Frazer, and Tim Maypray; and a host of uncles, aunts, and cousins.

Hoosiers Qualify Four For Final Night Of NCAA Championships

 AUSTIN, Texas – The No. 17-ranked Indiana University women’s swimming and diving team continued competition at the 2018 NCAA Championships on Saturday morning at the Lee and Joe Jamail Texas Swimming Center in Austin, Texas.

The Hoosiers qualified four swimmers and divers for finals on Saturday night, including three in Championship Finals. Along with the four finalists, IU will also have three swimmers in the timed heats of the 1,650 freestyle on Saturday afternoon.

Heading into the final night of competition on Saturday, the Hoosiers sit in 10th place overall with a total score of 122 points.

200 Breaststroke

Three-time defending NCAA Champion Lilly King headlines three Hoosiers who qualified for finals in the 200 breaststrokes. King will be the top seed in the Championship Final after posting a time of 2:05.60. She will be joined by freshman Noelle Peplowski, who earned the No. 6 seed after touching the wall with a personal-best time of 2:07.72.

Senior Laura Morley qualified for her first final in her career at the NCAA Championships, taking 12th in the prelims to earn a spot in the Consolation Final with a time of 2:08.60.

400 Freestyle Relay

The Hoosier 400 freestyle relay team of Morgan Scott, Shelby Koontz, Bailey Anderson, and Christine Jensen placed 21st overall with a time of 3:15.97.

Platform Dive

Jessica Parratto, the 2015 NCAA Champion and four-time Big Ten Champion in the event, qualified fourth overall for the Championship Final of the platform dive on Saturday night.

The redshirt senior scored a 316.40 to earn her spot – a list that included three dives scoring over 62.40 points. Parratto posted a 76.80 in the fourth round to help secure her spot in the A Final.

The 2019 NCAA Championships will conclude on Saturday evening with the finals of the 200 backstroke, 100 freestyle, 200 breaststrokes, 200 butterflies, 400 freestyle relay, platform dive and 1,650 freestyle. The action gets underway at the Lee and Joe Jamail Texas Swimming Center at 6:00 p.m. ET.

EVANSVILLE, Ind. – University of Southern Indiana Baseball used a six-run fourth to blow by William Jewell College, 10-2, Saturday afternoon at the USI Baseball Field. The Screaming Eagles move their record to 15-8 overall and 8-3 in the GLVC, while the Cardinals go to 9-15-1, 3-8 GLVC.

The Eagles erased a 2-0 deficit with the six-run fourth inning on three hits, taking advantage of pair of walks and a pair hit batters in the frame. USI junior third baseman Kobe Stephens (Dale, Indiana) had the big hit in the rally with ta wo-run single through the left side.

The Cardinals had built the early two lead over the Eagles with a single tally in the second and third frames.

USI extended the margin to 9-2 in the top of the seventh when it put a three-spot on the scoreboard. Junior catcher Wyatt Daly (Newburgh, Indiana) capped off the three-run rally with a two-run single to seal the victory for the Eagles.

The Eagles would finish off the scoring in the eighth when senior first baseman Nathan Kuester (Rockport, Indiana) smacked an RBI-single for the 10-2 final.

At the plate in the victory, Daly finished with a team-high three RBIs, while senior second baseman Jacob Fleming (Evansville, Indiana) and Stephens followed with two RBIs each. Stephens also had a team-best three hits in four at-bats.

USI senior right-hander Austin Gossmann (Avon, Indiana) went the distance for the Eagles to get his team-best fourth win of the season. Gossman (4-0) allowed two runs on eight hits and a walk in addition to striking out two in eight innings of work.

Senior right-hander Dalton Lewis (Parker, Colorado) pitched the ninth for the Eagles, loading the bases on a pair of hits and a hit batter, before starting a one-two-three double-play to end the game.

Up Next for the Eagles: 
The Eagles hit the road Tuesday when they vvisitBellarmine for a single game at 1 p.m. (CDT) in Louisville, Kentucky. USI and Bellarmine split a doubleheader last week with the Eagles falling, 13-4, in the opener and winning, 11-6, in the nightcap.

The all-time series leans toward USI with the Eagles leading, 82-75.

ST. LOUIS—University of Southern Indiana Softball blanked host Maryville University twice to sweep a Great Lakes Valley Conference doubleheader Saturday afternoon.

The Screaming Eagles (18-12, 6-2 GLVC) defeated the Saints, 2-0, in the opener before edging Maryville, 1-0, in the nightcap.

Senior second baseman Claire Johnson (Pittsboro, Indiana) hit a two-run double in the top of the third inning to break a scoreless tie and give junior pitcher Jennifer Leonhardt (Louisville, Kentucky) all the support she would need to earn her 11th win of the year.

A leadoff walk to freshman catcher Courtney Schoolcraft (Crest Hill, Illinois) and a single by junior shortstop Taylor Ricketts (Georgetown, Kentucky) set up Johnson for the two-run double.

Leonhardt (11-4) allowed just three hits and two walks, striking out six batters, as she earned her fourth complete-game shutout in her last five starts.

Game 2: USI 1, Maryville 0
USI broke a scoreless tie in the top of the fourth inning as a one-out double by sophomore outfielder Alicia Webb (Elberfeld, Indiana) followed by an RBI-single by Leonhardt put the Eagles up, 1-0.

Senior pitcher Haylee Smith (Florence, Kentucky) kept the Saints off the scoreboard as she earned the win. Smith (2-1) scattered six hits throughout five-and-a-third innings of work, striking out three in the process, before giving way to Leonhardt, who earned her second save of the year.

Leonhardt entered the circle in the sixth inning as Maryville had runners at second and third with one out. She induced back-to-back fly balls to get the Eagles out of the inning unscathed; then pitched a scoreless seventh inning to secure the win.

Eagles route Cardinals in doubleheader sweep

University of Southern Indiana Baseball scored 29 runs in two games to sweep a doubleheader from William Jewell College, 18-5 and 11-4, Friday afternoon at the USI Baseball Field. The Screaming Eagles move their record to 14-8 overall and 7-3 in the GLVC, while the Cardinals go to 9-14-1, 3-7 GLVC.

Game One: 
USI scored seven times in the first two frames and cruised to an 18-5 victory in the opening game of the doubleheader. The Eagles scored four in the first; three in the third; one in the fourth, fifth, and sixth; and eight in the eighth in a run-ruled game.

Eagles’ junior rightfielder Manny Lopez (Santo Domingo, D.R.) led the way at the plate for USI with a four hit game, scoring three times, driving in five RBIs, and hitting a pair of home runs. Lopez’s two-run blast highlighted the eight-run eighth inning.

On the mound, senior right-hander Austin Krizan (Mt. Vernon, Indiana) picked up his third victory of the year. Krizan (3-0) allowed five runs, two earned, on 10 hits and two walks, while striking out six in seven innings of work.

Game Two: 
The Eagles completed the doubleheader sweep with a convincing 11-4 victory. USI took command with three runs in the first three frames and sealed the win with a six-run fifth inning.

USI senior right-hander Chase Partain (Evansville, Indiana) tied senior right-hander Austin Krizan for the team-lead with his third victory of the season. Partain (3-2) allowed two runs on seven hits and struck out one in six innings on the bump.

Following Partain to the mound was junior right-hander Pete Wissel (New Castle, Indiana), who picked his first save after three innings of work. Wissel allowed two runs on five hits and one walk, while striking two.

Eagles’ sophomore centerfielder Bryce Krizan (Mt. Vernon, Indiana) headed the USI offensive attack with three hits, a run, and a RBI. Sophomore leftfielder Aaron Euler (Evansville, Indiana) also had three hits and a pair of RBIs in the victory.
