What amazes me as a guy who ran from the outside to shake the system up is how often that dynamic is still in place here. Ever since Donald Trump was elected President they’ve been trying to impeach him, and all I can tell you is all the things he’s accomplished since he’s been there get no credit.

The Democrats’ platform is free college, Medicare-for-All, the Green New Deal, forgive all college debt, and by the way, let’s get rid of the electoral college: it’s embarrassing.

We know they hate the idea of an outsider for President, but from day one they’ve been trying to get him and what’s amazing to me is that they do the official impeachment inquiry even before the information comes out, all based on a hearsay whistleblower report that was a big nothing-burger.

What surprised me most was that the hearsay whistleblower report hadn’t even hit the pavement before they started the impeachment inquiry.

From day one, they could not get over the fact that an outsider entrepreneur got through to become President, kind of like what I did when I ran the gauntlet to become senator, and they’ll never get over it.

When they play their card so far in advance of whatever it is they’re talking about, it looks foolish. This one fell with a thud even more than what they’ve done before and I think it’s really going to drill into the minds of voters who are still making up their minds.

Why are they doing this? They’re doing it because they’ve tried to do it from the get-go to distract from a platform that looks like it could do them in on its own.

Reversal: Appeals Court Strips Charter Schools Of $8.5M Tuition Judgment

Several Indiana charter schools couldn’t convince an Indiana Court of Appeals panel that they are entitled to a semester’s worth of tuition support funding, as a trial court had ruled.

Indiana Connections Academy Inc. and various other state charter schools sued the state of Indiana, seeking to recover tuition support they alleged the state failed to pay for the public education supplied to students enrolled during the 2012-13 school year.

The Marion Superior Court had previously granted summary judgment in favor of the charter schools, ordering the state to pay a total of more than $8.5 million in tuition support to Indiana Connections Academy, Andrew J. Brown Charter School and Aspire Charter Academy, as well as Rural Community Schools and National Heritage Academies.

On appeal, the state alleged the pre-2013 statutory scheme meant that charter schools were wholly unfunded for the first semester they are open. Instead of the tuition support funds covering the first semester, they would be real-time payments. But the charter schools argued that the system created a six-month funding lag.

The Indiana Court of Appeals agreed with the state that there was no statutory authority suggesting that the funding lag existed. It also agreed that the trial court’s determination that the charter schools were entitled to receive the funds was a fundamental misunderstanding of the prior funding formula. The appellate court then pointed out that a six-month funding lag would not fit into Indiana’s budgeting process.

“Because there was no so-called funding lag, it is apparent that the Charter Schools received tuition support funding on a real-time basis,” Judge John Baker wrote for the panel. “The DOE distributed those funds continuously throughout the transitional period. Therefore, the evidence undisputedly shows that they have received all funds to which they are entitled.”

The appellate court also found that the General Assembly never made a suggested policy change that the legislature provides funding for a charter school’s first semester of operations.

“But regardless of whether the process and result are fair or unfair, it is solidly within the wheelhouse of the legislature to create a statewide budget and to decide how to fund charter schools, which are a creation of the General Assembly, to begin with,” the panel wrote. “The General Assembly has the discretion to decide how to allocate State funds.

“In sum, while the Charter Schools may argue that it is a bad public policy for the legislature to have decided that charter schools should not be funded for their first semester of operation, that does not change the language of the relevant public law, which does not provide for the so-called funding lag. There is no statute providing that the tuition payments beginning in January paid for public education provided the previous fall,” it concluded.

In the last note, the appellate court observed that even if charter schools had to be self-funded for their first semester or had to close their doors as a result, Hoosier children “were always going to be able to obtain a tuition-free education at traditional public schools.”

It, therefore, concluded that it was within the purview of the Legislature to structure its budgets, and nothing in the case at hand suggested that it exceeded its discretion. The trial court thus erred by determining that the charter schools were entitled to a semester’s worth of tuition support, the appellate court held.

The case of State of Indiana; Indiana Department of Education; Eric Holcomb, in his official capacity as Governor of Indiana; et al. v. Indiana Connections Academy, Inc.; Rural Community Schools; et al., 18A-PL-2634, was thus reversed and remanded with instructions to enter judgment in the state’s favor.

The Vanderburgh County Sheriff’s Office has arrested Caroline Marie Rich on additional charges stemming from a fraud and theft investigation into her activities as a family services counselor at Alexander Funeral Homes.

A news conference is scheduled for Friday, September 27, 2019, at 10:30 AM. The news conference will be held at Sheriff’s Office Headquarters, 3500 N. Harlan Ave.

Additional details concerning the investigation and arrest will be released at the news conference and in a subsequent news release.

Volleyball opens MVC schedule in Iowa

Aces set for three matches in four days

  Sitting at 9-2, the University of Evansville volleyball team sits atop the Missouri Valley Conference entering the opening week of league play

– The Aces open up on Friday at UNI before heading to Drake Saturday and hosting Illinois State on Monday

Weekend Recap

– Evansville went 3-0 in its second-consecutive tournament en route to another championship

– The Aces swept the Skyhawk Invitational with a 3-1 win over UT Martin, a 3-0 triumph over Little Rock and a hard-fought 3-1 decision against Mercer

– Rachel Tam was named the MVP of the tournament while Melanie Feliciano and Allana McInnis were on the All-Tournament Team

– Evansville opened the week with a 3-2 home victory over Tennessee Tech where Tam set the school record with 39 kills; her tally is second all-time in conference history

Top of the Valley

– With 13.35 assists and 14.30 kills per set, Evansville leads the MVC; those numbers put UE 16th in the nation in both stats

– Evansville ranks third in the league in digs (16.93/set) and hitting percentage (.213)

– On the individual side, Allana McInnis continues to pace the conference with 11.09 assists

– Hannah Watkins remains second in the Valley with 1.12 blocks per set while Gabriela Macedo is second in the league in digs (4.86/set) and service aces (0.42/set)

– Feliciano and Tam rank second and third in kills

Record Breaker

– Rachel Tam had one of the best games in MVC history registering 39 kills in the win over Tennessee Tech on Sept. 17 and followed that up with an MVP performance at the Skyhawk Invitational on her way to being named the MVC Player of the Week

– Her total set the Evansville program record was second in conference history, just one off of the all-time mark

– Tam’s 39 kills is second-most for any NCAA Division I player in 2019

– Now averaging 4.60 kills/set, Tam is third in the MVC; she has had at least seven kills in all 11 matches in 2019

– On her way to the MVP honor in Martin, Tenn., Tam recorded 6.09 kills per set with her top match coming against the Skyhawks where she had 35 kills

– Her 35-kill final marked the top UE total in a 4-set match

A Helping Hand

– Junior Allana McInnis sits atop the MVC with 11.09 assists per set and is in the top 20 in the country

– McInnis has averaged 10+ assists in each of the last eight matches – all Evansville victories

– The top two contests of her career saw her post 65 helpers against Eastern Illinois before recording 64 in the win over Tennessee Tech

– She has recorded at least 29 assists in ten out of the 11 matches in 2019

– McInnis posted 22 or more assists in each of the last 14 matches of 2018 and has done so 10 out of 11 times in 2019

Scouting the Opposition

– UNI enters conference play with a 6-8 record, but seven of those eight losses came against Power 5 schools and the BIg East

– Karlie Taylor is near the top of the league with 4.73 kills per set and also chips in 3.19 digs per game

– Rachel Koop averages 10.4 assists per game and has 542 on the season

– Drake starts the weekend with a 6-7 record but halted a 5-match skid last weekend with a 3-2 win over North Carolina A&T

– Haley Bush paces the Bulldogs with 3.81 kills per game with Emily Plock just behind at 3.13

– Their defense is led by Paige Aspinwall’s 6.36 digs per game

– Illinois State starts their MVC slate with a 7-5 mark

– The Redbirds are led by Maylee Martin’s 3.86 kills and 10.22 assists per set from Stef Jankiewicz

– They open MVC action against Missouri State and SIU before coming to Evansville on Monday

Tucker joins USI Athletic staff

University of Southern Indiana Athletics announced the hiring of Jake Tucker ’05 as its Athletic Sponsorship and Sales Coordinator. Tucker is the first person to hold this newly created position.

“USI is really excited to have Jake on board,” said USI Director of Athletics Jon Mark Hall. “He is a high-energy person that will make a positive impact on our entire department. Jake has a passion for USI and he is ready to make a difference on our campus.”

A long-time member of the Tri-State business community, Tucker joins USI after 10 years with Old National Bank where he was an assistant vice president and retail center manager in the branch in Mt. Vernon, Indiana, and an assistant manager at the Red Bank branch. He was a personal banker for Fifth Third Bank for two years prior to his tenure at ONB.

Tucker also has been an active member of the community at-large, serving as a member of the Posey County Advisory Board for Junior Achievement of Southwestern Indiana; president of the Mater Dei Men’s Club; director of the Southwest Indiana Chamber of Commerce; director of United Way of Posey County; and director of the Posey County Economic Development Partnership.

Tucker is a 2005 USI graduate with a bachelor’s in business management and earned a master’s from the University of Evansville in public service administration. He and his wife, Robyn,
