AG Curtis Hill asks U.S. Supreme Court to protect FTC’s authority to obtain consumer restitution

Attorney General Curtis Hill on Friday announced an amicus brief supporting the Federal Trade Commission’s ability to seek restitution for consumers when enforcing provisions of the Federal Trade Commission Act.

The U.S. Supreme Court should consider and reverse a decision by the 7th Circuit U.S. Court of Appeals holding that the FTC lacks authority to obtain restitution when providing redress to victims of fraud or deceptive business practices, Attorney General Hill said.

“Without the ability to seek restitution, the FTC would be seriously hampered in its ability to protect consumers,” Attorney General Hill said. “Further, this kind of restriction on the FTC’s enforcement powers would weaken Indiana’s efforts to fight unfair and deceptive business practices through collaboration with our federal partners.”

States rely on partnerships with federal regulators such as the FTC to protect millions of Americans. In order to make victims of fraud whole and to adequately deter further wrongdoing, regulators typically seek injunctive relief that requires defendants to cease illegal conduct and return illegal profits to consumers. While Attorney General Hill and attorneys general around the country obtain consumer restitution through their own enforcement actions, states also benefit from the FTC’s independent authority to investigate and address violations of federal law.

The amicus brief filed Friday is signed by a bipartisan group of 24 attorneys general. The coalition points out that the 7th Circuit’s decision upends decades of precedent and will result in defendants attempting to “forum shop.” In fact, the attorney’s general state in the brief, defendants have already begun to attempt to transfer cases to the 7th Circuit in order to take advantage of the decision. As a result, the coalition claims the decision has created confusion where none previously existed.

In 2018 alone, the FTC’s Bureau of Consumer Protection issued more than $122 million in refunds to consumers throughout the country.

Gov. Holcomb Joins Jake Steinfeld In Awarding Fitness Centers To Indiana Schools

Governor Eric J. Holcomb and fitness icon Jake Steinfeld announced nominations are now open for Indiana schools to apply for a $100,000 DON’T QUIT!® fitness center from the National Foundation for Governors’ Fitness Councils (NFGFC).

“We are determined to improve the health of Hoosiers and a great way to do this is to get our kids excited about fitness,” Gov. Holcomb said. “I am excited that Jake decided he wanted to bring the DON’T QUIT! Campaign to Indiana, because it will empower more kids to develop healthy habits that they’ll take with them throughout life.”

The NFGFC seeks to encourage and reward innovation in the field of youth fitness by awarding fitness centers to schools that use new and unique methods to promote student physical activity and wellness. Three Indiana elementary or middle schools will each receive a $100,000 state-of-the-art fitness center from the NFGFC.

“Childhood obesity is a serious problem that can follow a child into adulthood. I’ve declared war on this preventable disease and it’s inspiring to see elected leaders like Governor Eric Holcomb immediately jump on board to join the battle and welcome us into the great state of Indiana. Every governor we’ve partnered with recognizes that obesity is neither a Democratic nor Republican issue, it’s a kids’ issue and all have vowed to do everything possible to help,” said Steinfeld, chairman of the NFGFC.  “Children are our most precious resource and by providing them with a strong foundation in health and fitness, we can feel confident that they’ll excel beyond their wildest dreams.”

The NFGFC envisions a nation that—through innovation and a “DON’T QUIT!” attitude—boasts the fittest kids in the world. DON’T QUIT! Fitness Centers have been built in 32 states and Washington, DC. In 2020, NFGFC will gift fitness centers to four more states – Indiana, Alabama, Kentucky and Oklahoma – with a goal of building in all 50 states in the coming years.

Each fitness center is financed through public/private partnerships with companies like The Coca-Cola Company, Anthem Foundation, Wheels Up and Nike, and does not rely on taxpayer dollars or state funding. TuffStuff Fitness International provides all the fitness equipment, which is manufactured in the United States.

Aces softball set for Jaguar Challenge in Mobile, Ala.

UE looks to build on solid opening

After traveling north to the Chicago area for its opening weekend, the University of Evansville softball team heads in the opposite direction to Mobile, Ala. for the Jaguar Challenge.

The University of South Alabama is the host with the Purple Aces also set to face Louisiana Tech and Austin Peay.

Evansville posted a 3-2 record at last weekend’s Total Control Sports Invitational in Rosemont, Ill.  The Aces opened the year with a win over defending Mid-American Conference Regular Season Champion Miami Ohio to open the season before defeating Western Illinois and Green Bay later in the weekend.

Jessica Fehr had the top weekend for UE, batting .500 while finishing with an on-base percentage of .706.  Fehr recorded five hits in ten at-bats while drawing seven walks.  She scored a team-high four runs.  Freshman Hannah Hood led the team with six RBI in the first weekend of action.  She batted .300 while recording three walks and two runs.

Eryn Gould and Alyssa Barela each posted a pair of home runs in Rosemont while leading the team with 10 total bases apiece.  On the basepaths, Halie Fain accumulated four steals in four attempts.  Her tally ranks second in the MVC.

UE’s pitching staff did an admirable job to open the year, finishing the first five games with a 2.26 ERA.  Izzy Vetter earned the win over Green Bay to go along with a save.  She fanned 23 batters in just 16 2/3 innings.  Emily Lockhart earned two victories, defeating the RedHawks and Leathernecks.

Louisiana Tech will be the first opponent of the weekend.  The Lady Techsters are coming off of a 45-16 campaign in 2019 that saw them go 19-5 in Conference USA en route to the league championship.  They advanced to the Baton Rouge Regional.  In their opening weekend, La Tech went 1-4.  Next up is Austin Peay.  The Governors picked up 33 wins last season and began the 2020 schedule by splitting two games against Chattanooga.

South Alabama picked up 18 victories a season ago and are 1-5 through their opening six games.  Four of the five losses came to Power Five schools Notre Dame, Illinois, Minnesota and Missouri.

  The Evansville Police Department is looking for help in identifying the driver of this vehicle that was involved in a hit and run motor vehicle accident at 10th and Franklin Street on January 25th between the hours of 7:00pm and 9:30pm. The picture of the female is the suspected driver of the white car. The last picture shows several people who aren’t suspects but were merely passengers in the suspect’s vehicle.
