According to the Department of Defense, starting Jan. 1, 2020, all service-connected disabled Veterans, Purple Heart recipients, former Prisoners of War (POW), and individuals approved and designated as the primary family caregivers of eligible veterans under the Department of Veterans Affairs.

Program of Comprehensive Assistance for Family Caregivers (PCAFC) can use commissaries, exchanges, and morale, welfare and recreation (MWR) retail facilities, in-person and online.

The Indiana Department Of Transportation Will Host Open House At South Spencer High School

The Indiana Department of Transportation will host a public open house on Wednesday, January 29, 2020, starting at 5:30 p.m. at the South Spencer High School Auditorium, 1142 N CR 275 W, Rockport, Indiana 47635. A brief presentation will be held at 6:00 pm.

Displays and representatives will be available prior to and following the presentation.

The purpose of the public meeting is to notify all interested persons regarding the revised design plans for a proposed intersection improvement at State Road (SR) 66 and Orchard Road (N CR 275 W), 0.26 mile east of SR 161, located in Spencer County. On June 23, 2017, a public hearing on preliminary design plans was held for this project, which included a roundabout. In response to community concerns, INDOT modified the project by eliminating the roundabout and proposing a signalized intersection with an added turn lane.

The revised preferred alternative includes widening the intersection to accommodate an added left turn only lane along eastbound SR 66, a mill and overlay of existing pavement, drainage improvements, an upgraded signal, and upgraded signs. As part of this project, several pipes and culverts will be replaced. Guardrail will be installed where needed. Approximate project termini were expanded east and west to achieve left turn lane deceleration and storage lengths. The approximate termini are from 1,105 feet west to 595 feet east of the intersection center and from 320 feet south to 265 feet north of the intersection center. The preferred alternative will meet the project’s purpose and need by improving safety with lengthened deceleration areas, increasing the capacity of the intersection and correcting drainage issues.

A total of 0.8 acres of permanent right-of-way and up to 0.5 acres of the temporary right-of-way was acquired for this project. The project is scheduled to begin in the spring of 2020, and work will occur year-round. During construction, the intersection will remain open to traffic along SR 66. The area will be restricted to one lane of traffic, which will be controlled by temporary signals. Traffic traveling north- and south-bound along Orchard Road/N CR, 275 W will experience temporary disruptions requiring detours via local roads, SR 161, and SR 66.

Project information, including environmental documentation, will be available for public viewing on the INDOT Vincennes District’s webpage at https://www.in.gov/indot/2707.htm, prior to the public meeting date.

Parolee With Violent Past Arrested After Standoff With Sheriff’s Office

The Vanderburgh County Sheriff’s Office has arrested a parolee previously convicted of voluntary manslaughter after a stand-off at a northern Vanderburgh County residence.

On Friday, January 10, 2020, at approximately 12:30 PM the Sheriff’s Office responded to a welfare check at a residence located in the 3000-block of Bromm Road. Parolee Eric Nicholson was reportedly refusing to go to a scheduled mental health appointment and had been breaking the windows out of the residence. Nicholson also threatened that if law enforcement arrived at the home he would set himself on fire using gasoline.

Responding sheriff’s deputies created a temporary command post near the intersection of Bromm Road and Orchard Road and did not approach the residence. Deputies confirmed that Nicholson’s family members were out of the residence and safe. The family joined us at the command post and explained that Nicholson was experiencing a manic episode and hallucinating severely.

Deputies began researching Nicholson’s criminal history and confirmed that on February 19, 1999, Nicholson pled guilty to a reduced charge of Voluntary Manslaughter as a Class A Felony in Vanderburgh Superior Court. At the age of 23, Nicholson was sentenced to the Indiana Department of Corrections for a period of forty-five (45) years for the death of his aunt, Ms. Melody Trent of Evansville. Trent was killed in her own apartment in the 1600-block of N. Seventh Street after being stabbed four times, sustaining repeated blows to her head with a blunt object and having her throat cut.

On September 28, 2018, Nicholson was released to the Evansville Parole District after serving a little over 20 years and 8 months in prison. On November 09, 2018, the Sheriff’s Office responded to Nicholson’s residence on Bromm Road after his family reported he was hallucinating and thought someone was shooting at him through a window. Nicholson had been released from prison with a 30 day supply of medication, but his family had not been able to obtain another prescription.

Nicholson initially agreed to allow the deputies to transport him to the hospital for an evaluation, but then assaulted a deputy and was taken into custody after a struggle. Nicholson was taken to the hospital by ambulance for a physical evaluation. He was later booked on charges of Resisting Law Enforcement and Battery on a Public Safety Official. Additionally, the Evansville Parole District filed a parole violation against Nicholson. All the charges were later dismissed in September of 2019 and Nicholson was released from custody.

At the command post, Sheriff’s Office negotiators attempted to make telephone contact with Nicholson, but he sounded incoherent and would frequently hang the phone up. During the stand-off, Nicholson’s parole officer applied for and obtained a new parole violation warrant. After consulting with Nicholson’s family members (who owned the home), the decision was made to deescalate the situation by leaving Nicholson alone in the home.

The Sheriff’s Office utilized plainclothes detectives to notify all the surrounding residents of the situation. Residents were cautioned to call 911 should Nicholson be observed approaching their residences.

Around 6:00 PM Friday evening the Sheriff’s Office responded to a report that Nicholson was seen walking in the area and later located him on North Saint Joseph Avenue near Mohr Road. Nicholson was ordered to lie on the ground, but refused to comply. After being warned that a Sheriff’s K-9 would be used against him, Nicholson surrendered without resistance.

Nicholson is currently being held in the Vanderburgh County Jail with no bond on a parole violation warrant.

Sheriff Dave Wedding stated, “This case is a perfect illustration of the challenges our criminal justice system faces when dealing with violent offenders who are in need of long term mental health care.” Sheriff Wedding added, “We must have adequate bed space and mental health resources in our community to prevent cases like this from spiraling into tragedy.”

Democrats Say Now, Republicans Say No On Teacher Pay Hikes

Republicans have insisted they don’t want to reopen the two-year budget passed in 2019 and don’t want to commit the state this year to a long-term funding liability. And Gov. Eric Holcomb and legislative leaders have also counseled waiting until the governor’s “Next Level Teacher Compensation Commission” issues its report this spring.

Thursday, House Speaker Brian Bosma, R-Indianapolis, said Holcomb plans to address teacher pay in his State of the State address on Tuesday, but will offer a solution for a future year.

“The governor’s proposal is going to be outside this budget year,” Bosma said. “So, he’s going to propose a future resolution which I think is a very wise one.”

Indiana has lagged the nation in pay increases for teachers, contributing to falling numbers of people holding or applying for teaching positions in this state. Concerns about that, as well as ongoing frustrations with standardized testing and the use of it to evaluate teachers, brought thousands of teachers to the Statehouse in November.

Republicans have responded by pushing bills to not grade schools for now on the poor results from the new ILEARN test and to decouple teacher pay from the results of those tests. But they have balked at giving teachers a raise this year.

During the House session Thursday, Democrats took aim at House Bill 1007, which takes about $290 million of the state’s surplus to pay cash rather than borrow money for university capital projects. They tried and failed nine times with amendments to instead devote funds to school corporations, health programs, shifting the cost of school counselors to the Department of Education and to establish paid family leave for Indiana workers.

The amendments included spending $50 million for pre-kindergarten programs; $5 million for making schools safer, $50 million for a prescription drug program for seniors and $186 million for a one-time bonus for public school teachers.

Rep. Tim Brown, R-Crawfordsville, said there is already a budget set in place for the current fiscal year, and the amendments are simply trying to open up the budget when it isn’t needed.

But Rep. Ed DeLaney, D-Indianapolis, said once the budget is adopted, passing bills regarding expenditures shouldn’t stop.

And he expressed outrage that the state has a surplus of $2.27 billion while needs go unfunded.

He noted that when he first was elected to the Indiana House in 2008, the state was cash strapped.

“The only problem I had then was we were broke. And the only question was who was going to get squeezed and it turned out to be the schools. Now, the problem is nobody can be helped.”

“What is this session about?” DeLaney said. “This is really very disappointing if we don’t want to address a single new topic or make an adjustment.”

Senate Democrats made their case for acting now in a news conference Thursday morning.

Sen. Eddie Melton, D-Gary, urged passage of a bill he’s authored, Senate Bill 413, to increase the teacher appreciation grants the state provides by 333%. This will be achieved by appropriating $100 million each year for the current fiscal year and the following one.

“Currently, IPS (Indianapolis Public Schools) eligible teachers will receive, as the budget is right now, on average $350 per teacher. Under this bill they will receive over $1,100,” Melton said.

Teachers statewide who are already eligible for the grant would receive the raise immediately upon SB 413 passing.

Sen. Karen Tallian, D-Ogden Dunes, said a bill she authored, SB 306, would free up $100 million per year to increase teacher salaries statewide by lowering payments to the Teacher Retirement Fund.

“I would never do anything that would jeopardize your pensions and I assure every teacher in the state that this will not harm” the retirement fund, Tallian said.

When asked whether enough Republicans would go along to help pass the measures, the Democrats were hopeful, recalling positive comments from some GOP lawmakers in the past on these issues.

“This should be a bipartisan effort,” said Senate Minority Leader Tim Lanane, D-Anderson.

Melton also called attention to the teachers’ November protest.

“They can’t forget what happened on Nov.19th … when over 15,000 teachers were here,” Melton said, adding: “I’m sure they have been contacted by teachers around their districts.”

AG Curtis Hill Assails Effort To Overturn Entire Slate Of Indiana Abortion Laws

Attorney General Curtis Hill this week filed a brief in U.S. district court refuting arguments by Whole Woman’s Health Alliance that 25 sections and sub-sections of Indiana law dealing with abortion are unconstitutional.

“Indiana’s abortion regulations are carefully designed to further our important and legitimate interests in expressing respect for fetal life and promoting women’s health,” Attorney General Hill said. “At the same time, our laws respect the woman’s ultimate decision whether or not to bear a child. The federal district court should protect the delicate balance fashioned by the Supreme Court’s abortion precedents.”

Late last year, Whole Woman’s Health argued in a court filing that the entirety of Indiana’s abortion legislation imposes an undue burden on a woman’s right to choose whether or not to bear a child. At the heart of the abortion provider’s argument, Attorney General Hill said, is a gross misinterpretation of the U.S. Supreme Court case Whole Woman’s Health v. Hellerstedt.

Whole Woman’s Health’s latest claim, he said, “represents an attempt by an abortion provider to exploit the Supreme Court’s decision as a weapon to strike down entire state regulatory regimes, even if those laws have been enforced and upheld for years.”

The abortion provider’s expansive claims show disregard for existing case law, he added.

“Indeed, Whole Woman’s Health’s approach cuts to the very heart of the Supreme Court’s abortion jurisprudence,” Attorney General Hill said. “It assumes no abortion dispute can ever be truly settled, claiming that no matter how many times an abortion regulation is upheld, it can always be challenged again — at trial — on the grounds that changed circumstances have made the previously valid law unconstitutional.”

Whole Woman’s Health’s contention that Indiana law creates undue burdens on the right to an abortion is based on unfounded speculation rather than the actual effects of Indiana’s regulations, Attorney General Hill said. Whole Woman’s Health, he noted, has even conceded that it failed to show that Indiana’s laws have prevented Hoosier women from accessing abortion.

“If accepted, these arguments would throw abortion jurisprudence into chaos,” Attorney General Hill said.
