Court Ruling Should Remind State Leaders That COVID-19 Restrictions Must Follow Constitution

Attorney General Curtis Hill said today that leaders in all states should take notice of a federal court decision that declares unconstitutional certain COVID-19 orders issued by Pennsylvania Gov. Tom Wolf.

“Since the spring,” Attorney General Hill said, “I have expressed my strong belief that leaders at all levels of government must be careful to follow proper processes and stay within constitutional boundaries when devising measures intended to combat the spread of the novel coronavirus. This federal ruling announced Monday only strengthens my conviction in this regard.”

In his opinion, U.S. District Court Judge William Stickman IV found unconstitutional aspects of Pennsylvania executive orders that limited sizes of gatherings, implemented stay-at-home orders and imposed mandatory business closures.

“This ruling reminds us that general societal shutdowns, even in the face of pandemics, can be hard to square with an open society premised on liberty and constitutional rights,” Attorney General Hill said. “Governments must be vigilant in ensuring that emergency orders restricting fundamental individual liberties are based on science or other sound evidence. Such orders also should have defined expirations after short durations and draw thoughtful distinctions among regulated activities.”

Roadway Safety Encouraged During Harvest Season

Crops across the state are looking bountiful and harvest is almost here. Farmers will soon be traveling in large slow-moving farm equipment on Indiana roads. To increase roadway safety, we are encouraging motorists to exercise caution and patience when approaching large farm equipment over the next few months.

“When traveling across rural Indiana this fall, we want to encourage motorists to prepare for extra travel time and slow down when approaching large farm equipment,” said Lt. Governor Crouch. “It is vital that all Hoosiers work together for a safe 2020 harvest season.”

According to the most recent data from the National Highway Traffic Safety Administration, in 2018 farm equipment vehicles were involved in 98 crashes across the U.S., with two farm equipment vehicles being involved in fatal crashes in Indiana.

Farm equipment must have the national designated slow-moving vehicle sign – a red triangle-shaped reflector – to warn approaching drivers that slow moving equipment is on the roads. These vehicles often travel at speeds no higher than 25 mph.

Farm equipment during harvest season could include tractors, combines, grain carts, grain wagons and large trucks hauling agricultural products.

Bruce Kettler, Indiana State Department of Agriculture director, wants to remind motorists and farmers to slow down, be patient and share the road this fall.

“Harvest season is quickly approaching and Hoosier fields are looking really good,” said Kettler. “We want to encourage farmers and motorists alike to slow down, be patient and share the road.”

During harvest season, motorists are encouraged to leave 10 minutes early and to be aware of alternate routes. It’s important to watch for wide vehicles, especially when approaching hills and curves in the road.

When attempting to pass farm equipment, always look for oncoming traffic. Farmers will pull over for motorists when they are able to, but it may take some time to find a safe place to do so.

At all times, follow the rules of the road: don’t tailgate farm equipment, pass only in designated passing zones and ensure you are following the hands-free driving law.

“As farmers begin to harvest this year’s crops, please remember to be courteous and cautious when meeting farm equipment on the roadways,” said Doug Carter, Indiana State Police Superintendent. “By working together and sharing our roadways, we can ensure we all make it home safely.”

Potential Port Purchase Agreement Withdrawn

Gov. Eric J. Holcomb today announced the state will not move forward with plans to purchase land near Lawrenceburg that was under consideration as a potential site for a fourth port.

The Ports of Indiana entered into an agreement in September 2017 to reserve the option to purchase up to 725 acres of land that were formerly the American Electric Power plant. The Ports of Indiana engaged in an extensive evaluation of the site to determine its suitability as a port, including its environmental condition and plans for remediation.

The Ports of Indiana concluded that the remediation work would take years to complete on a significant portion of the land, rendering the site economically unviable as a port facility at this time.

“I have been eager to pursue the opportunity for a fourth port in Indiana well before holding this office and remain so today. While I’m disappointed this particular site is not feasible for this purpose, I am committed to working with the Ports of Indiana and all the dedicated business and local elected leaders in southeastern Indiana to explore other possible locations in the region,” Gov. Holcomb said.

Since taking office in 2017, Gov. Holcomb has included the acquisition of a fourth port in his Next Level Agenda and included it as a key infrastructure priority during each of his four State of the State addresses. At the Governor’s direction, his office partnered closely with the Ports of Indiana and other interested parties to explore all options to make the fourth port a reality at the site.

Indiana has three state ports operating on the Ohio River and Lake Michigan, with locations in Jeffersonville, Mount Vernon and Burns Harbor/Portage. Over the years, the Ports of Indiana has expanded each of its ports and now operates approximately 2,800 acres along Indiana’s navigable waterways. Indiana’s ports contribute over $7.8 billion per year to the state economy and support nearly 60,000 jobs.
