AG Curtis Hill Announces $678 Million National Settlement With Novartis Pharmaceuticals over alleged kickbacks

Attorney General Curtis Hill announced today that Indiana, along with 26 other states and the District of Columbia, has joined the federal government in reaching an agreement that settles allegations against Novartis Pharmaceuticals Corp.

The settlement with Indiana will resolve allegations that Novartis paid kickbacks to health care practitioners in the form of cash, meals, entertainment and honoraria payments to induce them to prescribe various medications that treat hypertension or Type 2 Diabetes.

Under the settlement, Novartis agreed to pay $678 million to the federal government, Indiana, 26 other states and the District of Columbia. Of that amount, $103 million resolves claims pertaining to state Medicaid programs. About $1.1 million of the settlement resolves claims relating specifically to Indiana’s Medicaid program.

“Medicaid exists to help cover medical costs for individuals with limited incomes,” Attorney General Hill said. “Exposing waste, fraud and abuse in connection with Medicaid funds is part of our responsibility as stewards of the public trust, and we are committed to fulfilling our mission in this regard.”

The settlement resolves allegations that from January 2002 to November 2011, Novartis paid kickbacks to doctors to prescribe Lotrel, Valturna, Starlix, Tekamlo, Diovan HCT, Tekturna HCT and Exforge HCT — and that between January 2010 and November 2011, Novartis also did so for Exforge, Diovan and Tekturna. In court documents, it was alleged that Novartis systemically paid doctors to speak about certain drugs at sham events — with a veneer of education applied in an attempt to avoid the law — and covered the costs of lavish meals and entertainment for attendee doctors. The goal, according to allegations in the documents, was to induce doctors to write prescriptions for these Novartis drugs in violation of Indiana’s False Claims Act statutes.

Novartis admitted aspects of the scheme in a stipulation filed in federal court in connection with the settlement. These admissions include details concerning excessive spending on meals and alcohol. In addition, Novartis admitted facilitating minimal medical discussions at these events.

This settlement arises from a whistleblower action originally filed in 2011 in the U.S. District Court for the Southern District of New York under the federal False Claims Act and the named plaintiff states’ respective false claims/anti-fraud statutes. A National Association of Medicaid Fraud Control Units (NAMFCU) Team participated in the investigation and finalized the settlement with Novartis on behalf of the states. The NAMFCU Team was comprised of representatives from the Offices of the Attorneys General for the states of California, Illinois, New York, Texas, Virginia and Wisconsin.

The Indiana Medicaid Fraud Control Unit receives 75% of its funding from the U.S. Department of Health and Human Services under a grant award. The remaining 25% is funded by the State.

40 Days for Life Fall Campaign is an internationally coordinated campaign that aims to end abortion locally through prayer and fasting, community outreach and a peaceful all-day vigil in front of abortion businesses.  The Fall Campaign will commence on Wednesday, September 23rd and end on Sunday, November 1st, 2020 with prayer partners standing and/or walking in front of Planned Parenthood on Weinbach Avenue in Evansville.

“Now more than ever, Life is at the forefront of the cultural conversation,” said Mary Ellen Van Dyke, Executive Director of Right to Life of Southwest Indiana.  “Supporting life by participating in these peaceful prayer vigils give voice to those who are voiceless – the preborn.”

INDIANAPOLIS —Jennifer McCormick, the state’s superintendent of public instruction, broke rank with her Republican party when she announced she is backing Dr. Woody Myers, the Democratic candidate for governor, over the incumbent Gov. Eric Holcomb.

McCormick has challenged her own party on issues ranging from charter schools to teacher pay in her tenure and has announced support for other Democrats in this election season. But the question is will it make a difference?

The timing of the endorsement and the significant gap in campaign funds means it is unlikely to sway the outcome of the election.

Myers’ campaign had $70,000 remaining while Holcomb had over $8 million. Both reporting periods ended on June 30, according to www.campaignfinance.in.gov.

Andrew Downs, director of the Mike Downs Center for Indiana Politics at Purdue University Fort Wayne, said that political figures and organizations strategically choose to endorse candidates that they want to win elections; or choose not to endorse more unfavorable candidates.

In the case of McCormick, this endorsement is unique because she chose to cross party lines. Downs said moves like this could be made to condemn the candidate that is not endorsed — in this case, Holcomb.

McCormick told the Indianapolis Star she chose Myers because of his intellect, concern, and commitment to education and that under his leadership school will get the support and resources to meet their challenges.

The next elected governor will have the job of appointing McCormick’s replacement, as the Indiana General Assembly decided to change the position from an elected one to an appointed one. The change was made after the Republican McCormick announced in the fall of 2018 that she would not run for a second term.

“It’s not surprising that a Democrat is endorsing a Democrat,” said Jake Oakman, communications director for the Indiana Republican Party. “Jennifer has been angling for a position in a possible future Democrat administration for months now.”

Earlier in the year, before the COVID-19 pandemic halted most political and social interactions, McCormick joined state Sen. Eddie Melton, D-Gary, on an education listening tour as Melton was contemplating a run for governor. Ultimately, Melton decided against running.

An endorsement matters most when voters are undecided, said Laura Wilson, assistant professor of political science at the University of Indianapolis. Wilson also said that the timing of an endorsement is important, as an early endorsement can be forgotten and a late one will not affect the election.

“Endorsements are going to encourage people who are on the fence or not quite sure,” Wilson said. “People who already know who they want to vote for aren’t likely to change their minds due to an endorsement.”

While the endorsement by McCormick is significant historically because she crossed the party line, Wilson said, but many endorsements are more expected.

“It’s polite,” Wilson said. “It’s a recognition of ‘here’s this person that’s running that I think is great.’”

Wilson and Downs said that the barriers of going up against an incumbent and having less campaign funding probably mean McCormick’s endorsement of Myers will not change the outcome of the election.

Holcomb is endorsed by police and firefighter groups, building, construction and realtor organizations, and the Indiana Chamber of Commerce.

Myers’ campaign for governor is supported by presidential candidate and former Vice President Joe Biden, Indiana progressive groups, and several federations and unions supporting workers.

The general election, including the Indiana gubernatorial race, is Nov. 3. Early voting begins on Oct. 6.

MVC slate unveiled for UE men’s basketball

Aces open league play on December 30

With the non-conference start date set for November 25 for the 2020-21 men’s basketball season, the Missouri Valley Conference has unveiled the league portion of the upcoming schedule as the University of Evansville prepares for its first full season under the leadership of head coach Todd Lickliter.

Conference action will begin on Wednesday, December 30 with a home matchup against Illinois State.  The Redbirds were the #9 seed in the conference last season after going 5-13 and 10-21 overall.  UE returns the trip to Redbird arena on Wednesday, January 27,

A trip to Missouri State will open up the new year.  The Purple Aces and Bears will tangle inside JQH Arena on Saturday, January 2.  MSU is coming off of a 9-9 league mark and were 16-17 overall.  Evansville has an even 3-3 mark in its last six trips to Springfield.  Four days later, the Aces are back home to face Drake, who was 20-14 overall in 2019-20 and 8-10 in the Valley.  Over the last eight home games against the Bulldogs, the Aces have come out on the winning end seven times.

The first 2-game road swing of the league campaign opens on Jan. 9 at UNI.  Last year, the Panthers won a league-best 25 games while taking the regular season league crown with a 14-4 mark.  On Jan. 13, UE continues its road trek at Valparaiso.  In its last trip to the ARC, UE played a spirited game against the Crusaders, trimming an 18-point deficit to just two tallies in the final minute before Valpo escaped with the 67-65 win.

UE travels back home on Saturday, Jan. 16 to take on a Loyola team that went 21-11 a season ago while finishing second in the conference on the strength of a 13-5 mark.  In its only Tuesday contest of the MVC season, Evansville welcomes Indiana State to town on Jan. 19.  The Sycamores tied for the third-best league mark in 2019-20, going 11-7.

Evansville wraps up its season series against Drake on Saturday, Jan. 23 before heading to Normal, Ill. for the second season match-up against the Redbirds on the 27th.  In what is always one of the most highly anticipated home games of the season, the Aces complete the month of January at home against Southern Illinois on the 30th.

February begins on the road with a return trip to Loyola on the 3rd.  Saturday, Feb. 6 will see defending MVC Tournament champion Bradley make its way to the Ford Center for its first contest of the year against UE.  The Braves posted a 23-11 overall mark last season while winning 11 league outings.  A pivotal home stretch wraps up on Wednesday, Feb. 10 when UNI comes to town.

A pair of short road trips comprise the following two contests as UE heads to Terre Haute to face the Sycamores on Feb. 13 before trekking to Carbondale, Ill. to complete the season series against SIU.  The final week of home action commences on Saturday, Feb. 20 when the Aces welcome Missouri State.  Senior Night is set for Feb. 24 as Evansville plays host to Valparaiso.

Regular season action wraps up on Feb. 27 with a road tilt at Bradley.  The State Farm MVC Tournament is scheduled for March 4-7 at the Enterprise Center in St. Louis, Mo.
