Attorney General Slams St. Joseph County For Urging Churches To Avoid In-Person Services

INDIANAPOLIS — In a week where Indiana saw some of the highest numbers of COVID-19 cases since the start of the pandemic, Attorney General Curtis Hill criticized St. Joseph County health officials for asking churches to worship remotely until March.

Friday, the Indiana State Department of Health reported that 2,519 Hoosiers have been diagnosed with the highly contagious novel coronavirus for a total of 157,713 people who have been sickened. That follows Thursday’s all-time high of 2,880 people who have been infected.

Deaths have been steadily climbing, too, with 27 additional Hoosiers who died as of Friday, according to the health department. With Thursday’s count of 42 new deaths, the total number of Hoosiers who have died is 3,858 while another 234 people have COVID-19 listed as a probable cause because of their symptoms at the time of death.

Hill, in an advisory opinion issued Friday, said a letter from the St. Joseph County Health Department to area churches was threatening. In his response, Hill asserts that limiting churches to remote services for five months puts a substantial burden on the religious freedom of Hoosiers.

The notice from the county’s department of health, released on Oct. 13, refers to five clusters of COVID-19 cases that were traced back to local churches.

“With the arrival of cooler weather and the traditional influenza season looming on the horizon, we write this letter to urge all faith communities in St. Joseph County to pivot to online or virtual worship formats from now through March 2021,” the letter said.

The letter, which came from St. Joseph County health professionals, cites the 1,249 active cases in the county, which is 460 cases per 100,000 residents on Oct. 13.

But Hill, in his opinion, wrote, “Unless you have actual evidence justifying the need to target churches for closure—i.e., something other than the ‘not conclusive’ study your letter cites—I advise you to cease from threatening congregations who do not comply with your demands or my office will be ‘compelled to act.’”

Dr. Mark Fox, a St. Joseph County health official, in an email response, said Hill’s letter is an example of prioritizing politics over public health in the midst of a pandemic.

“His letter also seems disingenuous in characterizing our letter as threatening,” Fox said. “We did not issue an order, or regulation, or a mandate, and in fact offered assistance in reviewing COVID safety plans for faith communities that choose to gather for in-person worship. His threat, however, was unequivocal.

“Having said that, we cannot let his attack distract us from our fundamental commitment to protect the community, especially those most vulnerable to COVID-19, a commitment that we believe many faith communities share.”

St. Joseph, home to the city of South Bend, has a 5.88% seven-day positivity rate and 303 cases per 100,000 residents as of Friday, factors considered in the Indiana health department COVID-19 dashboard that labels the county in orange.

Orange counties are considered to have a moderate-to-high community spread, with recommendations like allowing grade schools to continue in-person but using hybrid learning for middle and high school students.

EPA Continues to Improve and Clarify Clean Air Permitting Process

U.S. Environmental Protection Agency (EPA) finalized a rule to further streamline and improve the Clean Air New Source Review (NSR) permitting process. Specifically, today’s action will clarify the process for evaluating whether a NSR preconstruction permit is needed when an existing major-emitting facility plans to make changes to its facility.

“Today’s rule is part of the Trump Administration’s goal to revitalize and modernize our nation’s industrial operators while maintaining clean air progress,” said EPA Administrator Andrew Wheeler. “This rule incentivizes installation of new technologies that can both improve operator efficiency and reduce air pollution.”

In March 2018, the EPA Administrator issued a memorandum titled “Project Emissions Accounting Under the New Source Review Preconstruction Permitting Program.” In the memorandum, the Administrator explained that the agency interprets current NSR regulations to allow emissions decreases as well as increases from a project to be considered at Step 1 of the NSR applicability process. This rule provides further clarity and certainty to the regulated community regarding the permissibility of project emissions accounting.

EPA expects that allowing project emissions accounting will reduce regulatory burden — saving time and money without sacrificing environmental protection. Where a review of both the emissions increases and the emissions decreases associated with a proposed project indicates that the project will not result in a significant emissions increase, this review would end the applicability evaluation. In general, the project could then proceed under a minor source permit as applicable. Those state and local air agencies that implement the NSR program through EPA-approved State Implementation Plans (SIPs) need not allow for project emissions accounting nor are they required to submit SIP revisions or stringency determinations to EPA as a result of this action.

Under this Administration, EPA has taken numerous steps to clarify and improve New Source Review (NSR) permitting requirements including guidance to:

• Communicate how EPA would apply and enforce the Actual-to-Projected Actual Emissions Applicability Test;

• Clarify the meaning of “Common Control” and “Adjacent” in the context of determining the scope of a stationary source;

• Identify additional circumstances under which an area may be excluded from  “Ambient Air”;

• Provide PM2.5 and Ozone Significant Impact Level (SIL) guidance; and

• Provide guidance on plantwide applicability limits or PALs.

EPA has also issued final actions to complete the reconsideration of prior agency actions on project aggregation and reasonable possibility in the context of Clean Air Act permitting and to streamline tribal oil and gas permitting activities. All of these actions will improve regulatory certainty and remove unnecessary obstacles to projects aiming to improve the reliability, efficiency, and safety of facilities while maintaining air quality standards.

 

HEALTH DEPARTMENT UPDATES STATEWIDE COVID-19 CASE COUNTS

USI takes third in GLVC Championship, Morphew named GLVC Freshman of the Year

University of Southern Indiana Women’s Cross Country Team took third place in the 2020 Great Lakes Valley Conference Championship Saturday afternoon.

USI finished with a total of 85 points only behind Drury University (72 points) and Southwest Baptist (53 points).

Senior Jennifer Comastri was comfortable out front, pacing the Screaming Eagles as she crossed the line in 21 minutes, 39.5 seconds to claim fourth place overall. Freshman teammate Allison Morphew was the next Eagle to find the line as she clocked in at 22:29.4 in 12th place. Morphew was the first freshman of the Championship race to finish, making her GLVC Freshman of Year; capping off an incredible first collegiate cross country season.

Sophomore Mckenna Cavanaugh kicked it in quickly after Morphew giving herself 15th overall which also happens to be the cut-off for All-GLVC honors. Sophomore Aubrey Swart and Freshman Adele Schnautz closed out the scoring by placing 25th and 29th, respectively for the Eagles.

One last bright note, the Eagles had three runners recognized for their outstanding performance today.

Three All-GLVC: All runners who finished 15th place or better were named All-GLVC, so that includes Comastri (fourth), Morphew (12th) and Cavanaugh (15th).

This will conclude the 2020 USI Cross Country Season due to the cancellation of the NCAA II Midwest Regionals and NCAA II Championships earlier this year.
