Federal Appeals Court Upholds Indiana law Permitting Election Boards To Ask State Courts To Extend Polling Hours

Attorney General Curtis Hill today commended the 7th U.S. Circuit Court of Appeals for upholding an Indiana law permitting a county election board, but no one else, to request an order from a state court extending voting hours when justified by state law.

Such extensions may be necessary in the event of technical problems at polling places, but they cannot be undertaken without a court order making specific state law findings.

A lawsuit by Common Cause Indiana argued that anyone should be able to request such a court order, but Attorney General Hill observed  that the legislature limited the law’s reach in order to avoid inundating courts with demands for extended polling hours. Indiana law, he added, affords voters ample opportunity to cast their ballots even before Election Day, and the statute at issue does not preclude voters from filing claims under federal law in either state or federal court.

“Fortunately, we are seeing federal appeals courts nationwide recognizing states’ legitimate authority to enact and enforce reasonable election laws,” Attorney General Hill said. “Taken as a whole, election regulations must exist for elections to be fair, meaningful and legitimate.”

Attorney General Hill also recently prevailed in two other federal appellate cases involving Indiana’s election laws. In those cases, the 7th Circuit upheld state laws 1) prohibiting election officials from counting mail-in ballots received after noon on Election Day and 2) permitting only some categories of voters, including the elderly, to cast mail-in ballots.

Fernando Morales Named Head Coach Of Puerto Rico National Team

Morales To Lead The Team Over The Summer
 After serving as the captain of the Puerto Rico National Team in his days as a player, the University of Evansville head volleyball coach Fernando Morales has been named the head coach of the Puerto Rico Women’s Volleyball National Team.
This appointment will not have any impact on Morales’ work with the Purple Aces as the national team plays most of their games during the summer.
“It is always an athlete’s dream to be able to represent their country and I was able to do it for 10 years.  To get the opportunity to do it as a coach is a dream come true,” Morales said.  “We have a great group and having the support from the veteran players in the national team is very big for me.  We think we can do great things together and we will work hard towards our goals.”
“I want to thank Mark Spencer and Sarah Solinsky for understanding what this means and giving me the green light to follow this dream,” Morales continued.  “I have a great staff in Melissa (Rabell) and Jesus (Echevarria), it is going to be a lot of work but very doable with their help.”
Morales will assume the head coaching duties as the team prepares to make a run to the 2024 Olympics.  There are two ways for his team to qualify.  They will play in the regional qualifier that includes North America, Central America and the Caribbean with the chance to advance to the Olympics.  In 2022, his Puerto Rico will take part in the World Championships in the Netherlands, which also provides the opportunity to become one of the 12 teams that will play in the Olympics.
“We are very happy that Fernando accepted the challenge, he is a very talented young coach who knows how to reach his players. We have no doubts that our plan will be implemented to take our team to the highest level, “exclaimed president of the Puerto Rican Volleyball Federation Dr. César Trabanco.
His college coaching career began in 2018 as an assistant at UE before being named the interim head coach in early 2019.  After serving in an interim capacity through the first two months of the season, he was elevated to the head coaching position in October of 2019.
The impact Morales had on the UE program was immediate.  He led the team to a 16-14 record in 2019 along with a 6th place finish in the Missouri Valley Conference.  It was the first winning record for UE since 2010 and the first berth in the conference tournament since 2008.  On the individual side – freshman Melanie Feliciano had one of the best debut seasons in the Aces record books.  Her 456 kills were the most for an Evansville freshman in program history and she finished in the top three in kill average in the MVC and among all freshmen in the NCAA.
He directed senior Gabriela Macedo to a record-breaking performance on the defensive side of the floor, setting the single-season program mark with 704 digs, second-best in Valley history.  She set the single-match mark with 46.
Last year, Morales worked with the Puerto Rico National Team as an assistant coach.  The team played in the NORCECA Women’s Qualification Tournament, which also included Canada, Mexico, and the Dominican Republic.
His dedication towards his country spans over a decade.  As a player, he was the National Team Captain and took his career to the professional level where he played for 19 seasons, 12 of them coming overseas.

MVC releases spring women’s soccer information

On December 17, 2019, Chris Pfau returned as the head coach of the University of Evansville women’s soccer team. In a wait that will be roughly 14 months he will lead the Purple Aces back onto the field in February of 2021.

On Wednesday, the Missouri Valley Conference announced the league slate for the spring of 2021. Exact dates for several matches are still being finalized and will fall into place in the coming weeks. Date ranges are given below; just one match against that opponent will take place within those dates.

March 9 OR March 10, 2021 – at Southern Illinois
March 19 OR 20 OR 21, 2021 – at Missouri State

April 3 OR 4, 2021 – at Loyola
April 7, 2021 – vs. Indiana State

League action kicks-off in the final weekend of February when Illinois State visits McCutchan Stadium. Continuing home action on Friday, March 5 when UNI comes to town. In their last meeting, UE picked up a 1-0 shutout of the Panthers, setting the Aces up to qualify for the MVC post-season.

“First I want to thank UE, Mark Spencer, Sarah Solinsky, Terry Collings and the COVID taskforce for all their hard work in making this happen,” Pfau said. “Everyone has done an incredible job making sure our student athletes, coaches and staff are in a safe environment and we are all following protocols.”

UE takes to the road for its next match, traveling to Southern Illinois. The Salukis women’s soccer program is set for its first season of competition in the MVC. SIU, who is led by former UE assistant coach Grant Williams, went 5-10-2 in the program’s first season. UE and SIU will meet on either March 9 or 10.

Evansville visits Missouri State in a match that will take place on the weekend of March 19, 2021 in Springfield, Mo. The Purple Aces return home on March 24 to play Valparaiso before taking to the road for matches at Drake (3/28/21) and Loyola (4/3/21 OR 4/4/21). The regular season finale against Indiana State is set for Wednesday, April 7.

“We are excited to get going in the spring,” Pfau said. “The MVC has done a great job making sure that we not only have conference games but that we can play in a safe manor. Our team has been working hard this fall and now to have something to look forward to is very exciting.”

A 6-team conference tournament will begin on April 10 with the No. 3 seed facing No. 6 while No. 4 and No. 5 will square off for a chance to advance to the next round.  The semifinal round will be held on April 14 before the conference championship match will be held on Saturday, April 17.  All tournament matches will be hosted by the higher seed.

Non-conference dates and opponents will be announced in the coming weeks.  The NCAA has set February 3, 2021 as the first day regular season competition can begin.  All dates and opponents are subject to change.

Federal Partners Kick Off Workshop on Federal Government Human Health PFAS Research with the National Academies of Sciences, Engineering and Medicine

U.S. Environmental Protection Agency (EPA), the U.S. Department of Defense (DoD), the U.S. Department of Agriculture (USDA), and the U.S. Department of Health and Human Services (HHS) kicked off the National Academies of Sciences, Engineering, and Medicine (NASEM)’s Workshop on Federal Government Human Health Per- and Polyfluoroalkyl Substances (PFAS) Research. Aggressively addressing PFAS has been an active and ongoing priority for this Administration. This collaborative workshop will help to further coordinate PFAS research across the federal government and is an important part of EPA’s work under its PFAS Action Plan.

“EPA is committed to working with our federal partners and leading scientists around the world to advance cutting-edge research on PFAS,” said EPA Administrator Andrew Wheeler. “Aggressively addressing these chemicals of concern is one of my top priorities and this workshop will help our scientists showcase the depth of the research across the federal government.”

“This independent review by the National Academies is an important step to leverage the extensive work ongoing across federal entities and will help determine what further research needs to be conducted in order for us to most effectively continue our PFAS response. As the Chair of DoD’s PFAS Task Force, I will tell you that DoD’s participation in this workshop is part of the Department’s commitment to ensure the health and safety of our men and women in uniform, their families, and the communities in which we serve,” said Assistant Secretary of Defense for Sustainment Jordan Gillis.

“USDA supports measures that foster healthy, viable, and sustainable agricultural farming practices,” said Deputy Under Secretary for USDA’s Research, Education, and Economics Mission Area Dr. Scott Hutchins. “This multi-agency collaboration and coordination is a critical step in finding workable solutions for our nation’s farmers.”

“Similar to other agencies within the federal family, understanding the health effects of exposures to PFAS continues to be a priority for the Centers for Disease Control and Prevention (CDC) and the Agency for Toxic Substances and Disease Registry (ATSDR),” said Director of CDC and Administrator of ATSDR Robert R. Redfield, MD. “This virtual workshop with the National Academies is a welcomed opportunity to discuss and contribute to the growing body of knowledge on this topic.”

On October 26-27, the virtual public workshop will convene an independent panel of experts who will review federal agency research on human health implications of PFAS and identify potential research and data gaps. The workshop is free for those who wish to attend via webcast. Those who register will also have the opportunity to submit suggested research needs or data gaps for consideration as input to the workshop.

Following the workshop, NASEM will compile a report summarizing the discussion and views of workshop participants on how to ensure that the federal research program for PFAS is robust and focused on addressing the highest priority human health research.

AG Curtis Hill joins other AGs in issuing statement on elections, writes related op-ed

Attorney General Curtis Hill joined 35 other states’ attorneys general today in issuing a statement on this year’s general elections.

“Across the country and under circumstances both familiar and uncharted, election officials are working to ensure that every eligible citizen can vote and that every vote is counted,” the statement reads, in part. “America’s attorneys general are also working to ensure a free, fair, and secure election. As part of our duty to uphold the rule of law, we will take seriously any allegations of election interference, including voter fraud, voter intimidation and suppression.”

In an op-ed, Attorney General Hill contends that America’s leaders must work together to ensure that Election Day continues to be the day on which all votes are counted and results are announced.

“When all precincts report vote totals at about the same time, any vote counters tempted to cheat cannot know how many votes to add to which columns,” he writes. “But when results stagger in over days and weeks, cheaters know precisely where to manipulate results and by how much.”
