Illegal Kentucky Slot Parlors Now Have To Close Their Doors, Says Group

posted from The Family Foundation Website

JANUARY 21, 2021

LEXINGTON, KY – The Family Foundation welcomed the 6-0 decision* of the Kentucky Supreme Court today that turned down the petitions of the race tracks and the Kentucky Horse Racing Commission to rehear the ten-year case contesting the legality of so-called “historical horse racing” slot machines. The Court had ruled on Sept. 24 last Fall in a unanimous 7-0 decision that the machines did not meet the definition of parimutuel wagering and were therefore illegal.

The group says it fully expects the tracks and allies in state government to close the doors on the facilities. “The state’s horse racing tracks have been legally running from the law and the State Constitution for ten years while the regulatory agency overseeing them has looked the other way. Now they’ve run out of options.”

“This decision was something of a formality, since the Court rarely grants petitions to try a case over again,” said Martin Cothran, spokesman for The Family Foundation, the group that contested the legality of the machines. “And since this case spent ten years in the courts and the ruling was unanimous, it was even more likely the Court would turn them down.”

After engaging in discovery, The Family Foundation attorney, Stan Cave, argued that the so-called “historic horse racing” machines were really slot machines posing as parimutuel horse racing.

“The tracks have continued to operate after the September ruling knowing that their chances of getting the Court to change its mind was a shot in the dark. Now that the Court has fully finalized its decision – unanimously, the tracks have to shut down their illegal gaming parlors.”

Cothran criticized the tracks for operating the machines for ten years and taking over $800 million from Kentucky citizens unlawfully, even though they knew their legality was in doubt all along. “The race tracks have known all along that the legality of these machines was doubtful. That is why they petitioned the Franklin Circuit Court in 2010 to get its approval. It was only after that action that The Family Foundation asked and was permitted to intervene in the case in order to provide proper scrutiny and accountability.”

Evansville To Conduct Annual Point-in-Time Count Of Homelessness

• Provides snapshot of individuals experiencing homelessness in Evansville

  • • Conducted by the Aurora Outreach Team with support from area homeless shelters, agencies and other local partners
  • • Begins at 7:30 p.m. at CK Newsome Center, site this year of the White Flag Homeless Emergency Shelter operated by United Caring Services and Evansville Rescue Mission during freezing weather.

EVANSVILLE, Ind., January 27, 2021 – On January 27-28, 2021, Evansville will conduct its annual Point-in-Time (PIT) count of people experiencing homelessness in the community, including sheltered and unsheltered homeless men, women, children and families. Mandated by the U.S. Department of Housing and Urban Development (HUD), the count provides a snapshot of the number and characteristics of people experiencing homelessness in Evansville. The Aurora Homeless Outreach Team conducts the count with support from area homeless shelters and agencies, in conjunction with the Region 12 Homeless Services Council and Commission on Homelessness for Evansville and Vanderburgh County. The count will observe all mandated COVID-19 mask and social-distancing requirements.

WHO – Aurora Homeless Outreach Team and its Team Lead Natasha Goodge with four medical student scholars of the Southwest Indiana Area Health Education Center (Count of homeless who are unsheltered). Agencies participating include United Caring Services, Ozanam Family Shelter, House of Bread and Peace, Evansville Rescue Mission, YWCA Evansville, Salvation Army, and others (Count of all in-shelter homeless population). Other participants include Eric Biesel, ECHO Housing Case Manager, and Officer Josh Brewer, Evansville Police Department.

WHEN – The count begins Wednesday, January 27, 2021, at 7:30 p.m. at CK Newsome Center, and resumes and concludes the morning of Thursday, January 28, 2021. 2

WHERE – The count of those experiencing unsheltered homelessness will begin at the CK Newsome Center at 100 E. Walnut St in downtown Evansville, at 7:30 p.m. Since this location serves as the community’s White Flag Emergency Shelter this year, many of the individuals being counted will be indoors for the night at this facility. Once the count at CK Newsome Center concludes, Aurora’s Homeless Outreach Team will continue by car and on foot to check locations where they have observed homeless clients living (building steps, abandon homes, wooded areas, under bridges, etc.) to ensure these individuals are counted.

Onsite contacts are Natasha Goodge of Aurora and Krista Board of United Caring Services.

About the Point-in-Time Count

The annual point-in-time count is mandated by the U.S. Department of Housing and Urban Development (HUD) for communities receiving its funds for programs to aid people experiencing homelessness. The count includes sheltered and unsheltered people experiencing homelessness on a single night in January, including emergency shelters and transitional housing, as well as locations unfit for habitation. HUD aggregates the local data each year as a snapshot of homelessness nationally. HUD utilizes PIT data in its strategic planning for future programs to address homelessness.

About the Commission on Homelessness

The Commission on Homelessness for Evansville and Vanderburgh County was formed in 2005 to direct and facilitate the implementation of strategic actions to prevent and end homelessness locally. The Commission includes representatives of local non-profit and civic organizations, City and County government, the Evansville Vanderburgh School Corporation, the United Way of Southwestern Indiana, the Evansville Housing Authority, and homeless services and housing agencies, among others. Together, they provide leadership for local implementation of national programs and resources to address homelessness, including housing initiatives, coordinated entry and other community-wide homeless processes, homeless diversion and prevention programs. “IS IT TRUE” OCT 18, 2020 Casinos–Holcomb

0

We hope that today’s “IS IT TRUE” will provoke honest and open dialogue concerning issues that we, as responsible citizens of this community, need to address in a rational and responsible way?

IS IT TRUE yesterday the City-County Observer seemly scooped the local news media by revealing that Indiana Governor Eric Holcomb was the beneficiary of two flights on a private jet owned by Spectacle Entertainment’s CEO Rod Ratcliff? …yesterday an investigative article written by and published by the Indy Star revealed that Governor Holcomb’s political campaign may have been bankrolled when a casino CEO allegedly donated $500,000 plus to the Republican Governor’s Association and in turn most of this money was allegedly handed over to the political war chest to the Holcomb 2016 campaign? …the Associated Press and the Indiana Lawyer also published this outstanding investigative article written by Kaitlin Lange and Tony Cook of the Indianapolis Star?

IS IT TRUE that the above political donation that was given to Governor Eric Holcomb by the Republican Governor’s Association may turn out to be legal but it shouldn’t be and many people predict that it may become a political scandal that haunts Governor Holcomb for the rest of his political career?

IS IT TRUE attached is the link to the INDY STAR article we feel that you may find interesting?   http://bit.ly/2FHbJ2G

IS IT TRUE according to the Indy Star the Chairman and CEO of Spectacle Entertainment, Rod Ratcliff have contributed more than $1 million to the Republican Governors Association since 2016?   …the RGA became a financial lifeline for Indiana Governor Eric Holcomb in 2016 after his campaign got a late start and was then restricted from accessing the campaign funds of his predecessor, now-Vice President Mike Pence?

IS IT TRUE that “it’s a well-known fact that the Governor has final say over the plans to move two Gary casinos to more lucrative locations”?  …if the legislature eliminates the provision of Evansville receiving the $6 million dollars the Governor can veto the actions taken by the State Legislative body?Indiana Gaming Commission To Vote On Terre Haute Casino License Today

IS IT TRUE over the last several days we posted a “Readers Poll” that asked the question should THE CITY-COUNTY OBSERVER continue to publish their “IS IT TRUE” column? …we stated in last week’s ‘IS IT TRUE” column that unless there is a resounding public outcry for the “IS IT TRUE” column to be continued along with additional financial commitment (advertising) to support what it takes to do this column on a regular basis that this will be the last “IS IT TRUE”?  …a part of us wants to keep up the fight, but another part would like to live in peace without constant threats, disruption, and ostracism? …we urge you to go to today’s CCO “READERS POLL” and vote? …the fate of the City-County Observer “IS IT TRUE” is up to you?

IS IT TRUE our loyal readers and advertisers spoke in a resounding way and give us an unbelievable vote of confidence by a phenomenal 95% margin? …as of 10:30 last night, 841 people voted in this ‘Readers Poll”? …the “MOLE NATION” have spoken loud and clear?  …that 789 voted “YES”. 29 voted “NO” and 23 voted that they “Had No Idea”?

IS IT TRUE that a member of our staff went to the Civic Center to conduct some business?  …that Dottie Thomas, Chief Deputy Treasurer waited on him and she did a superb job in assisting him?  …Dottie Thomas was not only extremely professional but she knew her stuff?  …we need more people like her working at the Civic Center?

IS IT TRUE we are told by reliable sources that the renovations of the Westside Water and Treatment could use a little extra project management oversite help? …our sources tell us that they expect this project will go over budget and may not be finished in the time frame projected?
IS IT TRUE that for more than 15 years this column has served the City of Evansville and Vanderburgh County as the place to go to learn things that are going on in local government that other media is reluctant to cover?…much good has come from things posted in “IS IT TRUE” and the comment section has, for the most part, made the City-County Observer the go-to place for open constructive dialog?
IS IT TRUE that over the years this column has served the financial health of the taxpayers of Evansville well and we are proud to have done so?…as a reminder, one of the earliest breaking stories that the CCO profiled was when a former Mayor and his associates conspired secretly to eliminate the Homestead Tax Credit?…the CCO was alerted to this by one of our most trusted “MOLES” and we exposed this “SENEGAL” (Sneaky but Legal) meeting and the amount of money that the taxpayers of Vanderburgh County were about to be fleeced out of?…that number was $5 million per year which by now has amounted to $50 million that the CCO’s exposure of this sneaky dirty trick saved the taxpayers of Evansville?

IS IT TRUE that from drug addict needles in public playgrounds to potholes and from decrepit sewers to antiquated water pipes, exposing backroom political deals and government waste the CCO has been the watchdog for the people against ignorant and malignant local government actions?

IS IT TRUE that our finest hour, we exposed the Earthcare Energy project as a scam and saved an oblivious city council from handing $4 million to a project team that didn’t even have a patent they claimed to have?…through all of this we taught Evansville the meaning of the term VETTING?…we hope this is a lesson that is never forgotten?

IS IT TRUE that the Evansville city employees’ hospitalization fund has been insufficiently funded over several years? …the city’s hospitalization fund, from which city employee medical claims are paid, has had a negative balance of several millions of dollars over the last several years?  …we are now hearing that the city’s hospitalization fund will not be an issue in the proposed 2020 City budget? …all we can say is “very interesting?”

IS IT TRUE that the EPA has allowed the City of Evansville to pussyfoot around with the lead contamination issue in the Jacobsville area for over 20 years? …the real tragedy is that lead poisoning can be treated, but any damage caused by contaminated lead cannot be reversed? …we hope that before the City builds the new $28 million dollar Aqua Center at Garvin Park they will do extensive testing of possible lead contamination and toxic cleaning chemicals issues in the Garvin Park?

..this is an area of coverage that has been failing for a long long time whether it was bought and paid for reporting to promote a downtown arena being built and failing to even question the financial projections made by the consulting group that said the Ford Center would be cash flow positive from day one?…it is now about 3,500 days since the Ford Center opened and it still has not paid its own way from an operations perspective and it sure as heck has not made a single payment on the $127.5 Million loan floated to build it?…playing sycophant for the arena, the downtown hotel, the McCurdy, the ball parks, and even Robert’s Park was an abject failure in financial journalism?…that set of projects when the mainstream newspaper abdicated its responsibility to be cheerleaders for former Mayor Weinzapfel and current Mayor Winnecke destroyed the credibility built by a century or excellence?…the reality is that there is little of value remaining at the Courier and Press as reflected by the 63 cents share price of the parent company Gannett (GCI)?

IS IT TRUE that the 63 cent stock price at Monday bottom means that the entire Gannett Company with it’s 260 newspapers is only valued at $83 million all inclusive?…that this organization has a debt of over a billion dollars at 11.5% interest on a company that has a market cap of $83 million?…this does not bode well for future capital raises or paying off the debt?…the stark reality is that newspapers across the country are victims of large investment groups that have cut talent, alienated advertisers, and produced irrelevant biased narratives?…at this rate there may be no newspapers still in print in the United States in 10 years?…the value of the Gannett Company at this stock price divides out to just over $300,000 per newspaper?…these papers are to the point that there is little or no financial reason for them to exist?…the only things of value may be the archival records of the cities that have hosted them for over a century in many places?…the historical record of pictures, old articles and columns are worth more than the zero dollars that the day to day operations are cash flowing?…if you think fake news and biased posts are a problem now, just wait until there is no news at all?…we are nearly at that point?
IS IT TRUE we are hearing rumors that the new Gannett publishing Corp. may be considering selling off some of their less financially productive publications?  …if this happens, we are told that a group of local well-heeled and business savvy investors may be interested in salvaging the once proud and powerful Evansville Courier and Press at the scaled value of the paper? …we are told that this investment group has the creative and marketing experiences, literary and business skills to run the Evansville Courier and Press like it hasn’t been run in many years?  …we are also told if this group is successful in purchasing the Evansville Courier and Press the days of offering daily printed newspapers will cease except for offering an outstanding non-partisan and unbiased Sunday community newspaper at an affordable price?  …we are also told that the time and energy of this group will provide current daily news on the internet at no cost to the subscribers?  …we are told if this group of investors are successful they will put together an outstanding editorial board made up of literary authors with a newspaper background, well-known (male and female) entrepreneurs, known community leaders, a local banker and attorney and the former Editor of the City-County Observer Joe Wallace?
IS IT TRUE that allowing public employees to be able to retire at full or near full pay when the private taxpayers who toil to pay the taxes that cover their pensions is a situation that may not be tolerated for much longer?.
IS IT TRUE that allowing public employees to be able to retire at full or near full pay when the private taxpayers who toil to pay the taxes that cover their pensions is a situation that may not be tolerated for much longer?
IS IT TRUE  several years ago a group of American veterans who deal with some of the most debilitating mental anguish has called upon the State of Indiana to legalize medicinal marijuana? …some Veterans feel that legalizing medicinal marijuana and decriminalizing small amounts may just cut back on the overcrowding problem at the Vanderburgh County jail and VA hospitals ?…the veterans group also feel that putting someone who possessed a small amount of marijuana in jail at $50,000 per year cost to the taxpayers is bordering on insane?
IS IT TRUE that the City of Evansville will raise our taxes in 2020?…we wonder how on earth can a city that has ZERO population growth and minimal wage growth feel that they can collect more tax money from its huddled masses than it did the year before?
IS IT TRUE that a late great professor from the University of Evansville once said, “come to the revolution all of this $%#! will cease?”…the obsession with fun and game spending is what has led the sheep to this unsustainable abyss?
IS IT TRUE we are told that several patrons of Ellis Park are hoping that the new owners of Ellis Park (Saratoga Gaming of New York) will invest the money to professional pave the parking lot, install proper exterior security lighting and signage, install a first-class exterior digital on-premise sign located next to the highway? … they also are hoping that the new owners will also decide to update the interior decor, remodeled the restrooms, correct the issues with the heating and air conditioning, fix the leaking roof and damaged ceiling tiles in the main Club House building and the Sky Theater area?  …a couple of patrons also told us that is would very easy for Ellis to round all the old that artifacts in storage and laying around the historical track to create a ‘Horse Racing Museum?”  …if done correctly this ‘Horse Racing Museum” would attract new visitors to visit Ellis Park?

Eagles jump three spots to No. 11 in latest poll

0

University of Southern Indiana Women’s Basketball moved up three spots to No. 11 in the latest Division II Top 25 Media Poll, presented by D2SIDA.

The Screaming Eagles (9-1, 9-1 GLVC), who have won four straight games, went 2-0 last week to make their case for the rise in the poll. This week’s ranking, like last week’s, is the highest the Eagles have been ranked since they were No. 9 in the Division II Media Poll on February 20, 2018.

USI was joined in the national rankings by fellow Great Lakes Valley Conference member Drury University, who continued to hold its No. 1 ranking. Truman State University, the Eagles opponent Saturday, is receiving votes.

Other schools from the Midwest Region include No. 15 Grand Valley State University (GLIAC) and No. 23 Cedarville University (GMAC).

The Eagles return to action Thursday at 5:15 p.m. when they host Quincy University in a 5:15 p.m. contest at Screaming Eagles Arena. Thursday’s bout is USI’s Play4Kay game.

How to Watch
While fans are not permitted to attend the games, they can watch free of charge on the GLVC Sports Network, which is available both you’re your desktop, mobile/tablet devices, as well as four over-the-top (OTT) platforms, including Roku, Amazon Fire TV, Android TV and Apple TV (4th Generation). GLVCSN.com is the official website of the GLVC Sports Network, while the GLVCSN mobile app is available for iOS in the App Store and Android on Google Play. Apple users also can use AirPlay with their Apple TV or some of the newer smart TVs. (GLVCSN FAQs)

Updated USI Women’s Basketball Notes (1/27/21)
• USI to Play4Kay Thursday.
USI Women’s Basketball was in their pink uniforms Tuesday and will be in their pink uniforms, once again, Thursday when it “Plays4Kay”. The Play4Kay, which has been called Think Pink, Paint it Pink, Pink Zone, Pink Game and Pink Out, is associated with the Kay Yow Cancer Fund and has six elements to unite all coaches and teams participating in order to brand a united front across the country. The Play4Kay dates are February 10-20, but coaches also have the option to choose their most marketable date. Hall of Fame Coach Kay Yow, who battled cancer for 22 years, was the coach at North Carolina State from 1975-2009, earning more than 700 career wins. She passed away in January 2009.

• Eagles start long week with win over UIndy. USI Women’s Basketball began its three-game homestand this week with a 56-51 win over Indianapolis Tuesday evening. Senior guard Emma DeHart had a game-high tying 15 points, including 13 in the second half and nine in the fourth quarter, to pace the Eagles. Sophomore guard Addy Blackwell added 14 points, draining three shots from downtown, and finished with four steals, while sophomore forward Hannah Haithcock contributed 10 points, nine rebounds and three blocks.

• USI returns to court with two road wins. The Eagles returned to the court last week with a pair of GLVC road wins after having their previous three games postponed due to COVID-19 concerns. The Eagles began the week with a 64-59 win over Lewis Thursday before bettering Illinois Springfield, 77-71, Saturday.

• Last week’s leaders. Haithcock and fellow sophomore forward Tara Robbe averaged 16.5 and 11.5 points per game, respectively, to lead the Eagles, while Robbe added a team-high 6.0 rebounds per contest. USI had five players with 8.0 points per game or better, with Blackwell and senior guard Ashley Hunter each contributing 9.0 points per game. DeHart added 8.0 points per game and matched Blackwell with a team-high 3.5 assists per contest, while Blackwell and senior center Audrey Turner respectively led the Eagles with 2.5 steals and 1.5 blocks per game.

• USI moves up three spots in national poll. The Eagles jumped three spots to No. 11 in this week’s D2SIDA Top 25 Media Poll. The WBCA Top 25 is set to debut February 2. This week’s ranking, once again, is the highest for the Eagles since they were ranked No. 9 in Division II Media Poll February 20, 2018.

• GLVC Point Ratings System. The Eagles are currently second in the latest GLVC Point Ratings System (PRS) rankings, which determine the eight teams that will compete in the GLVC Tournament in March. The Eagles have a rating of 4.45, trailing only undefeated Drury (4.81). Truman State (4.41) is close behind USI, while Lewis (3.61) and Missouri-St. Louis (3.38) round out the top five teams. Lindenwood (3.25), Maryville (3.15) and Rockhurst (3.06) round out the top eight teams.

• Season leaders. DeHart leads USI with 14.9 points and 3.3 assists per game, while Haithcock is averaging 11.2 points and a team-high 6.8 rebounds per contest. Blackwell is contributing 9.8 points and a team-high 2.0 steals per outing, while Hunter is adding 7.8 points, 4.0 rebounds, 2.3 assists and 1.6 steals per appearance. Turner leads USI with 1.2 blocks per contest.

• Roaring 20s. Senior guard Emma DeHart has reached the 20-point plateau three times this year after entering the year with one career 20-point game. USI had five different players reach the 20-point plateau a year ago, including DeHart and sophomore forwards Tara Robbe and Hannah Haithcock.

• Double-figures. USI has had nine different players reach double-figures in the scoring column this year, with six players having had 10 or more points in multiple games.

• About Quincy. The Hawks’ 68-63 win over McKendree Saturday was their first of the year as they enter Screaming Eagles Arena with a 1-10 overall mark, 1-10 GLVC. Sophomore guard Laney Lantz averages 17.4 points per game to lead Quincy, while freshman guard Jazzpher Evans is contributing 13.4 points per appearance. Sophomore forward Marta Rivera leads Quincy with 5.6 rebounds per outing.

• Last year. Senior guard Ashley Johnson and then-sophomore forward Ashlynn Brown each scored 12 points, while Haithcock added 10 points for USI, which defeated Quincy, 65-41, last year at Screaming Eagles Arena. The Eagles held a 37-23 lead at the intermission before outscoring Quincy 18-5 in the third quarter to put the game away. Alexa Low had eight points and nine rebounds to lead Quincy.

• About Truman. With nearly four players averaging in double-figures, sophomore guard Hannah Belanger and senior forward Katie Jaseckas are averaging 18.5 and 16.3 points per game, respectively, to lead the Bulldogs, who are 9-2 overall and 9-2 in GLVC play following a 51-46 win over William Jewell Saturday. Jaseckas also is averaging 8.7 rebounds per game, trailing sophomore forward Ellie Weltha (9.9 ppg/9.4 rpg) for the team lead, while senior guard Tiffany Davenport is dishing out a team-high 6.4 assists per game for Truman, which visits McKendree Thursday evening.

• Last meeting. USI overcame a 19-point first-quarter deficit and 13-point fourth-quarter deficit to defeat the Bulldogs, 83-78, earlier this month in Kirksville, Missouri. Brown had a career-high 17 points to lead the Eagles, whose bench outscored Truman’s reserves 38-9. Belanger had 25 points to pace the Bulldogs, who also go 22 points from junior guard Katey Klucking.

• Record book watch. The Eagles have one player making moves inside the USI Women’s Basketball Record Books:
–Emma DeHart has jumped 14 spots to No. 29 all-time at USI with 797 career points. She began the year ranked No. 43 but has made the big jump during the first 10 games of the year thanks to a strong start. DeHart is six points away from matching Jennifer Donner for 29th and 21 points away from entering the top 25 all-time at USI.

• Magic Mark: 75 points. The Eagles are 422-77 (.846) all-time when scoring at least 75 points. USI is 295-28 (.913) since 1996-97 when reaching the 75-point plateau.
