Attached below are the legal documents of the George Music Trust legal documents.  Please see question 4 in paragraph 4 on page 3 dated November  2, 1973 entitled Report of Trustee.
It looks like the Board Of Trustees improved the ability of the Mesker Trust to enhance Mesker Park Amphitheater. Â Its also interesting that the Mesker Park had in the excess of $350,000 valued on a cost basis back in 1973.

Little was there with his hand out. Two others representing the Civic Theatre were there too. I guess once they opened that Trust up, telling the court what George Mesker really meant, Little & his cohorts couldn’t shake enough out of it to keep them happy. That has apparently resulted, lo these many years later, in an Engberian demand for an apology.
I demand a retraction and apology from Dick Engbers. He needs to own up to not knowing what he was talking about or deliberately misleading people, whichever it is.
Great find by the CCO! Back in 1973 the Trustees at request of the Court found the public representatives overwhelmingly desired the Trust income be used to improve or enhance Mesker Park Amphitheater. That sure sounds like maintenance, repairs and improvements. From the recent Trust tax returns it doesn’t appear that ever happened. Was there ever a committee appointed to direct the Trustees on how to spend the income? Why also was the Trust distributing funds to music groups in Mt. Vernon, In?

It still seems that the performance of this trust has been dismal. What’s it invest in, Social Security?
It looks like this Trust has been violated by a whole string of Mayors and now Winnecke is the one that is going to do the last of the dirty work.
I wonder why the Courier hasn’t put this link up.

Bayard park has a trust like this also. It was left by Hattie Bayard To maintain the park and the flower beds she had planted there at that time. I believe the city changed it around the same time. Don’t know where the money is now.
