BREAKING NEWS: City Council’s Attorney Danks Gives Opinion On Ordinance-Residency Requirements

    Dear Council Members,

    As you may know, Indiana statute already requires that members of many of our boards/commissions be residents of the City of Evansville. It appears that these statutes have been overlooked in the past and that some of our boards/commissions have members that are not residents of the city and are therefore serving in contravention of Indiana law.

    Other statutes concerning various boards/commissions are more expansive in that they allow members to be residents of the county. This does not prohibit the Council from enacting the proposed ordinance further restricting residency requirements to being a resident of the City of Evansville.

    Concerning interlocal agreements (city/county agencies), this ordinance will not prohibit residents of the county from being appointed to their boards/commissions so long as the appointments are made by the County and NOT the Mayor or City Council.

    1. RE: Article headline. Not trying to be a Grammar Queen but I don’t think we have multiple City Councils. One is enough. I believe you meant to use the possessive form of the word (Council’s) instead of the plural form (Councils).

        p.s., I understand there are several former Courier & Pravda Copy Editors looking for employment. Now that the C&P only employs undergraduate interns to produce verbiage and provide editorial content you should be able to “staff up” on the cheap.

    2. Does anybody know if Steve Schaeffer’s divorce went through on Friday? Will he still be vice president of the Indiana Focus on the Family? I don’t figure that James Dodson likes divorces.

      • They’re fine with divorce, just don’t be a homosexual. They take their marching orders from fat drug addict 4 time divorcee Rush Limbaugh. He’s a good representative for the family values party.

      • Interesting that Missy has so many constituents expressing dissatisfaction with the Home Rule ordinance while Dr. Adams, the at-large member indicated the opposite….Oh, I forgot, Dr. Adams does not work for the Mayor’s wife…of course the Mayor was sitting in Room 303 leading from BEHIND…

        • So many times the individual who supports the Mayor, i.e. campaign donations or hustles the campaign dollars finds themselves on a board, not any board, but the ones that spend our money….case in point, Mr. Hafer, then president of the ERC, one of the hustlers and contributors, directs one of the most expensive extravaganzas in the history of Evansville, not to mentions the bits and pieces in the background. Sat the pins up then resigns from the ERC with bowling ball in hand…and, of course, we have Mr. Russell, union boss sitting on the MOST important board, the Utility Board, been there for years and present when the Johnson Control deal was inked, the contract that places 5,000 customers in peril with those damned meter installs, but he delivered the temp jobs to his union buddies while we hope the KY jelly is available!!!

          • According the Dec 13th CP article, indicating that BIG LABOR is going to support their MAN (a/k/a Little Dog Winnecke) who will be, at the expense of the taxpayer/ratepayer giving them jobs at any cost and, of course, his crony capitalist…too bad Mr. Russell must retire from the utility board, but, we all can be assured that BIG LABOR will be inviting Little Dog this vary morning for “the replacement”….lottery, my bit, Mr. Green, or Mr. Biard, or Mr. Hidgon, or Mr. McNeely…make sure they live in the city, now….

            • The union rank and file better hope that Mrs Riecken does not hold grudges and keeps on fighting for our working families….Mr. Winnecke’s republican party is hell bent on eliminating the prevailing wage in Indiana while Little Dog, as you probably coined correctly, keeps delivering the rank and files’ money to Pence…with that said, who guys better take up Spanish courses at the local universities….suckers!!

    4. I noticed that the attorney for the city council made no mention of the possibility that votes cast by these illegal council members may have been critical to the outcome of some resolution, and if that did happen, whether such resolutions or other actions must be revisited.

        • This ordinance applies to commission and board members ,not city employees and mr Danks is employed by the city

          • That is true! Then again, one could ask what is the difference being appointed, verses being employed by the city and not being a resident doing these type of administration actions? Maybe just splitting hairs?

            • Seems the line had been drawn for years. It is just of late that a few want to shift that line around some other direction to meet a new agenda. Possible adding a “new angle” of reasoning to merge local government, along with the reason that city government may be broke and need to be bailed out? Time will tell!

            • Not exactly true, State Law bars terminating muni employees who live outside the governmental unit which employs them. For years, Mr. Fithian, the head of City Personnel has lived in Newburgh…the city has police officers who drive city squad cars back and forward from Newburgh were they reside…

    5. If Mr. Danks furnished this letter to CCO, he is to be commended for his openness. I just doubt that he did that, though.
