The EPD internal investigation into the April 22nd Officer involved Shooting of a man armed with two knives has been completed. The actions of the officers involved have been determined to be reasonable based on the facts of the case.
Officers David M Smith and Aaron McCormick were dispatched to 2039 Pollack for a harassment report. Just prior to their arrival, they were told that the suspect was at the house and had two knives. When the officer arrived they saw Terry Daugherty outside of the house. Daugherty fled from the officers and told them they would have to shoot him. As he was running, Daugherty took the protective sheaves off of the large knives and refused to drop the knives.
Daugherty attempted to get into 2045 Margybeth , but was unsuccessful. The officers were able to contain him in the driveway and repeatedly told Daugherty to drop the knives. Daugherty refused to drop the knives or surrender. Officer Smith fired two rounds from his handgun. Daugherty was struck once and then dropped the knives as we went down to the ground.
Daugherty was treated at the scene for a single gunshot would. He is currently at a local hospital under police guard.
Daugherty had been arrested for Strangulation and Domestic Violence against the same caller on April 16. After his release from jail on bond, Daugherty was admitted to a local hospital for a after he tried to commit suicide by cutting his wrist. After those incidents, he told family members he would not go back to jail. He also made statements the day of the shooting that he was going to die when the police got there.
Based on his actions, his history, and his comments before and immediately after being shot, investigators believe Daugherty was trying to commit suicide by cop.
Both officers have returned to full duty.
Why do we even pay for them to have tazers then? Just to mess with some smartass kids if they don’t feel like killing anybody that particular night? Seems like our local barney fifes are pretty quick on the draw like the west side known mental patient with a hammer who was 35 yds away from them and tossed a damn hammer at them. Of course the token investigation revealed no wrongdoing.
The incident you refer to is one of the worst I’ve known of in this vicinity, and I don’t think anyone was even “written up” on it. On the other hand, domestic violence runs are the most dangerous kind an officer can make, but I’d have to see the recording of this incident to make a judgement.
Like my ex-policeman, ex-husband used to say, “We have the police to protect us from criminals, but who’s going to protect us from the police?” We have some good officers, but it only takes one bad one to be a big, big problem.
Let us see the body cam video, we paid for it. It was much ballyhooed as a way to protect the officers and citizens. Best I remember the last shooting by the EPD, a couple of weeks ago, the shooter didn’t have it turned on. Convenient.
I’m not seeing any real reason to shoot this guy and try to kill him. ‘Suicide by cop’ has been abused and overused by police departments to justify bad shootings. This guy needed help when he cut his wrists. Doesn’t sound to me like the officer’s or others lives were in immediate danger. A judge heard about his ‘strangulation and attempted domestic violence’ and let him out of jail. Maybe it wasn’t as bad as the police affidavit read.

Exactly!! Anytime a shooting by an officer takes place, the body cam info should be posted on line for everyone to see. If there isn’t any video, the shooter better hope there are plenty of impartial eye witnesses to testify in his/her behalf, during a thorough investigation. I don’t think it is out of line to make a shooting that isn’t cleared by a video a matter for a Grand Jury.
Did the very trusting cliché Phoenix slip his bonds and venture from low level political smooching into shootery presumption? The anger, if not a giveaway, is close.
Wow a lot of angry people posting here. I would like to believe that the officers are right in doing what they did. I trust them just like I trust a doctor performing surgery on me or a family member. I dont ask the doctor for references or show me a video of his last surgery so that I can review it. Just because I watch every epidose of ER or Emergency or General Hospital etc… I would be qualified to say the doctor did a surgery right or wrong. I know that If I was trained to use a gun and a man with a knife approached me I would shoot. I rather be tried by 12 than carried by 6.
