THE UNITED STATES COURT OF APPEALS FOR THE SEVENTH CIRCUIT COURT RULING AGAINST EPD CHIEF BILLY BOLIN LACK OF INDIVIDUAL CAPACITY.

ATTACHED BELOW IS AN INSERT OF THE JUDGES RULING AGAINST THE EPD POLICE CHIEGF BILLY BOLIN!

Precipitate use of flash bangs to launch a search has troubled us before, leading us to declare that “the use of a flash bang grenade is reasonable only when there is a dangerous suspect and a dangerous entry point for the police, when the police have checked to see if innocent individuals are around before deploying the device, when the police have visually inspected the area where the device will be used and when the police carry a fire extinguisher.” Estate of Es- cobedo v. Bender, supra, 600 F.3d at 784–85. The police in this case flunked the test just quoted. True, they’d brought a fire extinguisher with them—but, as if in tribute to Mack Sennett’s Keystone Cops, they left it in their armored SWAT vechicle.

So while the defendants are correct to point out that a reasonable mistake committed by police in the execution of a search is shielded from liability by the doctrine of qualified immunity, Anderson v. Creighton, 483 U.S. 635, 641 (1987), in this case the Evansville police committed too many mistakes to pass the test of reasonableness.

  1. A competent Chief of Police would not do many of the things we’ve seen out of Bolin, and a competent mayor would not have appointed Bolin. An even remotely competent mayor would have fired Bolin within a week of the Milan fiasco.

    • Winnie is dirty AND incompetent. I’m guessing Bolin has “the goods” on Winnie and he can’t fire him.

Rambo Bolin & Company a/k/a referred to as the Keystone Kops per the United States Seventh Circuit has placed Evansville in the column of RED NECK cities in the US and why is Bolin still the Chief of Police . . well it is the culture of Winnecke . . .he will NEVER omit a mistake and only will take credit concerning positive issues . . for instances, when the payroll checks were not issued a week ago yesterday he told the FOP that was Russ Lloyd’s deal . . . what a A-Hole . . four more years of this horsesh…..t WOW . ..

  2. So much for the city’s attempt to get a summary judgment in the Milan case.

    Winnecke’s administration continues to infuriate the 7th Circuit. It started with the attempted Cross March. It continues on. Those responsible will not have to pay the huge legal bills that accrue with federal litigation, the financial liability falls to us. Winnecke appealed the district judge’s ruling to try get this put off until after the election. The appellate judges apparently saw through that ruse and issued their ruling in a timely manner.

    Look for Winnie to settle now. I don’t think they can afford to let this go to trial.

    • I look for the announcement of a “confidential agreement” very soon. Winnie won’t want us to know how much his bad choice for Chief of Police cost us.

What the hell do you expect . . . go back to the selection process remember that past Mayors would form a committee consisting of business, education, and FOP . . and in the process the Chief of Police one of the most important position in City Government would be determined . . .no not under Santa Lloyd . . he chooses basis on how much money an individual raised for him in the election and one with a GED degree at that. . .and during the last Council meeting the dude from Ziemer’s firm said we do not have five law suits but SEVEN concerning violations of peoples’ civil rights . .IT IS TIME FOR SANTA LLOYD AND HIS ELF CHIEF BELLY BOLIN TO GO!!!!
