We hope that today’s “IS IT TRUE” will provoke honest and open dialogue concerning issues that we, as responsible citizens of this community, need to address in a rational and responsible way?

IS IT TRUE that the floods of February 2018 are expected to crest today at levels that have not been seen since the big flood of 1997?…the age of drones has made many pictures available that never have been and the extent of the water is devastating?…for the first time many of us have seen the locks at Newburgh’s dam completely submerged?…the last time this happened an old outhouse floated up and was deposited right next to the Riverwalk in downtown Newburgh?…we had better hope that a big freeze does not happen as that will wreak havoc in all areas of the Tri-State?…we encourage our readers to be very careful in dealing with the flood waters?

IS IT TRUE the organization of CAJE (Congregation Acting for Justice and Empowerment) worked jointly with Aurora to advocate for a new caseworker position at Aurora last year?  …we commend Vanderburgh County Commissioners Ben Shoulders, Cheryl Musgrave and Bruce Ungethiem for continuing to work with both CAJE and Aurora to find funding for this much-needed position?

IS IT TRUE that the company that owns the Evansville Courier and Press is a nationwide conglomerate called Gannet?…Mole #3 tells the City-County Observer that Gannet has  recently sold the building that the Courier and Press has been in for many years to a New York-based real estate investment company and that much of the building will be refurbished and leased out as offices?…that the remaining space will be leased by the Courier and Press for offices?…Mole #3 says the Courier and Press in print circulation have continued to decline over the years?…that our mole also says that Gannet is planning to convert the Courier Press into a successful digital platform? …we hope if the Courier and Press decide to take this route that it will generate sufficient advertising dollars to support this kind of news operation?  …we also hope that the Courier and Press will continue to print the news on a daily basis?  …if Mole #3 is correct we hope that the majority of the Courier and Press staff will remain intact because they have some outstanding writers in their employment?

IS IT TRUE at Monday evening City Council meeting our “First Amendment Rights” took a step backward?  …that the Council voted 6-3 to keep the “3 Minutes Censorship Rule” that was created by the former City Council President Missy Mosby (D)? …at Mondays Council meeting the current Council President Jim Brinkmeyer (D) decided to keep this rule intact?  …we are told that Missy Mosby (D), Jim Brinkmeyer (D), Dan McGinn (I), Michelle Mercer (R), Jonathan Weaver (D), Dr. Dan Adams better get ready to vigorously defend why they felt compelled to continue to limit our freedom of speech during the next city election?

IS IT TRUE that the Ohio Valley Conference Basketball Tournament is poised to start action at the Ford Center this week?…this is a curious choice by the league as the closest member of the OVC is more than a hundred miles from Evansville?…there will be no such thing as a home game for any of the teams and the only team with any sort of alumni base in greater Evansville is the Murray State Racers?…the Ford Center is sort of centrally located with respect to where these teams are from an east/west perspective but when north/south locations are considered the center of mass for these campuses is way further south?…this tournament has traditionally been played in Nashville, TN where one team is located and two others are within an hour’s drive?…the attendance count for this tournament will be interesting to see as the last time a tournament with no home team came to Evansville, the attendance was only in the hundreds in an arena

IS IT TRUE last week The Indiana Utility Regulatory Commission (IURC) Nominating Committee submitted three nominees for consideration by Governor Eric J. Holcomb for appointment to the Indiana Utility Regulatory Commission?  …those three nominees are: Stefanie Krevda, IURC Executive Director of External Affairs,  State Rep. David Ober and Tristan Vance, Indiana Office of Energy Development Director?  …the committee has nominated these three candidates to fill the current vacancy on the IURC created by the retirement of Commissioner Jim Atterholt? … Gov. Holcomb will select one of the three nominees to serve the remainder of Atterholt’s term, which expires Jan. 31, 2020?  …we are puzzled why one of the finalists wasn’t from this area?

IS IT TRUE that it was reported Tuesday afternoon that a gas leak was reported at 3rd and Locust streets in downtown Evansville very close to the City of Evansville parking garage that is not worth the current encumbered debt?…the financial analysis of the value of the dilapidated garage has not changed?…any astute business person will require a payment from the City of at least $500,000 to assume all of the repairs and obligations that come from owning a neglected parking structure? …this is a great example of the shortfalls of a TIF project?

Bill Legalizing CBD Oil Passes House

FEBRUARY 27TH, 2018  BRITNEY TAYLOR INDIANA

 A bill that would allow the sale of CBD oil with low THC levels unanimously passes the House Tuesday. Senate Bill 52 passed 93-0.

This bill would allow Hoosiers to buy CBD oil that contains no more than 0.3 percent of THC, and no other controlled substances.

CBD, or cannabidiol, is a non-psychoactive derivative of the cannabis plant. CBD oil has been shown to help with various medical conditions such as cancer, epilepsy, and severe pain.

The oil would be available for purchase over-the-counter from retailers across the state.

The Senate passed a similar bill on February 5th, 35-13. A conference committee will convene to work out a few differences between the two versions before heading to Governor Eric Holcomb’s desk.

This bill is authored by Senator Jim Tomes and co-sponsored by Representative Wendy McNamara.

Civil Forfeiture Reform Passes General Assembly

A bill to reform many aspects of Indiana’s civil forfeiture proceedings is headed to Gov. Eric Holcomb after receiving unanimous support on final passage from the House of Representatives on Monday.

Senate Bill 99 sailed through each committee and chamber that heard it without opposition or amendment. The bill, authored by Sen. Rod Bray, R-Martinsville, was designed to increase due process protections for property owners whose property is seized as part of a civil forfeiture action.

Among the most significant changes SB 99 makes is its requirement for a court to find probable cause to support a property seizure within seven days of law enforcement seizing the property. The bill also builds in hardship provisions for “innocent owners,” or people who lend their property to someone else without knowing it will be used for illegal purposes.

The common example of an innocent owner hardship given during discussion of SB 99 has been seizure of “grandma’s car” — that is, a grandmother lends her vehicle to a grandchild, who engages in illegal activity resulting in the car’s seizure. Referencing those situations prior to Monday’s House vote, Evansville Democrat Ryan Hatfield said depriving a grandmother of her property could create hardships for her family — such as a loss of transportation or property kept in a seized vehicle — even though she had nothing to do with illegal activity.

“I think even the prosecutors acknowledge that too often we’re holding too much property that probably doesn’t have much to do with the crime that’s alleged, and we’re holding it for too long and it’s really placing a burden on these families,” Hatfield told the House. “So for those purposes, I think we’re headed in the right direction.”

But Rep. Matt Pierce, D-Bloomington, reminded his colleagues of an issue that has been a frequent sticking point in civil forfeiture reform discussions — how forfeiture proceeds should be disbursed.

 The bill provides for a disbursement mechanism that begins with attorney fees, trickles down to prosecutors’ offices and law enforcement, and ends with all remaining funds going into the Common School Fund. However, Article 8, Section 2 of the Indiana Constitution requires all forfeiture proceeds to be deposited into the Common School Fund, a constitutional mandate Pierce said the General Assembly cannot get around.

“It doesn’t say ‘after expenses,’” Pierce said. “So what we’re really trying to do with this bill … is hope that if we say it’s reimbursement of expenses that the courts will let us get away with not putting it in the Common School Fund, which the Constitution says we ought to do in the first place. So we need to deal with that issue at some point.”

The constitutional question Pierce raised is the subject of a Marion County lawsuit brought by the Institute for Justice, Jeana M. Horner, et al. v. Terry R. Curry, et al., 49D06-1602-PL-004804, which is scheduled for a summary judgment hearing on March 16. Despite those concerns, Pierce voted in favor of SB 99 because he said it resolves the due process shortcomings that were identified in part of Indiana’s civil forfeiture framework that was struck down in Leroy Washington v. Marion County Prosecutor, et al., 1:16-cv-02980.

A spokeswoman for Holcomb said civil forfeiture reform is not part of the governor’s agenda, but he will “consider it carefully” before deciding whether to sign SB 99 into law.

Dirty Campaign Tricks-The Civil War Within the GOP Plays Out in Indiana’s 8th Congressional District

JASPER, IN: The decision by Congressman Larry Bucshon to appear at my speech last week at the Vanderburgh County monthly Saturday morning breakfast, heckle me, accuse me of lying, and then accost me physically and verbally afterward reflects not just his own deficiencies and aggressive tendencies but that of the GOP Washington establishment. For years, the Republican National Committee and others such as Senate Majority Leader Mitch McConnell have spent millions trashing conservative candidates they don’t approve of in primaries (ask Ted Cruz, Marco Rubio, Marlin Stutzman, and many others). It’s their stock in trade.

That Congressman Bucshon threatened to attack me over domestic abuse allegations, the same story published 2 years ago, 2 weeks before the primary in 2016, already responded to by my wife in two Evansville newspapers, is also standard operating procedure. This story was a misunderstanding from 25 years ago. I am still married to my wife and we have four wonderful and accomplished children. Yet, Congressman Bucshon threatened to raise it again. I suspect, but cannot prove, that he leaked it the first time to the Evansville Courier Press in 2016 – and throughout the 8th district because I encountered the smear far and wide, as far north as rural Vermillion and Parke Counties, and everywhere else. Was it more GOP Establishment dirty campaign tricks channeled through the Bucshon campaign?

But this is how the Washington GOP Establishment plays it with movement conservatives in primaries. The last thing they want is someone like me who will not play ball with them, and who actively seeks to break the power of Washington, that citadel of corruption, with its armies of lobbyists, consultants, crony capitalists, and special interests. The last thing they want is someone who wants to disperse power back to the states, local communities, and individuals as befits our constitutional and federal system and away from DC and the entrenched political class.

It is not Iran, ISIS, Russia, or China that threatens this country. It is Washington DC and its one party system of career politicians from both parties who go to Washington, cut deals, grow the size of government and bankrupt our children – thinking only of the next election and not the next generation.

I criticized Bucshon for moving his family to Washington and becoming a typical Beltway politician. It was an Evan Bayh move. Is he eying his next job as a lobbyist? Does he prefer Washington insiders and assorted fat cats to Hoosiers? He deserves to be challenged on it.
He has a liberal voting record, a rating of 52%, an F, according to Heritage Action, a conservative think tank. He is well below the House Republican average and the most liberal Republican in Indiana. Like so many Establishment Republicans, he campaigns one way and votes another. He is a reliable tool of Republican leadership. He will not advance conservative policies. His votes have funded sanctuary cities, amnesty, DACA, Obamacare, the EPA, Planned Parenthood, importing more Syrian Muslim “Refugees,” along with huge deficit spending, all the things he claims he’s against. He’s not a conservative, he’s a liberal, a status quo, Country Club Establishment Republican living in Washington DC.
There is a civil war within the Republican Party and it plays out here in Indiana’s 8th district. The Republican Party claims to be a conservative party, but it is not. It is a big government, big-spending, liberal, progressive party. Conservatives do not have a home in this party. Establishment Republicans scorn their conservative base, the grassroots activists that go out and win it historic election victories only to see its successes squandered as Republicans pursue a big government agenda, working hand in glove with Democrats.
We must reform the Republican Party and make it a true political vehicle for conservative policies and philosophy, an honest to God, hard hitting, passionate and principled conservative party that will make its case before the American people, prevail in the battle of ideas, win the debate, and advance a liberty, limited-government agenda – if we have any hope of restoring America to greatness.

The only time is now, during the primary. We must send a message back to Washington by draining the swamp right here in Indiana’s 8th congressional district, by retiring Congressman “Sell Out” Bucshon and his dirty campaign tricks and fake news.
I will continue to press the issues that are important to the people of Indiana’s 8th district. I also pledge that if elected, I will live, work, and raise my family in Indiana’s 8th Congressional district.

Attorney General Curtis Hill Seeks Reinstatement Of Death Sentence For Killer

Attorney General Curtis Hill announced today he is asking the U.S. Seventh Circuit Court of Appeals to reinstate a death sentence in the case of a man who brutally killed a young mother and her 4-year-old daughter.

On February 24, 2004, Frederick Baer randomly selected his victim, Cory Clark, after seeing her outside her home near Lapel, Indiana, in Madison County. He first connived to get her to go into her home by asking to use a phone. After she went inside, Baer followed and initially attempted to rape her. After Cory’s young daughter saw Baer slitting her mother’s throat, Baer chased down the child as she ran to her bedroom, caught her and slashed the child’s throat, nearly decapitating her. After killing his victims, Baer took money from Cory’s purse, collected some decorative rocks as souvenirs and then drove to his job at a construction site. He told co-workers he was late because he had gotten lost before handing one crew member some cash and asking that co-worker to go buy him hamburgers.

After being convicted of murder, attempted rape and theft, Baer was sentenced to death. His convictions and sentence were twice affirmed by the Indiana Supreme Court, and a federal district court denied Baer’s request for habeas corpus. Later, however, a three-judge panel from the U.S. Seventh Circuit Court of Appeals ruled that Baer was entitled to habeas relief in the form of a new penalty phase of his trial – effectively sending the case back to Madison Circuit Court for a redo of sentencing.

The panel found that instructions to jury members may have precluded consideration of methamphetamine use as possible grounds for a lighter sentence. The panel also stated that trial attorneys representing Baer failed to object to improper comments by the prosecuting attorney.

In his petition for an en banc rehearing of the matter – asking the full court to consider the three-judge panel’s ruling — Attorney General Hill noted both that the Indiana Supreme Court rejected Baer’s claims of error in accord with federal law and that Indiana should be allowed to impose the judgment of jury and judge.

”No one disputes the fact that this man is guilty of the heinous crimes for which a jury convicted him,” Attorney General Hill said. “The U.S. Seventh Circuit Court of Appeals would serve the cause of justice by overturning the panel’s decision and letting the death sentence stand. The law does not require that this case be sent back to Madison County for a new sentencing phase.”
