Regional Cities Featured As Mobile Workshop During IN MPO Conference

The 2018 Indiana Metropolitan Planning Council will be hosting its yearly conference next week at the DoubleTree by Hilton Hotel in downtown Evansville.
The three-day conference will highlight transportation and connection planning as well as hear new strategies being implemented by other states and agencies.
The Council is comprised of all fourteen of the Metropolitan Plan Organization (MPO) executive directors in Indiana; and, functions as a forum to discuss issues, share solutions, and serve as the speaking voice in state legislative, executive and judicial matters.
The yearly conference allows the extended MPO staffs, as well as representatives from other state and local agencies, to share topics in current transportation planning practice.
One of the highlighted workshops available during the event features a presentation and tour of Regional Cities projects underway such as the YMCA, The Post House, and the Evansville Regional Airport.

Applications now available for 2019 Connect with Southern Indiana program

Connect with Southern Indiana, a regional leadership program managed by University of Southern Indiana Community Engagement, is accepting applications for its 2019 class. The annual program focuses on promoting active citizenship and developing creative problem-solving skills for individuals across a nine-county region in southwest Indiana. The deadline to apply is Friday, November 9.

Connect with Southern Indiana is designed to transcend traditional boundaries of towns and counties, occupation and demography. Participants will meet others from the region with similar concerns and interests, identify areas for collaborative projects and meet business and civic leaders.

“Several aspects of Connect with Southern Indiana set this leadership program apart,” said Leslie Townsend, director of Community Engagement. “Participants will learn unique problem-solving techniques from USI Entrepreneurship faculty that can be utilized in their careers.”

Faculty from USI’s Entrepreneurial Initiative, including Dr. Kevin Celuch, professor of marketing, and Bryan Bourdeau, instructor of management, as well as community leaders, will facilitate sessions on divergent and analytical thinking, idea generation, communication and strategic entrepreneurship from a community development perspective.

“I felt inspired by the questions asked by Dr. Celuch and felt personal growth through the ideation process with both ‘Coach K’ and ‘Coach B,’” said Laura Anderson, 2018 Connect with Southern Indiana graduate. “I would strongly encourage others to attend Connect with Southern Indiana. You will definitely learn something about the area and yourself!”

Connect with Southern Indiana is open to USI students and employees as well as Indiana residents living in Dubois, Gibson, Knox, Perry, Pike, Posey, Spencer, Vanderburgh or Warrick counties. Up to 24 individuals will be selected for the program.

“Because sessions are held in nine southern Indiana counties, participants learn about what makes this region special,” said Townsend. “Sessions might include a behind the scenes tour of Toyota or visits to cultural sites like Angel Mounds, Lincoln Boyhood or New Harmony.”

Participants will attend ten full-day sessions between January and May and develop a collaborative project, which they will present at the end of the program. Applicants should have an interest in improving the quality of life in their community and/or region, a desire to develop leadership skills and to become actively involved in their area.

Reversal Voids Sale Of Properties By Unauthorized Agent

The Indiana Court of Appeals reversed a decision granting summary judgment in favor of two companies who purchased real estate in a sale that was voided after the seller was found to have no authority to sell it.

In Feb. 2012, GO Properties, LLC was formed with two members, Larry Oliver of Olicorp Properties, LLC and Stacy Phillips of Gracie Properties, LLC. Olicorp was the designated member manager of GO Properties and had the sole authority to sign agreements and other instruments on behalf of GO. GO Properties then purchased four parcels of real estate in Indianapolis from Maxim Alliance Group.

Without notifying Oliver, Phillips filed a notice of change of registered officer or registered agent with the Indiana Secretary of State on Aug. 2013, which changed the registered agent from Olicorp to Gracie. Additionally, Phillips changed GO Properties’ principal address from Olicorp’s business address to her home address and handwrote her title as “Owner” of GO Properties on both documents.

Immediately, Phillips sold GO properties’ purchased land to Elden Investments. She hired Best Title Services to conduct the title examination, which failed to reveal a real estate mortgage with Maxim Alliance. Best Title relied on Phillips’ representation that she was the owner of GO Properties as it conducted its examination and later acted as closing agent for the transaction.

When the sale finalized, Elden Investments sold the properties to BER Enterprises and New Field. In April 2016, both BER and New Field filed for summary judgment, which the trial court granted when it found them to be bona fide purchasers of properties with voidable deeds.

On appeal, GO Properties argued the trial court erred by granting summary judgment in favor of BER Enterprises and New Field because the deeds were void. Both parties disagreed as to whether Phillips had apparent authority to act on behalf of GO Properties.

In its determination, the appellate court found that Go Properties made no direct or indirect statements indicating that Phillips had authority to act on its behalf and that documents filed by Phillips with the Secretary of State did not amount to statements made by GO Properties that create an apparent agency relationship.

“Nor would it be reasonable to conclude that Phillips’s own handwritten designation of herself as ‘Owner’ of GO Properties (she did not even bother to designate herself Member Manager) on the two forms constitutes a statement made by the principal bestowing her with apparent authority to act on its behalf,” Judge John Baker wrote in the Friday opinion.

The appellate court also found that no such statements were made during the title examination and that the individual conducting the examination testified that he relied only on Phillips herself.

“In sum, Phillips did not have actual or apparent authority to sell the Properties on behalf of GO Properties,” Baker concluded. “As a result, the original sale of the Properties to Elden Investments was void. Because the deed that Phillips executed on behalf of GO Properties was void, all future conveyances of the Properties were likewise void.”

Therefore, the judgment of the trial court was reversed and remanded with instructions to enter judgment in favor of GO Properties in GO Properties, LLC, and Maxim Alliance Group, LLC v. BER Enterprises, LLC; Mortgage Electronic Registration Systems, Inc., as Nominee for Franklin American Mortgage Company; New Field, LLC; et al., 18A-PL-176.

August Indiana Employment Report

Indiana’s unemployment rate stands at 3.5 percent for August and remains lower than the national rate of 3.9 percent. With the exception of one month when it was equal (October 2014), Indiana’s unemployment rate now has been below the U.S. rate for more than four years. The monthly unemployment rate is a U.S. Bureau of Labor Statistics (BLS) indicator that reflects the number of unemployed people seeking employment within the prior four weeks as a percentage of the labor force.

Indiana’s labor force had a net increase of 11,085 over the previous month. This was a result of a 2,594 increase in unemployed residents and an increase of 8,491 employed residents. Indiana’s total labor force, which includes both Hoosiers employed and those seeking employment, stands at 3.39 million, and the state’s 65.0 percent labor force participation rate remains above the national rate of 62.7 percent.

In addition, Indiana’s initial unemployment insurance claims continue to be at historical lows.

Men’s golf heads to NKU for weekend tournament Aces to play on Sunday and Monday

A busy start to the season continues for the University of Evansville men’s golf team as the Purple Aces travel to Batavia, Ohio for the NKU Fall Classic.

Hosted by Elks Run Golf Club, the tournament will feature 36 holes on Sunday and 18 more on Monday.  It has taken place each season since 2015.  Joining Evansville in the event are: Northern Kentucky, Detroit Mercy, Green Bay, Morehead State, Robert Morris, St. Francis (Pa.) and Thomas More.

Play each day begins with a shotgun start at 8:30 a.m. ET.  Par is 71 and yardage is set for 6,845.

Jessie Brumley was the top performer on Sunday as the Aces took 13th place in the EKU Intercollegiate.  Brumley carded a 1-under 69 to post the top round of the weekend for the Aces.  His effort saw him finish the three rounds with a 224, third on the UE team and tied for 60th overall.

Leading the team was Dallas Koth.  After recording scores of 74 and 72 on Saturday, Koth notched a 73 on his way to a 219, tying for 35th.  Spencer Wagner finished the tournament one behind Koth with a 220.  His final round score checked in at a 75.

Finishing third on the team with a 224 was Burmley while Noah Reese followed him with a 225.  Matthew Ladd completed the UE contingent with a 228 after carding a 73 on Sunday, his lowest round of the tournament.

Approximately 15 students from Cedar Hall Community School will spend their Saturday morning volunteering to help build the new Mickey’s Kingdom playground in Evansville. EVSC district office employees also will volunteer Saturday. The volunteers will work from 8 a.m. to noon.
