IS IT TRUE  on April 9, 2014, the City of Evansville was served with a TORT CLAIM NOTICE against the Evansville Police Department? …this notice states that you are hereby notified that Angel Santiago Pedrosa, does hereby make claim against the Evansville Police Department, unknown Officers, and other agents, and other representatives, and the City of Evansville for violations of his civil rights, harassment, and damages as the result of the Evansville Police Department’s unprofessional misconduct, and abuse of power? …this TORT CLAIM NOTICE also alleges that on April 2, 2015, Mr. Pedrosa was pulled from a vehicle he was a passenger in by numerous officers with the Evansville Police Department? …Mr. Pedrosa was repeatedly tazed, struck and punched by officers who kept shouting for Mr. Pedrosa to stop resisting? …the other passenger in the vehicle with Mr. Pedrosa was able to record the incident, with his cellular phone, and the recording clearly shows Mr. Pedrosa was not resisting, and that Mr. Pedrosa was the victim of a vicious, unprovoked, attack by the officers? …that this TORT CLAIM NOTICE further alleges that the acts of the Evansville Police Department were criminal, willful, wanton and malicious, as those terms are contemplated by 1.c. 34-13-1 et. seq., and were contrary to the written policies of the Evansville Police? …in addition, the conduct of the Evansville Police Department violated Mr. Pedrosa’s constitutional rights? …the amount of damages sought by the claimant is $700,000? …that well known and agressive trial lawyer Mark K. At this time, police are calling it a Battery w/ Serious Bodily Injury”?  …we want to thank the poster called Justplaindumb for this additional information?

IS IT TRUE it’s about time the Evansville City Council address the use of City Fire trucks at political picnics and rallies? …last Saturday “Evansville’s First Lady” McClintock posted on her Facebook that the Lorraine Park Picnic hosted by Missy Mosby and Laura Brown Windhorst was a great event? …only a few area residents (around 15 people) attended this event? …Evansville Fire Station #16 was in attendance at this poorly attended event? …the Mayor and “First Lady” McClintock were the only invited special political guests at this event?

IS IT TRUE that months and months ago Jeffrey Fisher was named General Manager of WEVV.? … when Bayou Broadcasting purchased the station they promised they would bring back a local news program each night on CBS44 and possibly FOX44? …the station’s sale has been finalized, Fisher is now General Manager replacing Tim Black and still there is no local news show? …what are we waiting for? … we encourage Jeff to get started immediately and enhance the local news competition in the Evansville area?

IS IT TRUE you need to take time and go to our Tri-State Voices TV Show posted in todays City County Observer video section? This weeks program features City Councilwoman Stephanie Brinkerhoff-Riley giving us an extremely investing presentation a the looming city debt facing the taxpayers of this community? … we agree with Brinkerhoff-Riley statement that professional services contracts should be bid out? …if this happens the taxpayers would save millions of dollars every year?

    Could it be true there may had been a language barrier, based off of the name given?

    IIT that we see the city police pull over “law abiding” citizens for shi* and giggles every day?

    Could it be true had video been produced from the time the police turn their lights on until the time
    the other passenger video was produce, would had told the real story?

    IIT that “body cams” were used during this event?

    Could it be true that “past records” of the suspect led to this “non- kitten glove” apprehension?

    • Could it be true he had just committed a felony? Is it true a simple google search would have told you that. Is it true this is more of the same from CCO.

      • This City now has four civil right case on file. . .maybe the rest of the story is Ziemer is getting richer? or. . . is this a trend? Do we believe that five cops were walking down the walkway and suddenly pick out this person of color and said “let’s beat the hell out of him” of course not. . .the question is when is enough. . .enough. . . if the report has any validity why would five police officers standing over this person handcuffed being kicked and tazered. . . i.e. if true? We all know that law enforcement has challenges and many are great at their job and we appreciate their sacrifices . . .but like all organizations there are always issues within the body and the EPD is no exception. . . the culture setting is always at the top. . . p.s. everybody has video nowadays. . .

        • As it seems, under the Wienzapfel Administration there was a search committee formed for the selection of the two most important position in the Administration, i.e. Police ans Assist Chief and the Fire Chief and Assit . . .the process was pain-staking and will served . . .however, the Winnecke administration apparently through out this process and determined the position on political acheivements . . .and in the final determination the positions were filled with individuals having questionable circumstances as alleged. . . .?

            Video does not lie. I sure hope that the Police had their body camera’s turned on when they were chasing this suspect and trying to subdue him when he could not understand what they were saying. Does he not really speak and or understand English?

          • Some people are ungovernable. Take a global look at the world and let your social scientist background go to work. What peoples follow the laws of the land, do well economically, live in crime free communities and live free of fear? Now look at the opposite side of that question. What is the commonality that separates the different groups. If a person runs from a police officer or attempts to resist or assault a police officer let them bring the can out. Speaking of white privilege, it’s nothing compared to affirmative actions, just means if you’re a white hetrosexual Christian male you just have to try a little harder and it seems to be paying off.

      Yes. I’m sure this nice lovely man was very polite trying to flee the scene where he had just committed a major felony. I’m sure he said “why yes mr police officer I did commit that felony assault and i was trying to escape. Please forgive me while I step out of the vehicle and politely place my hands behind my back. boy oh boy did i really mess up this time. I am ready to take full responsibility for my actions. Mr police officer i have willingly stepped out of the car.. why are you attacking me. Why are you repeatedly shocking me with your taser I am being very compliant”

            Our police are supposed to be trained to pursue, apprehend, restrain, and/or detain suspects, in a professional constitutional way and I expect them to be able to defend themselves and I also expect them to carry out their duties as stated above.

          And I agree with you on this one. They should use only the force necessary to arrest a suspect. Remember that we are all to be considered INNOCENT until proven guilty by a JURY of OUR PEERS.

          I’m not totally familiar with this entire story …. yet. But I’ll respond as I gather more information. I reserve the right to change my mind as I gather more information. Right now I’m trying to sort this incident out and figure out what really happened.

    • Well said, disaffected.

      I have zero idea about what is or is not on the video, and that also pertains to the dash video and body cams from all EPD personnel on scene.

      I think that 99.9% of the men and women that are EPD officers are brave and hard-working who make a concerted effort at abiding by the law and equally enforcing the law.

      That being said, the huge rise in citizen video cameras are providing a new and very disturbing insight into how there are far too many incidents where law enforcement personnel have been far too “zealous” in how they apprehend someone. I have watched an untold number of videos where citizens have been subjected to outright felony violence by law enforcement, up to and including death of the person being detained.

      Far too many people do not know their rights when stopped by law enforcement, and that is a problem (IMHO). All people who are approached by law enforcement have the EXACT same rights, and that includes a number of things. All people in America have constitutional rights under the 4th Amendment in regards to dealing with law enforcement.

      As you indicated, there are certain rights all members of the public are GUARANTEED under the law (starting with the Constitution and working its way down from there), and that includes the promise that if someone is taken into custody, there are rules and procedures in place designed to minimize injuries to BOTH sides.

      Not only that, is the precept of law of “innocent until proven guilty in a Court of law” no longer applicable?

      • There is no “right” to resist arrest. There is no “right” to flee when police order you to stop. If there were there would be no need for Courts of law. Or police, for that matter. Suspects would never be apprehended.
        The result is anarchy.

          • Meaning? More riots? Probably. Less law and order? Probably. Eventual anarchy? Probably.
            Here’s the thing, Bottomsup. Neither you, I, nor the rioters know what happened in Baltimore. We do, however, know what happened in Ferguson and it wasn’t what “the media” originally portrayed, which helped foment riots. Same in the Trevon Martin case.
            So, what are the police to do when a suspect flees or resists,. Yell stop, and when they don’t, say “oh well” and leave? That’s a sure path to anarchy.

          • The answer is yes. A portion of our society has become ungovernable. A society of feral children being raised by feral adults is now in it’s 4th generation, so Ferguson and Baltimore are just current results. The current situation in Indy is further proof of this, the crime in Indy is out of control but to put a stop to it would require some tough policing. The mayor has turned over Indy law enforcement over to the Feds in hopes of not being the next Baltimore. Looks like the criminals have won. Ferguson and Baltimore have made our police impotent and placed us all in danger.

        • I’ll agree on the lack of a “right” to resist arrest, but your example of not having a “right” to flee lacks substance to rebut.

          For example, if the police “stop” you, they are required to give you what is commonly known as a “reasonable articulated suspicion” that you have or are going to commit a crime. Police are not allowed to just stop people without reason. The legal terms that this would violate are numerous, but one example of that would be “profiling”

          If stopped by the police, they are required to give you the reason for the stop, but 99.9% of the time you have to know to ask them that. At that point they are required to provide that “reasonable articulated suspicion”. If they do not provide that, your next question should always be “Am I being detained, or am I free to go?”. Law enforcement MUST have a reason to detain you, which is where your 4th Amendment rights start kicking in.

          In summary, a police order to “stop” is probably valid, but law enforcement has a legal duty and requirement that covers them demanding that you “stop”. But a citizen who does not know what their rights are under the law can quickly and easily get in hot water, so to speak.

          • This mornkng on NPR they cited some supreme court ruling that basically says yes, cops can stop you for no reason whatsoever. We’re really living under martial law at the moment. Several of the necessary elements are in place. About all we are missing is a dusk to dawn curfew.

      • It’s not what happens but what you can PROVE happened that matters. Video cameras are a key to proving what really happened. Vs a he said she said incident without any video or audio documentation and zero eye witnesses. Even eye witnesses can be mislead or wrong. Memory is a tricky thing at times when people are stressed or even when they are not stressed. But Video that’s not edited does not lie. It may only show part of the story but it does not lie per-se.

          On another related topic… I saw the EFD Chief Fire Investigator shopping at Best Buy the other day. He should be shifting though the remains of that boat and telling the public what caused the fire on the House boat at Inland Marina back in Feb 14, 2015. It’s been long enough to find the cause of the fire and to report that cause to the general public though the news media. If he has time to go shopping at Best Buy then is he out there goofing off? Or maybe he was looking for a new Camera to help him do his job better. But in any case it’s been way too long and he need to get to work on this case and clear it once and for all in the public domain.

    • noitall, The trucks are out all the time. Going to the grocery, test driving, public relations, plus many other reasons. IIT writer is trying hard to find something to bash the city about that they haven’t worn out.

      • Cowboy: They should be kept in the Fire Stations unless they are responding to a fire. There is not excuse to use a fire truck ( they don’t get good gas mileage) to run to the grocery store. Those guys can buy their groceries before they go to work and use their personal vehicles to do that. They don’t need to be out running around in a $500,000 Fire truck getting toilet paper for the fire station.

        Test driving? How many times does one have to do a test drive before they can actually drive the fire truck to a fire? They get fire runs almost daily or at least once a month or more and they can get plenty of practice driving the fire truck. Believe me it’s not that hard to drive a fire truck. Unless it’s a very big Ladder truck which may take some extra training. But one can learn to drive a fire truck without much work. All they need to know how to do is work a manual shift vehicle with a clutch. And newer trucks have automatic transmissions in them so that makes it even easier to drive. So they don’t need to be going out to Missy’s Political Events to help her get elected. That’s a total miss use of the equipment.

    I wonder if Tri State Voices TV show or the City County Observer will provide regular CCO blogger, Stephanie Brinkerhoff-Riley, the opportunity to follow up her city debt presentation with an opinion piece regarding state legislator and mayoral candidate Gail Riecken’s proposed amendment language that would make it crystal clear that SBOA audit exit conferences are private meetings that cannot be electronically recorded, that information shared and presented at exit conferences is confidential, and that recording or divulging such information prior to its official release to the public by SBOA, as Stephanie Brinkerhoff-Riley did, would be illegal.

    It also would be interesting to have Ms. Brinkerhoff-Riley’s take on Ms. Riecken’s statement that she feels the amendment language is needed because of the grandstanding event where Brinkerhoff-Riley’s released audit information that the State Board of Accounts considered confidential.

    • it should be LEGAL to record and disclose any information that is presented about the City’s Finances. We the tax payers should be entitled to know all there is to know about how the Mayor spends OUR MONEY. Anyone who thinks the finances should be hidden may have a criminal agenda maybe.
